Rahul Gandhi's demand for digital voter list legally untenable: Experts

New Delhi: Leader of the Opposition (LoP) in Lok Sabha Rahul Gandhi's persistent demand that ECI provide machine-readable digital copies of the voter lists for the 2024 Lok Sabha elections and subsequent Vidhan Sabha elections appears to be legally untenable, said constitutional experts and sources on Thursday.
Election Commission of India insiders said an earlier Supreme Court verdict has already settled the matter in favour of the poll panel.
They suggest that LoP Rahul Gandhi's repeated attempts to rake up the demand for 'machine-readable digital copies' are nothing more than a publicity stunt, as the apex court has already ruled against such a demand.
Poll panel insiders shared excerpts of the Supreme Court's verdict on a writ petition filed in 2018 by Kamal Nath, the then president of the Madhya Pradesh Congress Committee, that said, 'The format in which the draft electoral roll is supplied to the petitioner fulfils the requirement contained in the Election Manual.'
'If the petitioner so wants, he can always convert it into searchable mode, which, of course, would require him to put his own efforts,' said the Supreme Court judgment.
Insiders in the ECI have shed light on the apex court judgment in the backdrop of LoP Rahul Gandhi's allegation of 'fixed election' in Maharashtra last November and the Election Commission's invitation to him to sit for a doubt-clearing session, an offer which he has not accepted yet.
'While it is factually correct that Rahul Gandhi, Leader of the Opposition, has been demanding a machine-readable, digital copy of the electoral roll for the last seven months, such a demand by the Congress is not new,' said an official source.
The demand, it seems, is part of a strategy by the Congress for well over eight years, a fact that appears to have been selectively obscured in the present representation, he said.
'The position historically maintained by the Indian National Congress is not tenable within the contours of the prevailing legal framework. It may be recalled that this very issue has already been agitated by the Congress before none other than the highest constitutional court of the country,' he said.
An ECI insider cited the Supreme Court decision on the matter, which said: 'We find force in the submission of ECI. Clause 11.2.2.2 of the Election Manual uses the expression 'text mode'. The draft electoral roll in that mode, i.e. text mode, has been supplied to the petitioner. The clause nowhere says that the draft electoral roll has to be put up on the Chief Electoral Officer's website in a 'searchable PDF'.'
'Therefore, the petitioner cannot claim, as a right, that the draft electoral roll should be placed on the website in a 'searchable mode'. It has only to be in 'text mode' and it is so provided,' said the SC verdict, quoted by the expert.

Elections are being stolen in India and that is the reality.' Congress sources said Gandhi was referring to Bangalore North constituency. Sharing a video of his remarks on X, Gandhi said, 'We showed everyone how match-fixing happened in Maharashtra. We investigated one Lok Sabha seat in Karnataka — large-scale vote theft was found, we will soon bring it before the public.' Gandhi said that in Bihar, votes of SC, ST and OBC communities and minorities are being stolen in the name of the electoral roll revision.

'The Constitution grants the right to vote to every person above 18 years, regardless of wealth or status. This equality must not be infringed,' he said. The Opposition, he insisted, 'wasn't against the SIR itself' but opposed the process. Referring to complaints cited by the Election Commission about non-resident and 'external' voters. 'The Election Commission should work honestly and transparently, but it is not doing so. We strongly oppose and deny this in the House,' he said. 'It is shameful that such a significant drive is going on and yet the Election Commissioner has not addressed the press to clarify their position; instead, information emerges only through unnamed sources.' He also wondered at the 'urgency' of conducting the exercise, pointing out that the last such revision in 2003 took two years to complete. 'If the process is so important, why not start after the Lok Sabha elections? Why was it initiated now, during the monsoon season?' he asked. 'Bihar is at the bottom in terms of essential documents, whether it's a birth or death certificate. Only 2.3% of people have the necessary documents. Now, 11 documents are being demanded which most poor people don't possess. Why aren't Aadhaar, ration cards, or MNREGA cards being accepted, despite Supreme Court suggestions?' This figure includes both 3.5 crore registered workers and around 1 crore unregistered voters who, despite their tenure outside, 'return to Bihar to vote'. 'There is now a risk their names may be deleted from the rolls,' the LOP argued. Addressing allegations about foreign nationals on the rolls, he said: 'The matter is pending before the Supreme Court. In the 780-page affidavit filed by the Election Commission, there is no mention of any Bangladeshi, Nepali, or Myanmar national. Even BJP's over 52,000 Booth Level Agents have never raised such complaints with the Election Commission.' In response, Chief Minister Nitish Kumar accused the Opposition of making electoral rolls revision 'an issue because of their lack of work and upcoming elections'. The RJD too had been in power once, he went on to say. 'Why are you raising these issues now? 'Look at what your budget used to be earlier, and how much more we've done for everyone now. Wherever there were gaps, we've addressed them… Whenever there was a need, we made sure the work got done,' he said.
