But prosecutor Sarah Fiddy alleged Ozzy had slipped out of the kitchen when the builder was being asked if he wanted a drink. In a statement read in court the workman said the attack had caused significant physical and financial impacts as he had been unable to work. It has been a criminal offence to own an XL Bully without an exemption certificate since legislation was tightened up in February 2024. The court was told Ozzy had been registered as exempt, but could now be subject to a destruction order following the attack on Samson Road in Norwich on January 21. Daniel Savino, 46, the partner of the dog's owner who had been looking after Ozzy on the day, pleaded guilty to being in charge of a dog dangerously out of control when it caused injury. The dog had been insured and there had been a £12,000 pay out, the court heard. District Judge Matthew Bone told Savino he would be sentenced on September 25 and that all options would be considered, including prison. His defence solicitor said the dog had been bought four years ago before the change in legislation and that his behaviour had been 'out of character" as he normally had a well behaved temperament. He said it had been an 'unfortunate slip' that he had escaped from the property despite there being three door gates.
