Judges' transfer: IK challenges order of SC CB

ISLAMABAD: Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan on Friday challenged the Constitutional Bench of the Supreme Court's order in the transfer of judges to the Islamabad High Court (IHC).
The former prime minister, on Friday, filed an Intra-Court Appeal (ICA) under Section 5 of the Supreme Court (Practice and Procedure) Act, 2023, read with Article 184(3) of the Constitution, praying to set aside the impugned order dated 19-06-2025.
The Constitution Bench on June 19, 2025 by majority of 3 to 2 held that transfer of judges under Article 200 is within the framework of the Constitution, and transfer (permanently or temporarily) cannot be construed as a fresh appointment.
The bench without upsetting the notification of transfer of judges in the IHC remanded the matter of seniority to the president of Pakistan to determine the seniority after examining/vetting the service record of the transferee judges as soon as possible, including the question of whether the transfer is on a permanent or temporary basis.
The petitioner contended that the constitutional bench erred in remanding the matter to determine whether the transfer was 'temporary' or 'permanent'. This is a judicial question, and delegating it to the president undermines judicial autonomy and violates the principle of separation of powers.
He stated that the Constitutional Bench failed to appreciate the distinction between the term 'functions' and 'powers' of the president under the Constitution.

Deputy Opposition Leader in the Punjab Assembly, Muhammad Moeenudin Riaz, told journalists that they had written to the CJP to draw his attention to these serious violations, noting that PTI lawmakers and supporters were sentenced despite these concerns being ignored. He said the letter also urged the Chief Justice to review the decisions handed down by the ATCs, which awarded sentences to PTI lawmakers and supporters in connection with the May 9 incidents. "No PTI leader, worker, or supporter was given a fair opportunity to engage proper legal defence in the May 9 cases," Riaz stated. 'What to speak of PTI leaders and workers—even the lawyers representing them were not granted adequate time to prepare their cases,' he added. He emphasised that the right to a fair trial and due process is guaranteed under Article 10-A of the Constitution. Riaz also said that the opposition has demanded the formation of a judicial commission to investigate the May 9 cases and called for the media to be granted access for proper coverage of these proceedings.

Vice Chief of the Naval Staff, Vice Admiral Ovais Ahmed Bilgrami on Monday conferred various military awards upon Pakistan Navy personnel, including Sitara-i-Imtiaz (Military), Tamgha-i-Imtiaz (Military), Tamgha-e-Basalat and Tamgha-e-Khidmat (Military). The vice chief of the naval staff graced the Pakistan Navy Investiture Ceremony (North) in Islamabad as the chief guest. On this occasion, Sitara-i-Imtiaz (Military) was awarded to Commodore Syed Muhammad Abbas Naqvi, Commodore Aamer Rasheed Malik, Commodore Kashif Elahi, Commodore Muhammad Afsar Khan, Commodore Rao Ahmed Imran Anwar, Commodore Dr Anwar Hussain, Commodore Shahid Ahmed, Commodore Raja Muhammad Nasir, Commodore Jawad Haider Khawaja, Commodore Muhammad Zahid Zaheer, Captain Jawad Malik PN and Captain Atif Aman Chughtai PN, the Director General Public Relations (DGPR) – Navy said. Whereas, the recipients of Tamgha-i-Imtiaz (Military) were Captain Hasan Ali Chauhan PN, Commander Zahid Mahmood Javed PN, Commander M Fahad Farooq PN, Commander Tahir Jabran Khan PN, Commander Aqeel Iftikhar PN, Commander Muhammad Tariq Rehman PN, Commander Abdullah PN, Commander Nadia Zulfiqar PN, Commander Umair Hafeez PN, Commander Asghar Ali PN, Lt Commander Nazish Javid PN, Lt Commander Muhammad Naeem PN, Lt Commander Shah Nawaz Abbasi PN, Lt Commander Talha Naveed PN, Lt Commander Muhammad Ali Shah PN and Lt Commander Mohsin Rashid PN. The recipients of Tamgha-e-Basalat were Lt Commander Imran Haider PN and Lt Commander Badruddin Khilji PN. Six awards of Tamgha-e-Khidmat (Military)-I, four awards of Tamgha-e-Khidmat (Military)-II and 15 awards of Tamgha-e-Khidmat (Military)-III were also conferred upon chief petty officers (CPOs) and sailors of Pakistan Navy, whereas letters of commendation from chief of the naval staff were awarded to 30 officers, CPOs/ sailors and navy civilians. The ceremony was attended by a large number of senior, serving and retired officers of Pakistan Navy.

Listen to article Three terrorists from banned Tehreek-e-Taliban Pakistan (TTP), including one allegedly involved in last year's attack on Chinese engineers, were killed in a joint operation by the Counter-Terrorism Department (CTD) and intelligence agencies in Karachi's Manghopir area late Sunday night. On 5 November 2024, a private security guard at a textile mill in Karachi opened fire and seriously injured two Chinese nationals. According to police, deceased suspect, identified as Zafran, had a Rs20 million bounty on him and was accused of involvement in the 2024 Liberty Textile attack targetting Chinese nationals. He was also linked to the Karachi Police Office (KPO) assault. He emphasised that the protection of Chinese nationals remained a top priority, especially given ongoing China–Pakistan Economic Corridor (CPEC) projects, vital to the bilateral relationship between the two countries. Police said terrorists opened fire when they spotted them approaching, triggering a gunfight that lasted over an hour. All three suspected terrorists were killed, said police, adding that a fully assembled suicide jacket, three grenades, a Kalashnikov rifle, two pistols and a large cache of ammunition were recovered from the site. Moreover, police found a diary which listed two to three high-value prospective targets. The second deceased suspect was identified as Qudratullah and the third's identity is yet to be confirmed. The CTD chief said the three slain suspected terrorists belonged to TTP cell dispatched from Afghanistan. Intelligence officials had been surveilling the cell for several days, he added. Khattab further added that the TTP cell in question is believed to have five members but only three were present at the safehouse during the raid. A search operation in the area and further investigation are under way.
