Government approach to Omagh bomb hearing ‘risks undermining public confidence'

Counsel to the inquiry Paul Greaney KC told a hearing in Belfast that it was 'highly unfortunate' that legal papers relating to the redaction of names were received on the evening before the public session.
Mr Greaney also said that as the hearings related to transparency, he would have thought the Government 'would have been scrupulous to avoid the impression that it was behaving in a way that was procedurally unhelpful and possibly even unfair'.

The hearing was told that applications from the Government and the PSNI to redact names of junior civil servants and bombing suspects from documents released to core participants in the inquiry is 'putting a brake' on its work.
The Omagh Bombing Inquiry, chaired by Lord Turnbull, is holding procedural hearings in Belfast which relate to submissions to redact information from materials.
The Real IRA bomb in the Co Tyrone town in August 1998 killed 29 people, including a woman who was pregnant with twins, in the worst single atrocity in the Troubles in Northern Ireland.
The public inquiry was set up by the previous government to examine whether the explosion could have been prevented by the UK authorities.
Earlier this year the inquiry heard personal statements from those affected by the massacre.
On Wednesday, Mr Greaney said there were two issues which the latest hearings would deal with.
The first relates to a Government submission that the names of junior civil servants should be redacted from documents they provide before they are released to core participants.
The second relates to a PSNI application to redact the names of suspects who have not been charged from documents.

The barrister said the inquiry would see the documents in unredacted form but the issue was whether they should be redacted before they are given to core participants.
Core participants in the inquiry include the families of those who were killed in the bombing as well as multiple people who were injured.
He said the issue of whether the names would be disclosed unredacted during oral evidence hearings would be dealt with at a future point.
He said: 'The current position of HMG (His Majesty's Government) and PSNI is putting a brake on the work of disclosure of the inquiry.'
Setting out the background, Mr Greaney said the inquiry legal team had written earlier this year to the Government, asking it to make any applications for redaction by March 14.
He said: 'Even at that early stage, in March of this year, as many as 80 documents were having to be withheld from disclosure.'
The barrister said the Government made an initial application on March 31, then withdrew it and made a revised application for redactions of the names of junior civil servants on April 15.

He said the inquiry's legal team proceeded on the basis that this was the Government's position.
Mr Greaney added: 'It was therefore with considerable surprise and some frustration that at 4pm on 20th May, so yesterday and therefore the day before the hearing was scheduled to start, and moreover in circumstances in which we suggest it ought to have been anticipated that members of the inquiry legal team and the chairman and indeed core participants and their representatives would be travelling to Belfast, in those circumstances a skeleton argument was emailed to the inquiry legal team by the Crown Solicitor's Office on behalf of the Northern Ireland Office.
'The inquiry legal team regard the unexpected service of a skeleton argument at such a late stage as highly unfortunate.'
He added: 'This inquiry is about whether the Omagh bombing could have been prevented by UK state authorities. It is also notable this hearing concerns issues that could be described as ones involving transparency.
'It might be thought that HMG would have been scrupulous to avoid the impression that it was behaving in a way that was procedurally unhelpful and possibly even unfair.
'It seems to the inquiry legal team a risk that the approach taken by HMG to this hearing will undermine public confidence in HMG's approach to this inquiry.'
The barrister said there had seemed to be 'a chaotic rush to provide materials at the very last minute'.

Later, Lord Turnbull addressed Fiona Fee, senior counsel at the inquiry for Northern Ireland Secretary Hilary Benn.
He said he had been disappointed to receive written notes from her as he was boarding a plane to Belfast the previous evening.
Lord Turnbull added: 'I should imagine you only instructed to prepare that note very recently and, if so, I would like to say that disappoints me in respect of the level of engagement with the inquiry which it implies.
'We are likely to be spending a significant amount of our professional lives in each other's company and I would hope we could do so in a harmonious, constructive and mutually respective manner.
'But it does seem to me those aspirations are unlikely to be easily achieved if core participants, or their representatives, engage with the inquiry in a manner which appears to demonstrate a lack of prioritisation or allows an impression to be gained of a disrespectful or a disorganised attitude towards the work of the inquiry.'
Ms Fee said no discourtesy to the inquiry had been intended and it had been hoped the written note would assist its work.
She said: 'We are genuinely dismayed that the service of the document has caused consternation and the fact that our attempts have had the opposite effect to that which was intended, and hoped for, is a matter for real and sincere regret and is taken extremely seriously.'
The inquiry also heard submissions from a barrister for the PSNI.
It will later hear submissions from legal representatives of the office of the Police Ombudsman, bereaved families and media organisations.

Steve Reed announced in a speech alongside the River Thames that regulator Ofwat would be scrapped, as part of measures to pull overlapping water regulation by four different bodies into one 'single powerful' regulator responsible for the whole sector. He made the announcement in response to an independent review by Sir Jon Cunliffe which called for the move, as one of 88 measures to tackle problems in the water sector. The review was commissioned by the Government to answer public fury over pollution in rivers, lakes and seas, soaring bills, shareholder payouts and bosses' bonuses. Mr Reed pledged the new regulator would 'stand firmly on the side of customers, investors and the environment', as he said the Government would cut sewage pollution by half by 2030 – based on a new, higher baseline of pollution in 2024 compared with previous targets relating to 2021. And it would oversee maintenance and investment in water infrastructure so that 'hard-working British families are never again hit by the shocking bill hikes we saw last year'. Questioned by journalists after the speech about future bill hikes, Mr Reed insisted it was 'absolutely the intention' that the reforms would ensure there was adequate investment in the long term to prevent the kind of 30% increase seen in customer water bills last year at the next price review in five years. He also accused the Tories of failing to ensure sufficient investment in crumbling pipes and infrastructure that would have prevented the recent hikes. But in a separate speech, review author Sir Jon warned that costs and bills are likely to continue to rise, as he recommended the Government introduce a national social tariff to help households struggling to pay. 'The cost of producing water and wastewater services is likely to increase over the medium and longer term as the industry has to replace ageing assets, respond to higher environmental and public health standards and continue to adapt to the challenges of population growth and climate change,' he said. 'And against that likely background of rising costs and rising bills, there is a need for a stronger safety net for the most vulnerable when exposed to water poverty.' Asked if investor returns will need to rise to attract the capital needed and contribute to bill hikes, Sir Jon said: 'All the investors I talked to said we are happy to accept a lower return … if you can give us lower risk on the downside. 'Bills will have to reflect what investors need, the equity they need. 'That is part of the cost of building the infrastructure that we need but at the same time, a regulator needs to continue to maintain pressure and efficiency.' Sir Jon's review did not explore renationalising water companies; ministers have refused to entertain the possibility despite demands from campaigners to return them to public ownership. Mr Reed warned nationalisation would cost £100 billion and slow down efforts to cut pollution. He said it was not the answer, adding: 'The problems are to do with governance and regulation, and we are fixing those problems so we can fix the problem of sewage pollution and unacceptable bill hikes in the fastest time possible.' The reforms would see a single regulator replace Ofwat and take in functions related to the water sector from the Environment Agency, which currently investigates pollution incidents and licenses water abstraction from the environment, as well as the Drinking Water Inspectorate and Natural England. Sir Jon suggested a new water regulator would take two years to set up after looking at the time frame for setting up Ofcom, the communications regulator, in the early 2000s. The process could involve bringing the different organisations together as one before integrating the staff and working out where there may be duplication or gaps. Sir Jon also said the Government will have to tackle the issue of securing a 'very high level of leadership', adding that the current system does not have the skills and expertise that will be needed in the new set-up. Asked if ministers need to carry forward all of his 88 recommendations to ensure a full reset of the sector, he said: 'I don't think you're going to solve the fundamental problem unless you tackle all of those issues. 'I think you can get improvement on all those dimensions, but I do think you need to address it all in order to move us to a different place.'

John Swinney demands ‘urgent international action' after aid convoy attack

John Swinney has demanded 'urgent international action' in response to Palestinians being killed while waiting for aid lorries in Gaza. The Israeli Defence Forces are said to have fired what it described as 'warning shots' at crowds who gathered around aid trucks bringing emergency supplies. The Scottish First Minister insisted: 'Reports that those seeking what little aid is permitted to enter Gaza face violence and death at the hands of the Israeli government demands urgent international action.' His comments came as the UN World Food Programme told how its 25-truck convoy 'carrying vital food assisted' for 'starving communities in northern Gaza' had come 'under fire from Israeli tanks, snipers and other gunfire'. In a statement after the incident on Sunday July 20, it said: 'We are deeply concerned and saddened by this tragic incident resulting in the loss of countless lives.' Mr Swinney said that that was 'unbearable to read'. He insisted: 'The international community must require the Israeli Government to stop these attacks and there must be a ceasefire now to allow humanitarian aid to flow.' The First Minister made the demands as he wrote in a letter how a recent attack on the only Catholic church in Gaza had brought the 'horror of the situation painfully close to home'. Mr Swinney and his wife Elizabeth met the priest from the Holy Family Church in Gaza, Father Gabriel Romanelli, in Glasgow last year. Father Romanelli was injured when an explosion hit the front of the church, killing three people and leaving others seriously injured. Pope Leo XIV has already said he was 'deeply saddened' by the 'military attack' on the church. And in a letter to Cardinal Pierbattista Pizzaballa, the Latin Patriarch of Jerusalem and leading Catholic authority in the area, Mr Swinney told how people across Scotland are 'moved with both distress and anger at the unimaginable suffering facing the people of Gaza'. The First Minister told Cardinal Pizzabella: 'The heart-breaking reality of the situation in Gaza is that this tragedy, that has taken the lives of three of your parishioners, is but one of an untold number of tragedies that has come to pass in the region since October 7 2023.' Mr Swinney continued: 'That the people of Gaza can not even find peace and sanctuary within the confines of their place of worship beings me real pain.' He told the Cardinal that he would 'pray for the families of the dead, for the injured and for lasting peace in Gaza'. But Mr Swinney also pledged: 'The government I will lead will continue to do everything it can to help achieve a ceasefire in the region.' The First Minister's comments came as he noted that 'over 55,000 people have been killed in Gaza since the conflict began', adding that 'many more are being starved of food, water and humanitarian aid'.
