Transparency In Banking Vital To Combat Fraud, Build Trust, Says Legal Expert

KUALA LUMPUR, May 29 (Bernama) -- Consistent and transparent disclosure of internal compliance information by banks—particularly in cases involving suspicious cross-border remittances—is key to boosting corporate confidence in Malaysia's financial system, said legal expert Datuk J. Shamesh.
He said pre-action discovery mechanisms, increasingly recognised by Malaysian courts, are playing a pivotal role in compelling financial institutions to disclose crucial documents that could help uncover fraudulent transactions.
'Legal tools such as the Norwich Pharmacal relief and Order 24 Rule 7A of the Rules of Court 2012 allow aggrieved parties to seek access to a bank's internal documents—even before initiating formal legal proceedings—especially in cases involving potential fraud, money laundering or questionable transfers,' said Shamesh.
Speaking to Bernama, the lawyer also highlighted that while these tools are not intended to implicate the bank, they enable access to records that may assist in identifying wrongdoers or enforcing legal rights.
The corporate lawyer cited the case of First Malaysia Finance Bhd v Dato' Mohd Fathi Haji Ahmad [1993] 3 CLJ 329, in which the court endorsed the Norwich Pharmacal principle, ruling that a third party, such as a bank, can be ordered to disclose information if it is innocently mixed up in potential wrongdoing.
Shamesh explained that this decision confirms that compliance records, anti-money laundering (AML) frameworks, internal alerts, and audit trails can be disclosed when legitimate legal interests are at stake.
He further noted that courts may issue disclosure orders when there is evidence of fraud, financial misconduct, the use of third-party accounts for illicit fund transfers, suspected breaches of internal compliance policies, or money laundering activities involving cross-border transactions.
'These disclosures are especially important when doubts arise about a bank's internal controls or when red flags are raised during due diligence,' he added.
Shamesh stressed that consistent and transparent cooperation by banks in such proceedings could significantly strengthen trust among corporate clients.

KUNAK: 74-year-old substitute driver was killed and nine others injured after a van crashed at KM29 of Jalan Kunak-Lahad Datu early this morning. The incident occurred around 7 am when the driver reportedly lost control of the vehicle. Acting Kunak police chief ASP Reduan Rahman stated that the Hiace van, carrying 10 passengers, veered off the road. 'Four passengers suffered minor injuries, while five were seriously hurt. The van was en route from Semporna to Sandakan,' he told Bernama. Fire and Rescue operation commander Mohd Ridzuan Shahidun said emergency services arrived at 7.50 am after receiving a distress call at 7.19 am. The driver, trapped in the seat, was rescued using Hydraulic Power Unit (HPU) equipment. All passengers, aged between 46 and 75, received initial treatment before being transported to hospital via Emergency Medical Rescue Services (EMRS) and an ambulance. Police are investigating the case under Section 41(1) of the Road Transport Act 1987.

KUALA TERENGGANU: The bodies of a man and two children who died after a boat capsized off Pulau Perhentian will be brought to Butterworth, Penang, and Sungai Petani, Kedah, for their funerals. Dr K. Balachandran, special officer (non-Islamic affairs) to the Terengganu Menteri Besar, said the post-mortems of S. Arumugam, 40, his daughter A. Sarrvihka, 3, and another relative, V. Vennpani, 10, were completed at 4.30pm today. He said all 15 passengers in the boat were related and frequently holidayed on islands in Terengganu. "The remains of the father and daughter will be taken back to Butterworth, while Vennpani's remains will be sent to Sungai Petani," he said, according to a Bernama report. Balachandran said the 15 victims from four families arrived in Terengganu on Friday and were supposed to return today. "I am made to understand that on the night of the incident, they were on their way back from Pulau Perhentian Kecil to Perhentian Besar after dinner," he said. He added that the survivors were still in shock and traumatised by the incident. Last night, the boat carrying 15 passengers aged between three and 40, capsized during a storm. Besut police chief Superintendent Azamuddin Ahmad @ Abu later said that the boat driver, who tested positive for drugs, has been arrested. Tourism, Arts and Culture Minister Datuk Seri Tiong King Sing said that the travel agency and boat operator had no licence to operate.
