: Congress MP from Rae Bareli and leader of opposition in the Lok Sabha Rahul Gandhi will appear before the MP/MLA court in Lucknow on Tuesday in a case related to disparaging remarks allegedly made by him about a face-off between Indian and Chinese soldiers. Advocate Vivek Tewari had filed the complaint against Rahul Gandhi on behalf of Uday Shankar Srivastava, a former director of the Border Roads Organisation with a rank equivalent to an Army colonel, in January 2023.
Rahul Gandhi's alleged statement was derogatory towards the Army and hurt the sentiments of the armed forces, according to the complainant.
Additional chief judicial magistrate Alok Verma, Lucknow, had earlier directed Rahul Gandhi to appear before the court on March 24, 2025, in the defamation case filed against him.
Gandhi had challenged the additional CJM's order, passed on February 11, 2025, in the high court but did not get relief.
Dismissing Congress leader Rahul Gandhi's petition, the Lucknow bench of the Allahabad high court held that the right to freedom of speech and expression does not extend to making defamatory statements against the Indian Army.
Gandhi had challenged the summons by a local court in connection with a case related to his alleged remarks on the Indian Army.
A single-judge bench of Justice Subhash Vidyarthi on June 2, 2025, passed the order, rejecting Rahul Gandhi's petition challenging the additional CJM's order.
'No doubt, Article 19(1) of the Constitution of India guarantees freedom of speech and expression, this freedom is subject to the reasonable restrictions and it does not include the freedom to make statements which are defamatory to any person or defamatory to the Indian Army,' the high court observed.
The high court dismissal of his petition paved the way for Rahul Gandhi to face trial in the lower court.

Prime Minister Narendra Modi will launch development projects worth more than Rs 7,000 crore during his visit to Bihar on Friday, a senior party leader said. According to state BJP president Dilip Jaiswal, Modi will address a public meeting at Gandhi Maidan in Motihari town, the headquarters of East Champaran district. 'That Bihar is high on the Prime Minister's agenda can be gauged from the fact that he will be visiting the state for the 53rd time since he assumed power. The state will be showered with development projects worth Rs 7,196 crore,' Jaiswal said. He added that the projects are related to diverse sectors, including railways, national highways and roads, rural development, animal husbandry and dairy farming, and Information Technology. 'The projects relating to railways are worth Rs 5,398 crore while national highways and roads would account for another Rs 1,173 crore. IT projects, aimed at strengthening digital infrastructure, would involve a cost of Rs 63 crore,' Jaiswal said. The BJP leader also said that at the function, the PM will disburse an amount of Rs 162 crore, through direct cash transfer, to 40,000 beneficiaries of Pradhan Mantri Gramin Awas Yojana while another 12,000 people will be handed over the keys to their new houses. 'In addition, financial assistance of Rs 400 crore will be extended to 61,500 self-help groups during the function. Bihar, which sees Modi as family, awaits the PM eagerly,' Jaiswal added. NEW DELHI: Stepping up his attack on Election Commission (EC), Congress leader Rahul Gandhi on Thursday alleged that the EC has been caught 'red handed' stealing votes in the name of Special Intensive Revision of electoral rolls in Bihar, and asked whether the poll body has completely become BJP's 'Election chori branch'. The EC has all along maintained that the revision, being held after 22 years, will cleanse the voters' list of ineligible people, duplicate entries and include those eligible as per law. Gandhi shared a post by Ajit Anjum, whose YouTube channel is running a series on special intensive revision (SIR) of electoral rolls in Bihar. 'The EC in Bihar has been caught red handed stealing votes in the name of 'SIR'. Work - just theft but name is 'SIR' and FIR will be lodged against the one who exposes it!' NEW DELHI: The Public Accounts Committee (PAC) headed by Congress MP K C Venugopal on Thursday called for review of the functioning of Unique Identification Authority of India (UIDAI) and raised concerns over erroneous Aadhaar details, flagging that this denies people access to government benefits. 'This is a common man's issue. We flagged various problems and have raised several questions,' Venugopal told the press after the meeting. Venugopal said Aadhaar-related issues directly affect common people and require serious attention, especially those linked to biometric verification. The panel will examine the matter in detail. The committee, sources said, told the authorities to put out a circular at the earliest to inform people of the requirements to get Aadhaar and look into simplifying the process. The panel also recorded briefings from officials of the Ministry of Electronics and Information Technology, and the UIDAI. According to sources, several MPs raised concerns of data breach, to which the UIDAI officials replied that their central repository is unbreachable. Sources said some MPs were of the view that since Aadhaar is considered residency proof and does not certify one's citizenship, authorities should reconsider if this alone should be the basis for identifying eligible beneficiaries of government welfare schemes. Only an Indian citizen should be entitled to government benefits, a source said, noting that scandals related to people with fake documents getting Aadhaar have often come to light.
