FIR against AAP leaders in Gwalior for ‘insulting' BJP flag

Bhopal: A political row erupted in Gwalior after the police registered a case against several Aam Aadmi Party (AAP) leaders and workers for allegedly insulting the BJP flag during a protest against poor road conditions in the city. The FIR was lodged on Friday night following a complaint by BJP district coordinator Kamal Makhijani. During the protest held in the Kailash Vihar area of City Center, AAP workers reportedly planted the BJP flag in mud near a garbage heap to highlight the deteriorating condition of roads after a brief spell of rain. The party's campaign, titled 'Jahan Sadak Par Gadda Hoga, Wahan BJP Ka Jhanda Hoga', there will be a BJP flag, aimed to symbolically hold the ruling party accountable for Gwalior's crumbling infrastructure. However, the demonstration sparked controversy after allegations emerged that AAP workers not only buried the BJP flag in mud but also spat on it. BJP leaders claimed the act was deeply offensive and hurt the sentiments of party workers. The FIR has been filed against AAP's state vice president Advocate Rohit Gupta, state co-secretary Amit Sharma, Ashish Rai, Rahul Gaur, Trilochan Singh, Sheeladevi, and others under sections related to promoting enmity and hurting sentiments. Reacting strongly to the police action, Advocate Rohit Gupta told media that AAP is being targeted for raising genuine civic concerns. Gupta also accused the BJP of misusing police machinery to suppress dissent. AAP leaders claimed they had approached the administration several times demanding road repairs, but their pleas were ignored. BJP leaders maintain that while political protests are acceptable, using party symbols in a derogatory manner crosses the line. The AAP's campaign in Gwalior was said to be modeled on symbolic protest tactics to draw attention to the plight of roads in the city. Party workers planted BJP flags in potholes to suggest accountability, claiming the ruling party was responsible for the condition of roads.

Somnath Bharti can't represent wife in defamation case: Sitharaman's counsel

Citing 'conflict of interest', Counsel representing Union Finance Minister Nirmala Sitharaman on Thursday informed a Delhi court that Aam Aadmi Party (AAP) leader Somnath Bharti 'cannot represent his wife' in a defamation case. The submissions were made in the court of Additional Chief Judicial Magistrate Paras Dalal, during the hearing of a criminal defamation case filed by Lipika Mitra, wife of Mr. Bharti, against the Union Minister. The Union Minister's counsel stated that Mr. Bharti cannot appear in his case while demanding that he withdraw the authorisation document appointing a lawyer to represent the matter. The counsel also said, failing to do so, should prompt a reference to the Bar Council of India for disciplinary proceedings against the AAP leader. The court posted the hearing on July 16 after Mr. Bharti sought time to argue on the application. Ms. Mitra, in her complaint, alleged that the Union Minister attempted to tarnish Mr. Bharti's image with her 'defamatory' remarks during a campaign ahead of the 2024 Lok Sabha polls. Ms. Sitharaman's remarks were intended to tarnish the image of Mr. Bharti and impact his chances of winning from New Delhi Parliamentary Constituency as INDIA alliance candidate, she said in the complaint, adding that it has caused the immense mental anguish to Mr. Bharti and damaged his public reputation as an elected representative. The case has been filed under Section 356 (defamation) of the Bharatiya Nyaya Sanhita.

AAP Leaders Call Case Against 2 Delhi Ex Ministers "Political Vendetta"

New Delhi: The Aam Aadmi Party (AAP) launched an attack on the BJP-led central government, questioning the secrecy around the first information report (FIR) registered against former Delhi ministers Saurabh Bharadwaj and Satyendar Jain. The AAP alleged selective media leaks and suppression of the FIR to avoid public scrutiny. "Why hide the FIR if it contains valid allegations? Is it so flimsy that the BJP fears public ridicule?" AAP leaders, calling the case a blatant misuse of investigative agencies. Mr Bharadwaj cited official records showing the hospital projects in question were sanctioned between 2016 and 2018, while he assumed ministerial office only in March 2023. He emphasised there is no proof of corruption in these projects or the HIMS (Hospital Information Management System), which was announced in 2016-17. Mr Bharadwaj, who is also the AAP Delhi chief, questioned why only two former ministers were named in the FIR while all responsible health and PWD officers were spared. He said the Lieutenant Governor's press note on June 24 referred to projects from 2018-19 and 2021, but the anti-corruption bureau chief's press note mentioned only 2017-18 projects, raising questions on consistency. Former minister Satyendar Jain also criticised the timing and nature of the allegations, calling them baseless and politically motivated. The AAP demanded the immediate public release of the FIR, asserting that transparency would reveal the case to be a "mockery of law." The ACB filed the case against Mr Bhardwaj and Mr Jain over alleged embezzlement of funds allocated for health infrastructure projects during the previous AAP government. The case, filed under Section 17A of the Prevention of Corruption Act, is based on a complaint by former Leader of the Opposition and current assembly Speaker Vijender Gupta. According to the FIR, 24 hospital projects worth Rs 5,590 crore were sanctioned during 2018-2019. However, most of these projects remained incomplete, with significant and unexplained cost escalations. Similarly, a Rs 1,125 crore ICU hospital project comprising seven pre-engineered facilities with a total of 6,800 beds is only 50 per cent complete, nearly three years after it began. Some Rs 800 crore has already been spent, despite the project initially having a six-month completion timeline. The ACB reported unauthorised construction at government hospitals in Jwalapuri by Parnika Commercial and Estate Pvt Ltd and in Madipur by Ramacivil India Construction Pvt Ltd.
