ED withdraws summons to senior advocate amid row

The Enforcement Directorate (ED) on Friday withdrew its summons to senior advocate Pratap Venugopal, hours after the Supreme Court Advocates-on-Record Association (SCAORA) urged Chief Justice of India (CJI) Bhushan R Gavai to take suo motu cognisance of the agency's move, calling it a grave infringement on the independence of the legal profession and the sanctity of lawyer-client privilege. Venugopal, summoned on June 19 to appear before the ED on June 24 under Section 50 of the Prevention of Money Laundering Act (PMLA), 2002, received a text message from the agency on Friday afternoon informing him that the notice 'stands withdrawn with immediate effect.'
The summons pertained to the ongoing investigation into the allotment of Employee Stock Option Plans (ESOPs) by Care Health Insurance to former Religare Enterprises Chairperson Rashmi Saluja. Venugopal was the Advocate-on-Record (AoR) for a legal opinion rendered by senior counsel Arvind Datar in the matter. ED had earlier summoned Datar as well, but that notice too was rescinded following backlash from the legal fraternity.
In a letter dated June 20, SCAORA President Vipin Nair described the summons to Venugopal as 'a deeply disquieting development,' and warned that coercive measures against lawyers for professional legal opinions strike at the heart of legal privilege and the fundamental tenets of the rule of law.
SCAORA asserted that such actions represent an 'impermissible transgression' into the constitutionally protected sphere of legal advice.
'The role of an advocate in offering legal advice is both privileged and protected. Interference by investigative agencies, particularly in respect of opinions rendered in a professional capacity—strikes at the core of the rule of law,' the letter stated.
SCAORA urged the Supreme Court to examine the legality and propriety of summoning advocates for professional opinions and called for the framing of clear guidelines to insulate the legal profession from similar overreach in the future.
This is the second time in recent days that the Association has stepped in to defend the autonomy of the Bar. On June 16, SCAORA issued a public statement condemning the ED's notice to Datar as 'unwarranted' and a manifestation of growing investigative overreach.
Similar concerns have echoed across the legal landscape. On June 17, the Delhi High Court Bar Association passed a resolution criticising the ED's actions, warning of a direct threat to the constitutional right to legal representation and fair trial. The Gujarat High Court Advocates Association also convened an emergency meeting, with its president Brijesh Trivedi calling for urgent government action to protect lawyer-client privilege through amendments to the Indian Evidence Act, 1872, and the Bharatiya Sakshya Adhiniyam, 2023.
While ED has not formally disclosed reasons for withdrawing the summons to Venugopal, senior members of the Bar see the move as an implicit recognition of the serious constitutional and professional issues flagged by the legal community.

KOLHAPUR: In one of the biggest cyber frauds reported from the Western Maharashtra region, fraudsters posing as Mumbai Police and Enforcement Directorate (ED) officials forced a 75-year-old Kolhapur resident to transfer a total of Rs 7.86 crore between 26 May and 23 June, under the false pretext of an inquiry into a case of 'funding a banned terror outfit and money laundering'. The victim, who settled in Kolhapur after retiring in 2012 as an assistant vice-president from a refinery in Jamnagar, exhausted all his savings from investments in shares and a fixed deposit (FD) held jointly with his wife. He made 14 transfers to bank accounts in Mumbai, Nashik, Akola, Chandigarh, Prayagraj, Manoharpur, Andhra Pradesh and Bihar. His three sons are settled in the United States, and he had rejoined the refinery in 2017 for two years before retiring fully. According to the FIR, at one point the victim even told one of the fraudsters, who claimed to be an ED official, that he had no involvement in any money laundering and suspected a cyber fraud . The caller then disconnected the call. Later, the victim received another call from someone claiming to be a senior serving officer from Mumbai, who instructed him to cooperate with the supposed ED official. They convinced the victim to sell his shares and deposit the funds from both the sale and the joint FD into the accounts they provided, falsely promising that the money would be returned to him. The Juna Rajwada Police registered a case after conducting a preliminary verification of the victim's complaint.

New Delhi: The Enforcement Directorate on Saturday alleged that admission of students through the management quota in three Bengaluru-based private colleges was being done in an 'opaque' manner using money, including funds in cash. The federal probe agency's statement comes after they conducted searches at 17 locations on June 25-26 in a 'seat blocking scam' case. The raids were carried out at the premises of BMS College of Engineering, Akash Institute of Engineering and Technology, and New Horizon College of Engineering, along with those associated with these institutions, the agency said in a statement. A few entities engaged in educational consultancy services and some private agents were also raided. The ED case stems from a Karnataka Police FIR registered by the KEA (Karnataka Examination Authority) against these colleges. The complaint alleged that these colleges colluded with unknown individuals to acquire the login credentials of students registered with the KEA and subsequently blocked seats in their name for students who did not intend to enroll, the ED said. The searches revealed 'evidence' of 'widespread' seat blocking and the use of cash/money in the admission process for popular professional courses in the private institutes, it said. 'There is an extensive network of agents, educational consultancy service entities, which is used to bring students for admission from across India to these institutes,' the statement said. The agency further alleged that the admission for management quota seats was mostly done in an opaque manner based on extraneous considerations such as cash or money. During the searches, a total of Rs 1.37 crore in cash was allegedly seized. However, the ED did not specify the source of the recovered funds. The colleges or their promoters could not be contacted for a comment on the ED charges made against them.

Mumbai court allows restoration of attached property worth Rs 952 Crore of Vadraj Cementt

New Delhi [India], June 29 (ANI): In a significant development in the IL&FS case, assets worth Rs 952 crore, which were attached by the Enforcement Directorate (ED), have been restored to the rightful claimant by the Special Court (PMLA), Mumbai, vide order dated June 25, 2025, following a no-objection certificate (NOC) issued by the agency. The ED, in a statement on Saturday, said this move is in continuation of its efforts to return properties to their rightful owners and enable financial institutions to monetise attached or seized assets. The ED, Mumbai Zonal Office, had initiated an investigation under the Prevention of Money Laundering Act (PMLA), 2002, against Infrastructure Leasing & Financial Services Ltd. (IL&FS), its group companies, and other associated entities for their role in the generation and laundering of proceeds of crime (POC). During the course of the investigation, it was revealed that Vadraj Cement Limited (formerly ABG Cement Ltd.), a group company of ABG, had availed financial assistance from IL&FS Financial Services Ltd. (IFIN), which was later classified as non-performing. The investigation established that loans amounting to Rs 952 crore were fraudulently obtained and constituted proceeds of crime. Accordingly, ED provisionally attached the immovable properties of Vadraj Cement Ltd., including its Surat Cement Plant, on January 21, 2020. The attachment was confirmed by the Adjudicating Authority on August 5, 2021. A prosecution complaint for the offence of Money Laundering was also filed in the matter before the Special Court (PMLA), Mumbai, praying for the confiscation of properties attached as POC. The Punjab National Bank was the major lender to Vadraj Cement Ltd. with an admitted claim of Rs 2,122 Crore. The defunct cement company's other major lenders include Union Bank (Rs 1,620 Crore), Indian Overseas Bank (Rs 1,419 Crore), Central Bank of India (Rs 1,391 Crore) and JC Flower ARC (Rs 677 Crore). Subsequently, M/s Nuvoco Vistas Corporation Ltd., a subsidiary of the Nirma Group and the Successful Resolution Applicant under the Insolvency and Bankruptcy Code, 2016 (IBC), filed an application before the Special Court (PMLA), Mumbai seeking restoration of the attached property to facilitate implementation of the resolution plan approved by the Hon'ble National Company Law Tribunal (NCLT), Mumbai on April 1, 2025. As part of the resolution plan, Nuvoco Vistas Corporation Ltd. is set to pay Rs 1,706 crore to financial creditors for acquiring Vadraj Cement Ltd. In light of the PMLA's objective to restore POC to bona fide and legitimate claimants, the ED submitted its no-objection before the Additional Sessions Judge for the release of the attached property. Following ED's submission, the court passed an order on June 25, 2025, directing restitution of the immovable properties to the bona fide claimant. The Special Court (PMLA), Mumbai, vide its order in PMLA Special Case No. 6/2019, has allowed the said application and directed the restoration of the attached property to Nuvoco Vistas Corporation Ltd. under Sections 8(8) and 8(7) of the PMLA read with Rule 3A of the PML (Restoration of Property) Rules, 2016. The Court has further directed the Applicant to submit an undertaking to return or restore the property or its value as may be directed in future. The Court has also instructed the ED to prepare a detailed inventory of the property prior to handing over possession. The restoration order pertains solely to the attachment of Rs. 952 Crore arising out of the investigation made by the Mumbai Zonal Office. (ANI)
