Man jailed 19 years for raping, sexually assaulting underaged sister

The Court of Appeal also affirmed the sentence of 19 strokes of the rotan on the accused.
PUTRAJAYA : The Court of Appeal today ordered a man to serve 19 years in jail for raping and sexually assaulting his underaged sister six years ago.
A three-member bench chaired by Justice Hashim Hamzah also ordered the 24-year-old to be whipped 19 times, and for the prison sentences for rape and sexual assault to run consecutively.
'The High Court had erred in reducing the jail term for rape and we restore the punishment imposed by the sessions court,' Hashim said in allowing the prosecution's appeal on sentence.
Justice Zaini Mazlan and Noorin Badaruddin also heard the appeal.
The man had been found guilty of raping his sister between 2018 and 2019, when she was 11 to 12 years old, and sexually assaulting her in 2021 when she was 14.
The offences were said to have been committed at a house in Kuala Lumpur.
The accused was charged with the offences in 2021 when he was 20. His sister had narrated the incidents after she went to live with her aunt following her parents' divorce.
Deputy public prosecutor Tengku Shahrizam Tuan Lah told the bench today the High Court sentenced the accused to five years' jail under Section 83(3) of the Child Act on the rape charges on grounds that he was a child when the offences were committed.
The sessions court had imposed a 10-year jail term and 12 strokes of the rotan on the rape charges, but the High Court subsequently halved the prison sentence to five years.
The court, however, maintained the nine-year jail term and seven strokes of the rotan imposed by the sessions court on the sexual assault charge.
The High Court also ordered the accused to serve his prison sentences concurrently, effectively reducing the total prison term to nine years.
The Court of Appeal reinstated the 10-year jail term on the rape charges, affirmed the nine-year sentence for sexual assault, and a total of 19 strokes of the rotan, and ordered for the accused to serve his prison sentences consecutively.
Lawyer Khor Boon How had urged the bench to affirm the High Court ruling, as his client had pleaded guilty to the charges.
'The High Court was correct to rely on the Child Act to reduce the term from 10 to five years for rape,' he said.

(Pexels pic) PETALING JAYA : A religious teacher was sentenced to 26 years in prison and five strokes of the rotan by the sessions court in Lahad Datu on two counts of raping a child last August. Judge Suhaila Selaq handed down the sentence after Basry Asang, 49, pleaded guilty to the two charges, Berita Harian reported. On the first charge, Basry was accused of raping an 11-year-old girl at a house in Lahad Datu between 1pm and 3pm on Aug 18, 2024. On the second charge, he was accused of repeating the offence at the same location and time the following day. Suhaila sentenced the accused to 13 years in prison and two strokes of the rotan on the first charge, and another 13 years and three strokes on the second charge. She ordered the prison sentences to run consecutively, starting from the date of the accused's arrest on Aug 20, 2024. Deputy public prosecutor Ng Juhn Tao had asked the court to impose a heavy sentence, citing the seriousness of the offence, which he said showed a complete disregard for human dignity. He said the accused had violated the victim's privacy and sanctity, and brought shame and humiliation, leaving the victim deeply traumatised. The accused was also ordered to undergo counselling throughout his sentence and to be placed under police supervision for two years after his release.

The three-member Court of Appeal panel unanimously ruled that the prosecution proved on a balance of probabilities that the Proton X70 registered under Aida Tengah was linked to offences under the Penal Code. PUTRAJAYA : The Court of Appeal today dismissed a bid by the wife of a former Terengganu assemblyman from PAS to overturn a lower courts' decision to forfeit her Proton X70. The panel of three judges unanimously ruled that the prosecution had proven on a balance of probabilities that the sports utility vehicle registered under Aida Tengah, 49, was linked to offences under Section 409 and Section 165 of the Penal Code. Section 409 relates to criminal breach of trust while Section 165 concerns a public servant obtaining valuable items from individuals with whom they have official dealings. Aida is the wife of former Ladang assemblyman Tengku Hassan Tengku Omar. He was then the chairman of the Terengganu Foundation investment committee and the state executive councillor for trade, industry, regional development and well-being. Justice Ahmad Fairuz Zainol Abidin said with regard to Section 409, it was clear from the prosecution's arguments, based on a balance of probabilities, that Abdul Ahad Khan, a board member of Hygenia Sdn Bhd, had misappropriated RM3.875 million from the company's funds for personal interest and used RM115,000 from the proceeds to purchase the SUV which was registered in the appellant's name. 'As for the offence under Section 165, it is clear that the appellant's husband was a public servant and chairman of the investment committee when Abdul Ahad had official dealings with him,' the judge said. The prosecution had previously submitted that it had consent to prosecute Abdul Ahad, who is missing. On March 14, 2024, the Kuala Terengganu High Court dismissed Aida's appeal against a sessions court ruling on May 5, 2023 which ordered the forfeiture of the vehicle to the government. The three-bench panel was led by Justice Zaidi Ibrahim, sitting with Justices Ahmad Fairuz and Azman Abdullah. Deputy public prosecutors Farah Yasmin Salleh and Ashraf Tahir appeared for the prosecution, while Aida was represented by Awang Armadajaya Awang Mahmud. Aida, however, did not attend the proceeding today due to a health condition.
