Kochi: The owners of the vessel MSC AKITETA II, which was arrested on the directive of the high court in an admiralty suit filed by the state govt, informed court that the amount claimed by the state, Rs 9,531 crore, is highly exaggerated.
They also submitted that the suit is not maintainable, as the vessel is not within Indian territorial waters. While considering the interlocutory application filed by the vessel owners in the state's admiralty suit, the bench of Justice M A Abdul Hakhim orally asked the owners to state how much they were willing to deposit as security in the matter.
HC had issued an arrest warrant against AKITETA II on July 7. It came following the state govt suit seeking claims for the grave and widespread environmental and economic damage allegedly caused by the capsize of cargo vessel MSC ELSA 3 off Kerala coast on May 25.
The vessel owners, however, contended that there was no evidence of oil pollution resulting from the capsize. They submitted that the oil sheen, which had spread within one nautical mile of the site, was completely cleaned up by the ship owner. They reiterated that the claim is exaggerated and not backed by adequate supporting documents.
Seeking modification of the previous order directing the deposit of Rs 9,531 crore as security, senior counsel for the vessel owners relied on Section 11(2) of the Admiralty (Jurisdiction and Settlement of Maritime Claims) Act, 2017, which permits the court to modify or cancel the security requirement for sufficient cause.

They also referred to a 2017 HC division bench judgment that had reduced a security deposit from Rs 18.5 crore to Rs 1 crore.
However, advocate general K Gopalakrishna Kurup opposed the plea, contending that the arrest order was issued after HC was satisfied with the prima facie case established by the plaint and supporting documents. He argued that the question of modifying or cancelling the order could arise only after completion of pleadings.
Accepting the AG's submission, HC directed the ship owners to file a counter-affidavit along with supporting documents within two weeks. The matter has been posted for Aug 8, and HC clarified that the arrest order shall remain in force until then.

Panaji: A survey conducted by the directorate of mines and geology (DMG) has revealed that 154 mining leases, most of them in South Goa, are in eco-sensitive areas where mining cannot resume. The survey was conducted by state govt ahead of fresh auctions of the state's mining leases. Govt has already conducted four such auctions of mineral blocks. A senior DMG official confirmed that 154 leases fall in eco-sensitive areas. When mining in Goa came to a halt in 2018 following the Supreme Court's decision to quash the second renewal of 88 leases, there were 254 valid leases. Most of these were spread over the talukas of Pernem, Sattari, Ponda, Sanguem, Bardez, Bicholim, Tiswadi, and Quepem. During the Portuguese era, Goa had 806 mining concessions, and in 1987, after the concessions were abolished and converted into leases, that number reduced to 595. In 1987-88 and 2000, 438 leaseholders applied for the first renewal. Subsequently, 413 leaseholders applied in 2006 for the second renewal. Ahmedabad: A 39-year-old businessman from the Jivraj Park area of the city filed a complaint of criminal breach of trust against a Mumbai agent who allegedly cheated him out of Rs 18.62 lakh by not booking flight tickets after taking money from him. The complainant registered the complaint on Friday against the agent from Mumbai. The complainant stated that he was dealing in taxi and flight ticket bookings, and in 2023, he received a WhatsApp message from the accused in Mumbai, stating that he was running a holiday company with a good facility for booking flight tickets at reasonable rates. "I requested verification of the documents for their company, and they sent copies of their Aadhaar card, PAN card, and GST registration, which built my trust. I started booking flight tickets for my customers through them, transferring booking payments to their account before each booking." During this period, a resident of Bharuch contacted him for a group booking inquiry for 26 people from Coimbatore to Mumbai and Mumbai to France (Lyon) return tickets. "Other customers also made group inquiries, and I booked a total of 60 flight tickets through the Mumbai company, transferring a total of Rs 18.62 lakh," the complaint mentions.
