Man who dragged visually impaired child from mother walks free

A man who dragged a visually impaired child away from her mother has been given a suspended sentence.
Dublin Circuit Criminal Court heard that Stephan Obelngoa (24) of Deerpark Road, Tallaght, Dublin 24, pleaded guilty to assault causing harm, assault of a peace officer and resisting arrest at The Square, Tallaght. Dublin, on October 2, 2023. He has six previous convictions and was on bail at the time of this offence.
Judge Sinead Ni Chulachain handed down an 18 month prison sentence but suspended it in full on strict conditions.

Obelngoa was suffering from a mental illness at the time and had not been taking his medication, the court heard.
Garda Sergeant Gemma Collins told Shaun Smyth, BL, prosecuting, that an 11-year-old girl, her mother and little brother were leaving the shopping centre on the day in question when they noticed a man later identified as Obelngoa. He was topless, and the mother described his movements as 'unnerving' and said he seemed 'aggressive'.
The court heard the mother intended to walk on and avoid Obelngoa, but she suddenly noticed that her daughter had disappeared from her peripheral vision.
The woman turned around and saw her visually impaired daughter being dragged away by Obelngoa. The little girl was screaming, crying and struggling to get away.
The mother described her daughter as 'bouncing off the ground'. Obelngoa then threw the girl into a concession stand.
Gda Sgt Collins said two security guards immediately subdued Obelngoa. When gardai arrived, they found Obelngoa was shouting, roaring and aggressive as he was being restrained.
He then spat a mixture of blood and saliva into the face of one of the gardai. As gardai were trying to place handcuffs on Obelngoa, he tried to bite them.
Specialist gardai interviewed the young girl, and she described to them 'being dragged like a doll and being dragged on the floor'. She said, 'I thought he was going to drag me away forever and would kidnap me'.
The girl was examined the following day by a doctor, and a medical report stated she suffered minor spinal soft tissue tenderness and abrasions. The court heard the young girl had trouble sleeping and was extremely anxious in public places like shopping centres afterwards.
Gda Sgt Collins agreed with Ciara Ní Ghabhann BL, defending, that gardaí were unable to interview her client after he was arrested, as he was made an involuntary patient in Tallaght Hospital, where he remained for a period of time.
The garda agreed with counsel that CCTV footage obtained by the gardai shows that the incident lasted a matter of seconds.
Ms Ní Ghabhann said her client suffers from schizophrenia and is given antipsychotic medication every three months. She said at the time of this incident, Obelngoa had been off his medications for six months and was self-medicating with cannabis.
Counsel said her client is currently under the supervision of the Probation Services and has undertaken community response programmes. The Probation Services have said he is at low risk of reoffending.
She said Obelngoa has written letters of apology to both the garda and the young girl in this case, outlining his sincere remorse. He does not have a clear memory of the incident, but when shown the CCTV footage, he was embarrassed.
She asked the court to take into account that her client was quite young and had an acute mental health issue when this offence was committed. She said her client has taken steps to ensure that nothing like this will ever happen again.
At a hearing last month Judge Ni Chulachain said, 'these are very serious offences,' and adjourned the case for two weeks to consider her sentences and read all documents handed into court.
In sentencing the judge noted that the injured party was walking past him with her mother when he threw her into a concession stand and had to be pepper sprayed.
The judge asked Sgt Collins to explain to the injured party 'that we can't punish people for things that aren't their own fault' and that 'if he takes his medication - he's never going to come near her again.' 'It must be very strange to her that he is not going into prison,' the judge added.
She said the onus was on the defence to establish their client was suffering from a mental illness and that she was satisfied they had done so. She noted he was unmedicated for six months and was displaying his genitalia in public while in hospital.
Judge Ni Chulachain noted his mental state at the time but said it 'does not reduce all your culpability,' she said.
She said the appropriate sentence was 18 months but she had to take account of his guilty plea which saved the injured party giving evidence at her young age.
The judge noted he was 24 and was in college but dropped out and was on bail for six offences but there was a 'positive' probation report and he was at low risk of reoffending if he continued on the same path.
She imposed one-year imprisonment term to run concurrently on each of the assault charges but in view of the effect prison would have on him, she suspended it for two years on strict conditions.

Derek Cooney BL, defending, said it was a 'nasty, nasty crime' and that his client wanted to offer an unreserved apology for his actions that night. He said Macari is a member of the Macari takeaway family and has had 'significant difficulties throughout his life'. He has struggled with drug addiction and has been by ostracised by his family in recent years, the court heard. He has had periods of homelessness and living in hostels. His brother died of a heroin overdose some years ago and this caused Macari's life to spiral out of control, defence counsel said. 'He has had opportunities, coming from a very well-respected family and educational opportunities, but drugs got the better of him,' Mr Cooney said. He said Macari's father is supportive of him and an offer has been made for him to work in the family business upon his release. Judge Baxter said she would finalise the matter in November. She ordered a probation report, governer's report and urine analysis for that date.

Josh Cole, Townley Manor, Tullyallen, Drogheda, pleaded guilty to two counts of possession of drugs for sale or supply at his home address, charges which stemmed from a Garda search which yielded cannabis worth more than €30,000 and cocaine valued €299. Judge Dara Hayes sentenced him to two concurrent terms of three-and-a-half years and suspended both for three-and-a-half years. Last April, the court heard that the defendant is studying Music and Computer Science at Maynooth University. He had been struggling for money after failing first year and having to pay full fees. He was holding most of the drugs for someone else. He was given money and some drugs to sell himself as payment for storing them. He was aged 19 at the time. Gda Emma Kilroe testified that on July 25, 2023, gardaí searched Mr Cole's home at Townley Manor where he lived with his brother and sister. In an upstairs bedroom a sports bag was found. It contained 1.51kg of cannabis valued €30,228 and 4.27g of cocaine worth €299.32. Gardaí also discovered a weighing scale and bags. The accused was present at the search and following his arrest made admissions during interview at Drogheda Garda Station. He wouldn't name other people involved. There were no previous convictions, nor had he come to adverse attention since. It was submitted by counsel that the accused had been prevailed upon to hold these drugs for 'more sinister elements in the community'. The case had been put back to allow him complete exams. ADVERTISEMENT On the adjourned date the court had 11 urinalysis reports from January 9 last to July 3 and all were negative, as well as the defendant's exam results. Judge Hayes said that the Probation Service had assessed Mr Cole at low risk of reoffending. A report noted that he was the youngest of three children, worked part-time in a local shop and had strong ties to his church. The judge remarked that by any measure it was a substantial quantity of drugs. The defendant had been dealing to a small scale as well as storing drugs. He remained a very young man. This is notorious double rapist Simon McGinley out and about in a Co Louth town just days after he was released from prison. Evil McGinley, 52, walked free from the Midlands Prison on Wednesday after completing a sentence he received last year for breaching the conditions of the Sex Offenders Act. Our exclusive photos show the cowardly double rapist, dressed in a striped t-shirt, a grey zip-up jumper and black trousers and carrying a mobile phone and blue disposable vape, as The Irish Mirror tracked him down in Dundalk. The sicko sex fiend, who is now subject to Garda monitoring as he has been described as a dangerous individual, was in prison since August 2023 after he was sentenced at Dundalk Circuit Court for the breaches. As part of his release conditions, he is also under the supervision of the Probation Service for the next 12 years. He has also been placed on the Sex Offenders Register for the rest of his life. In October 2022, the sex beast was released from Arbour Hill Prison, having served 13 years behind bars of an overall 21-year sentence for the brutal and shocking rape of an 85-year-old woman in her Co Monaghan home in 2008. A drunken McGinley had broken into her home and raped her repeatedly during the night and put his hand over her mouth. The elderly woman had been unfit to give evidence during the trial due to worsening dementia. But, a statement she had given at a previous district court hearing was read to the jury. The evil rapist was previously sentenced to 12 years in 1998 after pleading guilty to raping a 13-year-old girl in August 1997 — in a controversy known as the 'C Case'. The young girl at the centre of the infamous 'C Case' against him was involved in a legal battle over whether she was allowed to travel to the UK to have an abortion. Speaking out in 2009, the victim told RTÉ Radio how the brutal attack left her pregnant and forced her into a succession of care homes and how she was caught at the centre of an infamous legal battle over her right to have an abortion. 'He ruined my life and I am still coming to terms with that. My life is destroyed,' said the woman. 'I never got schooling or anything like that. I don't know how many times I tried to kill myself but I have a little five-year-old son now so he keeps me going.' Dangerous rapist McGinley has also previously been compared to infamous beast Larry Murphy and is considered a highly volatile sexual predator. And he was once deemed a person of interest in the case of missing JoJo Dullard. During his trial in 2009 for the rape of the elderly woman, Mr Justice Birmingham said he could find no mitigating circumstance. 'Rape is always a serious offence but within the spectrum of rapes this, in my view, is at the top of the upper end. This case is just about as bad as it gets,' he said.
