
Health association takes legal action against NHI Act

The ANC, which governed the country solely until being forced into a national coalition after the polls, says the NHI is intended to provide universal and comprehensive health coverage to all South Africans.
But it has faced fierce criticism from the private healthcare sector and parties such as the
Health Funders Association chief executive Thoneshan Naidoo acknowledged this week that 'South Africa needs a healthcare system that delivers equitable, quality care to all [and] we fully support that vision.'
But he added: 'In its current form, and without private sector collaboration, the NHI Act is fiscally impossible and operationally unworkable, and threatens the stability of the economy and health system, impacting everyone in South Africa.'
The association filed its application at the Pretoria high court, joining five other medical entities that are fighting the law.

The association's position is premised on a report by Genesis Analytics, published this week, which showed that the 'NHI Act requires unsustainable tax increases while reducing healthcare access for medical scheme members'.
It said the analysis also revealed South Africa's racially diverse medical scheme membership, in which more than 68% of members are black, Indian or coloured, and up to 83% earn less than R37 500 a month.
'The proposed NHI would, therefore, disproportionately impact working-class households who currently rely on medical schemes for quality care.'
Modelling by Genesis Analysis showed that it would be impossible to raise the funds required for NHI, 'even under the most optimistic assumptions'.
'For NHI to fund a level of care equivalent to what medical scheme members currently receive, as government has indicated is the intention, the Genesis model shows that personal income tax would need to increase by 2.2 times (a 115% increase in tax) from the current average rate of 21% to an average of 46% of income.'
This, it said, would push marginal tax rates in the lowest income bracket from 18% to 41%, and in the highest bracket from 45% to 68%.
Building its case, the association said the Genesis model projected that more than 286 000 additional healthcare professionals would be required to fulfil the NHI vision.
This is more than twice the number of general practitioners, nurses and pharmacists and three times the number of specialists.
'NHI will therefore place significant pressure on healthcare workers and addressing these capacity gaps will require significant time and investment,' the association said.
Naidoo added that South Africa does not have enough skilled workers to deliver the NHI's mandate.
'By driving down service tariffs, the NHI risks accelerating the emigration or exit of healthcare professionals from the sector altogether.'
The country is already facing a medical professional 'brain drain'. A survey conducted last year by the South Africa Medical Association, which represents approximately 17 000 doctors across South Africa, showed that as many as 38% of its members intended to leave the country in response to the implementation of the NHI scheme.
Last month, Ramaphosa defended the Act after the Board of Healthcare Funders, which represents most private medical schemes, said he flouted his constitutional duty by failing to scrutinise its constitutionality when he signed the NHI into law.
It added that the president ignored submissions that pointed to the patent constitutional defects in the legislation. The Pretoria High Court ruled in favour of the board.
Ramaphosa launched an appeal, arguing that the court lacked jurisdiction in the matter and erred in finding that his decision to sign the new law was reviewable.
The court found no merit in his argument on the separation of powers and said the step of assenting to a Bill was but part of a lawmaking process that was a reviewable exercise in public power.

JOHANNESBURG - Very resilient. That's how ANC spokesperson Mahlengi Bhengu-Motsiri, describes former deputy president David Mabuza, who has died in a Mpumalanga hospital aged 64. Minister in the Presidency Khumbuzo Ntshaveni has also paid tribute Mabuza. Ntshaveni described the late ANC leader as a warm, supportive and down-to-earth leader. Mabuza played a key role, during a turning point in ANC internal politics, particularly at the 2017 Nasrec conference. It was a critical time the party and South Africa, as the country tried to move away, from the damage of state capture. International Relations Minister Ronald Lamola also remembered Mabuza as a special educator. Opposition parties are joining the ANC, in paying tribute to the 64-year-old. ANC NEC member Dr Zweli Mkhize has praised the late deputy president, as a humble, respectful servant of the people. He says Mabuza always took time to resolve problems of those around him. The former deputy president has died in hospital aged 64. Members of Parliament are reflecting on his role. One of his crucial responsibilities was in bridging the gap, between the legislature and the executive. National Assembly speaker, Thoko Didiza says he executed his role in parliament very well.

The Hague Group revives the possibility of a new internationalism

Photo by Leanne Brady Imperialism is on a genocidal offensive in Gaza, and has recently bombed its way through Syria, Yemen, Lebanon and Iran too. But there is also a growing international pushback. In the West, young people are standing with Palestine in growing numbers. In Africa, the rise of anti-imperialist sentiment across West Africa and the Sahel marks one of the most significant political shifts in a generation. In Mali, Niger, Burkina Faso, and now Senegal, we are witnessing a rupture with the neocolonial order — a rejection of French military presence, International Monetary Fund tutelage and elite subservience to Western interests. The emergence of figures such as Captain Ibrahim Traoré in Burkina Faso reflects a desire to reclaim sovereignty not in speeches, but through concrete acts of defiance. While these new formations are uneven and at times militarised, they speak to a profound disaffection with the postcolonial consensus. There is a new assertion of a politics rooted in self-determination, resistance to external domination, and the urgent need to build new regional solidarities on African terms. South Africa has, in a very different way, led a hugely important challenge to the West by taking Israel to the International Court of Justice and then, in January this year, taking a leading role in the formation of The Hague Group, a coalition of Global South nations formed in response to Israel's genocidal attack on Gaza and committed to upholding international law and confronting impunity. Nine nations — Belize, Bolivia, Colombia, Cuba, Honduras, Malaysia, Namibia, Senegal, and South Africa — came together to commit to upholding the provisional measures of the International Court of Justice, which found plausible evidence that Israel is committing genocide in Gaza. They pledged to prevent arms transfers that could contribute to the genocide, to block military cargo from docking at their ports, and to begin building the legal and diplomatic mechanisms required to hold states accountable for aiding and abetting war crimes. For the first time in decades, the postcolonial world stood together and spoke in a voice not dictated by Washington, Tel Aviv or Brussels. The presence of our government among those leading the charge signals a meaningful rupture with the status quo — a reminder that, at its best, the ANC tradition carries within it the embers of a once-vibrant internationalism. In standing against genocide, and in asserting the illegality of occupation and collective punishment in Palestine, the South African state returned to its historic alignment with the oppressed of the world. Internationalism has never been a luxury for the oppressed. It is a necessity. Our own struggle against apartheid was not won through domestic action alone. It was carried on the shoulders of Cuban brigades, Swedish trade unionists, Caribbean intellectuals and Indian feminists. It was amplified by the voices of Latin American and African writers. It was supported by movements across the world that understood that apartheid was not simply a local aberration, but a node in a wider system of racial capitalism. The same is true of Palestine today. To isolate what is happening in Gaza from the broader structures of occupation, imperialism and settler colonialism is to misunderstand its function in the world system. Palestine is not simply a humanitarian crisis — it is a political one. Its resolution will not come through diplomacy alone, but through the reconstruction of international solidarity as a material force. In July, the Hague Group will reconvene in Bogotá, co-hosted by South Africa and Colombia, to deepen these commitments. Discussions will focus on expanding the group, developing regional enforcement mechanisms and coordinating legal and trade responses to states and corporations complicit in Israeli apartheid. The growing power of the Hague Group gestures back toward Bandung and the Non-Aligned Movement — not as nostalgic artefacts, but as unfinished projects: projects that sought to create an alternative axis of power among the formerly colonised. Internationalism in Africa has deep roots. Kwame Nkrumah, in his speech to the Conference of Independent African States in 1960, declared: 'The independence of Ghana is meaningless unless it is linked up with the total liberation of the African continent.' His vision of a pan-African future was inseparable from a global anti-imperialist alignment. In 1961, he helped launch the Casablanca Group, laying the foundations for continental unity rooted in anti-colonial solidarity. Thomas Sankara insisted that internationalism without class politics is hollow. Speaking at the Organisation of African Unity summit in 1987, just months before his assassination, he said: 'The debt problem is a neo-colonial plot. We cannot repay the debt because we are not responsible for it. Instead, we must build solidarity among the peoples of the South to end this global system of plunder.' Today, Africa faces the same global forces that Nkrumah and Sankara named: imperial domination, predatory finance and extractive trade arrangements. What has changed is the scale of the crisis — from climate collapse to mass displacement — and the growing realisation that no national project can resolve these challenges in isolation. A renewed African internationalism must begin from this understanding: that we are bound to one another not just by history, but by necessity. Internationalism is not just about states. It is also about class. Gaza, like Marikana, like the imperialist stranglehold on Haiti, the brutal monarchy in Swaziland and the imperialist driven war in the Democratic Republic of the Congo, is nested into the system of global capital — a system that profits from weapons, from land theft, from forced displacement, from cheap labour. It is a system that organises violence through borders and banks, and calls it civilisation. To truly confront it, solidarity cannot be abstract. It must be rooted in the lived realities of working people — their dispossession, exploitation and resistance. This means reimagining our role in the world — not as supplicants or junior partners, but as protagonists of a different future. A future in which justice is not calibrated according to proximity to power, but according to our shared histories of resistance. When the Hague Group was formed in January this year, it immediately won the support of left formations and opinion across the spectrum of the often divided South African left. There was a universal recognition that this was a critical moment and one that all of us, including those of us with very strong criticisms of the ANC, must support. We will offer the same support to the meeting in Bogotá. There is now a rare opportunity to begin rebuilding forms of southern multilateralism that are not captured by elite diplomacy or reduced to symbolic performance. This will require not only coordination between states, but active connection with movements, unions, and civic organisations rooted in material struggle. Without a real grounding in democratic forces below the level of state power, any new alignment risks becoming yet another site of compromise and betrayal. The Hague Group is a critical step forward. It has shown that coordinated action by states in the Global South is possible — serious, principled and effective. But if this moment is to mark the beginning of a new internationalism, not just a high point of symbolic clarity, then its scope must expand. The same resolve brought to bear for Palestine must now be extended to the people of Swaziland, the DRC, Western Sahara and elsewhere — places where impunity still rules, and where silence has too often passed for diplomacy. The work of justice does not end in Gaza. It begins wherever brutal force is used to foreclose the future of the oppressed — and it must be carried forward with the same unity, courage, and clarity of purpose. How South Africa fell into the dull political loop of becoming boring
The death of meaningful political advancement means that South Africa has become stuck in a rut of its own carving. Is there a way forward? Remember when South Africa used to be fun? Remember when the memes slammed into each other like neutrons and electrons, causing small explosions every 15 seconds or so? Remember when there was a fancy term for corruption? Remember when optimism and pessimism cycled around each other in an endless loop, and didn't always land on 'this sucks'? Yeah, me neither. South Africa has become boring. I'm not talking about a lack of political spectacle — there is still Floyd Shivambu scurrying around the kleptocratic wilds looking for a political party to hide behind, and the general idiocy at MK, which is eating itself, like faecal parasites. There is still President Cyril Ramaphosa trying to assert himself on the local stage while playing a pliant mouse in the White House. There's still the alleged drama within the alleged GNU, really just a coalition government and horse-trading forum where the Ramaphosa wing of the ANC and the house-trained wing of the DA bargain on behalf of their backers. Nor am I using 'boring' as a simile for 'blandly functional' — a sort of Scandinavian or Botswana-ish plodding along that results in something akin to stability. What I mean is boring in the true sense of the term — an endless drilling down into the depths of utter nothingness. Is anything happening in South Africa that could be meaningfully termed progress? If you're a capitalist, is the economy growing? If you're a socialist, is the economy becoming fairer? If you're a communist, is anyone at all being sent to the gulag? I'd wager no. Apologists for the coalition government point out several areas where something seems to be moving. The Hawks, South Africa's crack cops, appear to have pulled the proverbial thumb out, and have made some big arrests. The National Prosecuting Authority sort of/kind of won a case. The Transnet baddies have finally been arrested, even though most South Africans (outside of Cape Town) have forgotten what a train looks like. But even with these dogged, incremental improvements, crime and corruption are so embedded in the South African political, economic, social and cultural space that it hardly touches sides. Always accomplished sports-washers, South Africans can point to the excellent performance of our major teams in international competitions, but it's worth remembering that tiny East Germany cleaned up at the Olympic Games during the Cold War, and no one in West Germany was risking their life to hop the wall into the German Democratic Republic (GDR). Culturally, the music and movie booms teased during the 90s and noughties have stalled out. There is no meaningful support of artists in this country, which means talent gets strangled at birth. The Sports and Culture minister can't do sport and wouldn't know culture if JM Coetzee's entire bibliography was tattooed on his butt cheeks. The DTIC under Parks Tau has become exclusively focused on ensuring that American preferential trade deals remain in place, despite the fact that America thinks it's being screwed by Lesotho. The department no longer assesses applications for film industry tax rebates, a standard industry stimulus that pertains in any market that hopes to draw filmmaking talent. Tau has single-handedly killed the industry, through sheer ignorance and lassitude. (There are also those sweet sweet Lotto tenders, which may or may not have cost deputy minister Andrew Whitfield his gig.) Sure, there are individual politicians who are truly gifted—I'm thinking Geordin Hill-Lewis in Cape Town, and perhaps a handful of other players here and there. But Helen 'Supreme Karen' Zille has auditioned for the role of Johannesburg Executive Mayor, a role that has not been blessed with talent of late. Zille, a vet of State Capture and Ramaphosa's first-term Race Grift Wars, feels like an absurd anachronism at this point. And the only people keeping Julius Malema alive are her allied American race warriors, who don't seem to understand — because they don't understand anything — that Malema has no constituency, and no power base. So what's next? Zuma for president? Sort of. Deputy President Paul Mashitile, at this point a shoe-in for the ANC's next leader, did state capture before there was State Capture. As a ranking member of the Gauteng ANC mafia, he is adept at taking a piece of the action, and will only entrench and deepen South Africa's kleptocratic tendencies. It's all so boring. So where is the pushback? Part of the problem is that most people seem to be waiting for the coalition to click, and have deferred the responsibilities of citizenship to their proxies inside government. (See: the VAT fight.) But the coalition won't click, as should be perfectly plain now. As this suggests, the bigger problem is an existential exhaustion. First, there was the fight against apartheid. Then, there was the fight against State Capture. Now, there is the fight against reverse anti-white apartheid. (I'm kidding, I'm kidding.) The population of this country has been stirred up into a big mound of lukewarm mieliemeal — cheap carbs, hold the gravy. So much of it comes down to the fact that the dispensation just hasn't served the majority, not even close. I'm going to quote Peter Thiel here. Yup, Peter 'I Pull The Heads Off Babies' Thiel: 'When one has too much student debt or if housing is too unaffordable, then one will have negative capital for a long time … and if one has no stake in the capitalist system, then one may well turn against it.' No shit, homie. Most South Africans have tacitly turned against the system. The MK party's surge at the polls was a protest vote that functioned as a large raised middle finger at the establishment. And so downward we bore, deeper into the Earth's core than our defunct gold mines. It is perhaps ironic that South Africa's most interesting politician just won the Democratic primary for mayor in New York City. I know, calling Zohran Mamdani South African is a stretch, but he was educated here, and one imagines part of his world-view was formed here. Maybe that's why he can so clearly see through the guff, and understand that a politics of fairness, driven for and by the majority, is the only way forward. It's telling that both Republicans and Democrats are flipping out over the guy, as of course would any South African politician. Mamdani's platform leaves no room for grift, for the double-dealing and self-enrichment that has become the hallmark of postmodern politics. That's why we're boring, and why we'll keep digging our own deep graves. And why Mamdani presents a way forward that South Africans would do well to consider. DM
