Supreme Infrastructure sets Rs 2,200 crore debt resolution in motion

Construction and engineering company Supreme Infrastructure India (SIIL) has moved ahead with the resolution of its ₹2,200 crore debt exposure under a court-approved settlement plan involving 13 lenders.
The company has repaid ₹387.92 crore as part of the resolution scheme approved by the National Company Law Tribunal (NCLT), Mumbai, in March under Sections 230 and 232 of the Companies Act, which allow companies to restructure debt and settle with creditors through a court-monitored process outside the Insolvency and Bankruptcy Code.
The approved plan provides for a full and final settlement of ₹464 crore to financial creditors including State Bank of India, ICICI Bank, Axis Bank, HDFC Bank, Punjab National Bank, Union Bank of India, Bank of India and JM Financial Asset Reconstruction Company, among others.Of the total amount, ₹183.29 crore was raised through monetisation of assets owned by the company and its promoters. Another ₹147.23 crore came from preferential allotment of equity shares to new and existing investors, including promoter contributions. An additional ₹133.48 crore was paid through monetisation of assets exclusively charged to certain lenders, who released their claims following receipt. While a portion of non-fund-based liabilities, mainly bank guarantees, remains pending, the company expects to address these in the coming weeks.
MDP Associates represented SIIL, with the transaction team led by managing partner Ashok Paranjpe and partner Radhika Dixit. Saraf and Partners, led by partner Satyadarshi Kunal, with support from his team, represented the lenders.To facilitate the settlement and ensure structured repayment, SIIL and the lenders entered into nine escrow agreements, resulting in the creation of 11 transaction escrow accounts. State Bank of India acted as the escrow agent, while SBICAP Trustee Company served as the escrow documentation agent. The accounts managed inflows from asset sales and equity issuances and routed repayments to creditors as per the scheme.Objections to the scheme were initially raised by ICICI Bank, SRS Private Investment Powai and Central GST & Central Excise Department. ICICI Bank later withdrew its objection following a settlement, while the tribunal clarified that the GST department's claims were outside the scope of the scheme.

The combined market capitalization of seven out of the ten most valued companies declined by ₹ 1.35 lakh crore last week, with Tata Consultancy Services (TCS) experiencing the steepest fall. During the same week, the BSE benchmark index dropped by 863.18 points, or 1.05%. TCS, Bharti Airtel, ICICI Bank, State Bank of India (SBI), Infosys, Life Insurance Corporation of India (LIC), and Bajaj Finance together saw their market value shrink by ₹ 1,35,349.93 crore. In contrast, Reliance Industries, HDFC Bank, and Hindustan Unilever witnessed a rise in their market capitalisation, collectively gaining ₹ 39,989.72 crore. TCS's valuation plummeted by ₹ 47,487.4 crore, bringing it down to ₹ 10,86,547.86 crore. Bharti Airtel's market value declined by ₹ 29,936.06 crore to ₹ 10,74,903.87 crore, while Bajaj Finance lost ₹ 22,806.44 crore, ending at ₹ 5,44,962.09 crore. Infosys also suffered a loss of ₹ 18,694.23 crore, reducing its valuation to ₹ 6,10,927.33 crore. The market cap of SBI fell by ₹ 11,584.43 crore to ₹ 7,32,864.88 crore. ICICI Bank's valuation dipped ₹ 3,608 crore to ₹ 10,50,215.14 crore, and LIC saw a reduction of ₹ 1,233.37 crore to ₹ 5,59,509.30 crore. On the other hand, Hindustan Unilever added ₹ 32,013.18 crore, taking its valuation to ₹ 5,99,462.97 crore. HDFC Bank's mcap increased by ₹ 5,946.67 crore to ₹ 15,44,025.62 crore, while Reliance Industries gained ₹ 2,029.87 crore, reaching ₹ 18,85,885.39 crore. Reliance Industries continued to hold the top spot in terms of market value, followed by HDFC Bank, TCS, Bharti Airtel, ICICI Bank, SBI, Infosys, Hindustan Unilever, LIC, and Bajaj Finance.

The Enforcement Directorate (ED) has arrested Partha Sarathi Biswal, managing director of Biswal Tradelink Private Limited (BTPL), in connection with an alleged fake bank guarantee case. 'A probe has revealed that BTPL fraudulently arranged and submitted fake bank guarantees of Rs 68.2 crore along with forged State Bank of India (SBI) endorsements and fabricated confirmations for a Solar Energy Corporation of India (SECI) tender. For providing this bank guarantee, BTPL received Rs 5.40 crore from Reliance Power Limited,' an official said. Seven days after searching multiple locations in Mumbai linked to Anil Ambani, the ED has summoned the industrialist on August 5 to join the investigation into a money laundering case linked to a multi-crore bank loan fraud involving companies of the Reliance Anil Dhirubhai Ambani Group. The ED has also issued a lookout circular (LOC) to prevent him from travelling abroad. BTPL was one of the companies where the ED recently conducted searches. Biswal's arrest was made on August 1 and he was produced before a Delhi Court, which sent him to their custody till August 6. 'We are planning to confront him with Anil Ambani during questioning and will try to verify some facts,' an official said. The ED has initiated its investigation against BTPL based on an FIR registered by the Economic Offences Wing (EOW), Delhi Police, against the firm, its directors and others, for allegedly providing a fake bank guarantee which was submitted to SECI. 'During the investigation, the ED has collected several pieces of evidence and they confirmed the use of fake documents in the name of certain banks and fake email IDs in the name of SBI. Probe has also revealed that BTPL, a small company incorporated in 2019, maintained multiple undisclosed bank accounts and carried out transactions disproportionate to its declared turnover. Many violations of the Companies Act are found, and no statutory records are found at registered addresses, such as books of accounts, shareholders' registers, etc,' the official said. The probe also revealed that dummy directors were used solely to sign documents, and found at least seven undisclosed bank accounts of the company. 'Proceeds of crime, of crores of rupees, have been traced to these accounts,' the official added. A spokesperson for Reliance Power said the ED case related to a bank guarantee. 'The company and its subsidiaries acted bona fide and have been a victim of fraud, forgery and a conspiracy. The company has made due disclosure on this to the stock exchanges on November 7, 2024. A criminal complaint in this regard has already been lodged with the Economic Offence Wing of Delhi Police against the third party on October 16, 2024. The due process of law will follow,' said the spokesperson.

ICICI Bank has introduced a new fee structure for payment aggregators (PAs) processing Unified Payments Interface (UPI) transactions on merchant platforms. The change, effective from August 1, will impact platforms such as Google Pay, PhonePe, Mobikwik, and Razorpay. ICICI Bank will charge payment aggregators for UPI transactions from August 1.(MINT) New Fee Structure for Payment Aggregators Payment aggregators act as intermediaries between banks and merchants, handling the collection and settlement of payments. According to reports, ICICI Bank has informed PAs that those maintaining an escrow account with the bank will pay 2 basis points per transaction, capped at Rs. 6. For those without an escrow account at the bank, the fee will be 4 basis points, capped at Rs. 10 per transaction. Also read: No humans needed! Industry executives believe the move aligns with recent regulatory discussions on monetising UPI infrastructure. Private sector peers such as Yes Bank and Axis Bank already charge PAs for UPI payments. These three banks together handle a major share of UPI transactions for both payers and payees. Since UPI transactions do not attract a merchant discount rate (MDR), banks earn little revenue from facilitating them. By introducing fees for PAs offers a way to offset operational expenses. Impact on Merchants and Customers Currently, banks also pay a fee to use the UPI switch. PAs recover costs from merchants through platform fees, convenience fees, and other charges, while customers remain exempt from direct UPI charges. Industry sources suggest PAs may pass these new costs to merchants or absorb them, depending on agreements in place. Often, the funds are first deposited into an escrow account managed by the PA before being transferred to the merchant. This setup ensures settlement security but may now attract additional costs due to ICICI Bank's new policy.
