Punjab govt to set up special unit to tackle GST violations

To institutionalise tax enforcement, finance and taxation minister Harpal Singh Cheema on Monday announced the decision to establish a state-level special fraud detection unit (SFDU) headquartered at Patiala. This dedicated Unit will streamline the detection and bring consistency in investigating complex cases involving Goods and Services Tax (GST) violations. Punjab cabinet minister Harpal Singh Cheema
Cheema stated that the SFDU will be tasked with uncovering and probing high-value GST frauds, with particular focus on breaking down circular trading operations, unearthing benami (anonymous) transactions, and eliminating the practice of fake invoicing. 'The unit will be empowered to initiate stringent enforcement actions, including cancellation of suspicious GST identification numbers (GSTINs), blocking wrongful claims of input tax credit (ITC), and recommending prosecution against offenders to uphold legal accountability', he added.
The FM highlighted that the SFDU will leverage advanced technologies, including artificial intelligence (AI), data analytics, and centralised backend operations, to enhance its detection capabilities. The Unit will conduct comprehensive data mining and pattern recognition across the state to identify anomalies in tax returns, transaction networks, and goods movement.
He further stated that the Unit will use data-driven red flags to selectively verify only dubious or miscreant taxpayers, protecting honest taxpayers from unnecessary scrutiny. This strategic approach aims to strike a balance between effective enforcement and taxpayer facilitation, ensuring a more efficient and taxpayer-friendly administration, he emphasised.
Detailing the composition of the SFDU, Cheema stated that the Unit will comprise a multidisciplinary team consisting of experienced tax officers, skilled IT professionals, a chartered accountant, and a legal officer. He said that this team will be equipped with real-time access to critical datasets such as GSTN information, e-way bill tracking, toll records, and RFID trail analytics, enabling prompt and precise action against tax evasion.
The minister informed that SFDU will be empowered by robust legal provisions under Sections 67, 70, 74, and 132 of the CGST/PGST Acts, complemented by relevant sections of the Indian Penal Code (IPC).

Last Updated: Lakhimpur (Assam), Aug 6 (PTI) The Assam government on Wednesday realised Rs 7.5 crore for tax evasion from a Haryana-based company involved in constructing a four-lane road from Dhemaji to Oyan in Arunachal Pradesh, an official said. A 12-member team from Guwahati conducted an investigation into tax evasion allegations against Kaluwala Construction Private Limited over six days. Investigations have so far revealed an estimated tax evasion of around Rs 64 crore. The company failed to provide adequate justification for several discrepancies identified in their GST profile during the verification process, the official said. New Delhi: The Delhi Police has busted a syndicate for allegedly cheating people by posing as bank employees and offering credit card rewards, officials said on Tuesday. Five people have been arrested in the case. The syndicate came to light when a resident of Palam Colony lodged a complaint on June 20, stating that he was cheated of Rs 96,000 after receiving a call from a person claiming to be from a private bank. According to the police, the gang impersonated bank employees and contacted victims under the pretext of redeeming credit card reward points. The caller informed the complainant of partial details of his credit card and convinced him to share OTPs in the name of reward point redemption. The money was then fraudulently transferred through a mobile application into the accused's bank account, a police officer said. "They would collect the credit card details and OTP from unsuspecting victims and transfer the defrauded money through mule bank accounts," the officer said. "A case was registered and an investigation was taken up. It was found that the defrauded amount was settled in a bank account and later diverted to another bank before being withdrawn. CCTV footage from ATMs showed one accused withdrawing cash with his face covered," the officer added. Following a raid at a location in Mohan Garden, police arrested three of the accused — Atul Kumar, Sunny Kumar Singh and Kaushal Kumar. A search of the premises led to the recovery of multiple bank account kits, stamps of different firms, mobile phones and other digital gadgets. "During interrogation, it was revealed that Kaushal Kumar, a former private bank employee, was responsible for opening multiple mule accounts. He had taken a rented premises in Mohan Garden, where he facilitated the creation of current and savings accounts. These accounts were then provided to cyber criminals through a woman who was also later arrested," he added. Sunny Kumar Singh, a final-year CA student, helped create GST and Udyam certificates as well as email IDs for opening accounts. Atul Kumar, in whose name the firm was registered, held three bank accounts used in the fraud. The fifth accused, Md Ahmad, who previously worked in call centres, was identified as the key caller impersonating bank officials. He had been absconding and was wanted in another cyber fraud case registered earlier this year. Ahmad was arrested based on the inputs provided during interrogation. "All accused, Md Ahmad, Kaushal Kumar, Atul Kumar, Sunny Kumar Singh, and the woman, have been arrested and further investigation is underway," said the officer

While these ventures exhibit high growth rates, they are still establishing their business models. Arora's portfolio includes several such companies, contributing to both outperformance and competitive he has no option, his option is equity because he has to compare it with his alternatives. The alternative is Indian debt and the game you have to play is the spread. Previously we used to say that the market will make 14-15% because that is in line with the corporate earnings, but that means the economy is doing well and the interest rates, if measured by 10-year government bonds, was say 8-9%. So you are making 5% more. And now that instrument is giving you 6.3%, so you will make 10-11-12%. All these things are consistent with each other because the economy is slow, the interest rates are slow and nominal growth rate is low. Therefore, prima facie, you will make a lower nominal rate, but you have to compare it to interest say the same thing to foreign investors that previously the index used to outperform and hopefully do, but that the index will give you 14%, 13% and you will lose 2.5-3% on currency, so you will anyway make 11%. Now, we say you will make 12% and lose 1% on currency or make 11% and lose plus-minus 1% on currency. So, it is somewhat the same for everybody. But the whole game is relative to your choices. So, the spread is first thing is that in aggregate, the earnings are growing 10% or 9%, and that is why from now to year end or maybe even to March, you cannot make a greater annualised rate than that. In the back of your mind, you should have some expectation that these things will improve and that this is not the normal, it will be 2-3% higher because growth is less. With lower interest rates and maybe the festive season, monsoon, or even generally the government giving some more attention to it or cutting GST or any other rate will help by 1% or 2%.The normal cycle is that the economy, whatever anybody does or does not do, in rupee terms will grow around 10%, which is 6.5%, 6.7%, 6.3% GDP growth plus 3 odd percent inflation. So, anyway, the economy grows 10%. It is not something second is that financials and particularly the banks which because of the 1% cut in interest rate, had their NIMs go down a little bit leading to lower profit. But as soon as this has been passed to the public in terms of lower deposit rates, they will also go back to higher profit. It is a thumb rule of life that they will grow 1.2 to 1.3 times GDP nominal term. So they will grow 13%, as they have been doing for 30 years. They are not going to stop now. Either the stocks have to fall more, or they have to go below average valuation or grow 2-3% more, but we will tend to have about 12% earnings growth in aggregate and that is where we will be till some big event happens to take it much three pools basically have slow growth – financials, consumer and IT. For big pools, you have to look at companies that are changing the habits of consumers or even of companies, not relying so much on the end growth of consumers. If you are only changing the habit, but the overall pie is the same, there are many companies. You can change the habits of how you buy groceries, how you eat food, how you pay for your transaction with cash or with an app, whether you are going from unorganised logistics to organised logistics, whether you are buying insurance from an agent or online. We have all of them and they are all growing 50%, 80%, 100%, 150%.But do not overdo this because obviously these are high growth but are still setting themselves up in terms of businesses and just breaking even. Cumulatively together we have some 15-18% but they help me in two ways. They make me outperform and second, they help me irritate get bugged that these companies do not make profit as if only they have read Warren Buffett. Today somebody bought Rs 3,800 crore of the stock and says it does not make profit. I bought this stock at maybe 40% of this price. Some guy tweeting away and taking 50 rupees advisory is commenting. The point is there are new areas and only young people like me can understand about Paytm or Zomato, even CarTrade has done so well. PB Fintech has done well. Delhivery has done well. The point is you have to give them a fair chance and to understand what they are doing and the fact that they have survived and the fact that everybody else has been thrown out and the fact that the customer is not going back to the old remember that none of this is relying on the overall growth of the pie and all that. It is all happening from the market share shift. One day when you have to rely on the fact that insurance is growing or consumer is growing, then it becomes a boring stock. Right now, it is happening because this is the new way that the consumer or the corporate will react in whichever area and if that bet does not resonate with you, then this is an unsustainable trend and you would not believe it. I believe that all these trends are sort of but people do not want it. People say oh, how can this make money? The point is all of them have cash. Not one guy is losing one rupee in terms of cash and you can see their accounts and you can see that every year there is some addition to cash and therefore they are okay and it is an optionality and they are growing 100% while we worry about some IT company increasing its guidance from 0-3 to 1-3 and get excited. Please do, but not me.
