City regulator unveils car loan compensation scheme worth up to £18bn

Drivers could be handed a share of between £9bn and £18bn in compensation next year, after the City regulator said it would consult on a redress scheme for consumers affected by the car finance scandal.
The Financial Conduct Authority (FCA) said on Sunday that it plans to launch the redress scheme in 2026, with consumers 'starting to receive compensation next year'.
'At this stage, we think it is unlikely that the cost of any scheme, including administrative costs would be materially lower than £9bn and it could be materially higher,' the FCA said in a statement.
The watchdog said that although some scenarios put the total cost as high as £18bn, it considered estimates in the mid point of this range to be 'more plausible'.
In most cases individuals would receive less than £950 in compensation, it added.
The regulator will start consulting on the compensation scheme by October, and plans to include motorists who were harmed by discretionary commission arrangements .
These discretionary commissions, which were banned in 2021, inflated the cost of car financing by controversially allowing car dealers to earn higher commissions if they put customers on loans which earned higher interest rates for the lender.
The watchdog will also consult on broader motor financing issues where motorists may have been harmed by egregious or unfair commission arrangements.
It comes after a supreme court ruling on Friday largely sided with finance companies on Friday, but upheld a single case in which judges said the relationship between the lender and borrower had been 'unfair.'
The supreme court case was brought by two specialist lenders, Close Brothers and South Africa's FirstRand, in an attempt to challenge the three consumers who collectively won the court of appeal case in October.

Justices were asked to review the court of appeal ruling, which suggested nearly all commission arrangements – unless plainly disclosed and issued under full consent of the consumer – were unlawful.
If upheld, it would also have meant millions of people who bought a car with finance could be owed compensation at an estimated cost of up to £44bn to lenders including Santander UK, Close Brothers, Barclays and Lloyds.
The sum would have almost rivalled the payment protection insurance saga, which cost banks about £50bn.

The Financial Conduct Authority has provisionally banned a former star City fund manager and fined him and his former company almost £46 million. The financial watchdog said Neil Woodford put investors' money at risk. It said it will ban Mr Woodford from holding senior manager roles and from managing funds for retail investors. Mr Woodford will be fined £5.89 million and Woodford Investment Management (WIM) will be fined £40 million. Mr Woodford and WIM have referred the case to the Upper Tribunal for appeal. The former manager's flagship fund, Woodford Equity Income Fund (WEIF), was wound down in 2019 after investors tried to withdraw cash faster than the fund could pay out, amid concerns over its high exposure to illiquid and unquoted shares. The value of the WEIF had fallen from a high of more than £10.1 billion in May 2017 to £3.6 billion before its suspension. About 300,000 investors still had cash trapped in the fund when it was suspended. On Tuesday, the FCA said it had concluded that Mr Woodford and the fund 'made unreasonable and inappropriate investment decisions' between July 2018 and June 2019. The fund's sale of liquid assets and acquisition of illiquid ones meant WEIF was unable to meet rules in place at the time, whereby investors should have been able to access their funds within four days. 'WIM and Mr Woodford did not react appropriately as the fund's value declined, its liquidity worsened and more investors withdrew their money,' the FCA said. 'The FCA has concluded that Mr Woodford held a defective and unreasonably narrow understanding of his responsibilities.' The regulator said it found that Mr Woodford and his company's failings 'led to a significantly increased risk of the fund being suspended'. Steve Smart, joint executive director of enforcement and market oversight at the FCA, said: 'Being a leader in financial services comes with responsibilities as well as profile. Mr Woodford simply doesn't accept he had any role in managing the liquidity of the fund. 'The very minimum investors should expect is those managing their money make sensible decisions and take their senior role seriously. 'Neither Neil Woodford nor Woodford Investment Management did so, putting at risk the money people had entrusted them with.'

The £100m man isn't thinking about being the £100m man. Although, should he and Liverpool achieve the success together that they hope they will, he will become the £116m man and – as things stand anyway – not merely the club record signing but the British record. Perhaps it helped him adjust to a world of sizeable, seismic fees when Bayer Leverkusen put a €150m (£130.3m) price on him Liverpool negotiated them down a bit, but the fee was still one to dwell upon. But not for Florian Wirtz. 'I don't think about it,' he said. 'I just want to play football and how much money the clubs pay between each other, it doesn't matter.' No pressure there, then. Or none that he puts on himself. It may be, of course, that the German only spends a few weeks as the biggest buy in Liverpool's history. They have already bid £110m for Alexander Isak, even if they have a reluctance to increase it after a swift rebuttal. A saga may deflect some attention from a signing who ought to lend plenty of excitement in his own right. Wirtz had played at Anfield in Leverkusen's colours, losing 4-0 in the Champions League last season. He enjoyed a first game in Liverpool's red rather more, a 3-2 win over Athletic Bilbao on Monday. Nor did he have to spend too much time pondering a striker who might arrive. Not when he operated behind one who already has. Hugo Ekitike is another of the Bundesliga all-stars. Wirtz had faced the Frenchman, who could cost £79m. Now he is charged with supplying him. 'He is a really good player,' he said. 'It was a joy to watch him at [Eintracht] Frankfurt and I was really happy he signed to come to us. In the training sessions already he went well and also in the game we had some combinations that were good.' And Wirtz has been bought to combine; to create too. 'I will try to find the right places to be and the right spaces to get the ball and to be dangerous and create chances,' he said. His duties include being the creator-in-chief. As Arne Slot noted after the victory over Athletic, Liverpool have lost Trent Alexander-Arnold's creativity and while Wirtz operates in a different position, the German can compensate for the right-back's departure with his own invention. Wirtz can operate as a false nine or off the left, but Anfield's first vision of him was as a No 10. He was selected there, but given a licence to roam. 'I think I am a player who needs freedom on the pitch and the manager gives it to me,' he said. Wirtz has the permission to go where he thinks he can cause most damage; that he has recorded totals in double figures for both goals and assists in each of the last two Bundesliga seasons indicates he is capable of inflicting a lot, and in various ways. Not every arrival from the Bundesliga has flourished in the Premier League, but Liverpool like to shop there. It was also instructive Wirtz referenced his own running power. 'I just try to create chances and also work against the ball, so I can also run a lot, so bring this to the team and then with the ball I can make the team better and bring my teammates into better situations,' he said. He proved he had conquered the Bundesliga, inspiring Leverkusen to their first league title in 2023-24, winning the division's player-of-the-year award that season. He attracted interest this summer: from Real Madrid and Manchester City. Above all, from Bayern Munich. He chose Liverpool, in part because he could see himself in Slot's side. 'I came for that reason because I thought I could fit in this team,' he said. In the letter, the ministers said the main sum would be taken off future grants for the event."It is unfortunate that, despite the efforts of the new organisers and the grant funding already provided by the Department for the Economy, the success of the event should be imperilled due to ongoing challenges in resolving the 2024 overspend," they said."Having therefore considered the balance of risks and the great benefit that Battle brings to our community and visitor economy, it is our judgement that a grant to the Battle of Flowers Events Limited to contribute towards the settling of its outstanding debt is necessary in order to enable a Battle of Flowers Parade in 2025 and beyond."The money has come from the Chief Minister's Pilot £90,000 top-up grant, which was also given out in 2024, will not be recovered, the ministers added.
