
Bid to encroach Puri temple land won't be tolerated: SJTA

The judgment was in connection with a case related to 15 acres of 'disputed' land belonging to Puri Jagannath temple, located in Jatni's Kantia Mouza in Khurda district. Odisha's Advocate General Pitambar Acharya argued in favour of the temple, and SJTA chief administrator Arabinda Padhee also appeared in the court to defend the interests of the shrine.
The court, in its order, has made it clear that no sanction or approval regarding temple land transactions would be considered valid, unless it strictly adheres to statutory requirements. These requirements include prior recommendations from competent land committees and valuation by the district sub-registrar, as mandated by law.
The court also observed that substantial tracts of land endowed to Lord Jagannath, particularly in urban and peri-urban areas, have been lost from the effective control ofthe temple administration due to flawed alienations of immovable property. Therefore, the High Court directed the revenue and land records authorities to take immediate action to correct entries related to properties held in the name of Lord Jagannath.
The court has also asked the State government to review the existing provisions and procedural mechanisms under the SJTA to address significant loopholes that have facilitated unauthorised alienation and mutation of temple properties.
'In this case, the court has given orders to manage the land property of the temple in the coming days. The court order will be a guideline for the SJTA and will be followed strictly. The SJTA is committed to protecting the temple land,' Padhee said.
Official sources said a total of 60,426.943 acres of land is in the name of Shree Jagannath temple, and these land parcels are located in 24 of the 30 districts of Odisha. Of these, the Shree Jagannath Temple Administration has received the final record of rights over 38,061.892 acres of land.
Besides, 395.252 acres of the temple land have been identified in six other States. A total of 169.86 acres of land, belonging to the Puri Jagannath temple remained encroached in Cuttack, Puri, Bhadrak, Kendrapara, Khurda, Balasore and Jajpur. As many as 974 cases have been lodged in different tehsils of the State to remove encroachments.

The inventory will then be conducted in the presence of the nominated officials,' the minister added. The last full inventory of the Ratna Bhandar was carried out 46 years ago in 1978. The SJTMC plays a key role in overseeing the affairs of the 12th-century shrine. The committee, constituted under the Shree Jagannath Temple Act, 1955, has 18 members out of which 10 are nominated by the government. The remaining include ex-officio members, with Gajapati Maharaj Dibyasingha Deb serving as the permanent chairperson. However, the state government has not nominated members for the last 10 months. The term of the previous members was over on September 2, 2024. 'Thereafter, the government has not made the nominations. Now that the Rath Yatra is over, we are hoping the government will soon nominate members to the SJTMC,' Gajapati Maharaj recently told PTI. 'It is necessary in the interest of the smooth and efficient management of the affairs of the Shree Jagannath Temple in Puri,' he added. CUTTACK: In a significant judgement, the Orissa High Court's single judge bench of Justice Sashikanta Mishra, directed the state government to sanction and disburse Freedom Fighter's Pension to Brahmananda Jena, a 101-year-old man, who has claimed to have participated in the 1942 Quit India Movement. The court directed the authorities to sanction and disburse the pension to Jena within six weeks of submission of the certified order. Jena, who had applied for the pension under the Swatantrata Sainik Samman Pension Scheme in 1981, approached the court after decades of inaction. He filed a petition seeking the high court's intervention in 2021 after the government rejected his claim citing lack of records and doubts over his age and eligibility. However, in the July 29 judgement, Justice Mishra noted that Jena had submitted ample documentary evidence, including a 1984 communication from the Ministry of Home Affairs forwarding his application to the state government and a 1989 Home department letter listing him among applicants. The court held that the claim that Jena did not apply before the 1990 deadline was baseless. On the question of age eligibility-applicants must have been born before 1924, Justice Mishra accepted Jena's 2002 voter list entry, which showed his age as 82. The authenticity of the list had been certified by the deputy collector, and no inquiry was shown to have been conducted on it. The state's allegation of age manipulation was dismissed as speculative and unsubstantiated. Further, Jena had submitted affidavits from two recognised freedom fighters Khali Pradhan and Manguli Parida, both of whom confirmed his role in the movement. Their credentials and signatures were verified by the district treasury officer, adding weight to Jena's claim.
