The eThekwini Municipality was forced to pay damages to three men who were unlawfully arrested for drinking in public by the Metro police.

The eThekwini Municipality has paid out collective damages of R1 million in a case brought by three men who said they were unlawfully arrested by Metro police officers for carrying sealed bottles of beer.
A judgment handed down by the Durban High Court earlier this year revealed that the men were initially suspected of drinking in public by the Metro police due to their possession of the sealed bottles. The situation thereafter escalated and the men were arrested and spent time in jail, where they said they were subjected to severe mistreatment. One of the men, Philani Lukhele, was also shot in the leg during the incident.
The court awarded the men damages for past loss of earnings, unlawful arrest and detention, and assault and contumelia. Msizi Cele was awarded R231,000, Welcome Hlongwa received R240,200 while Lukhele's case was distinguished from the other due to the severe injury he sustained. He was awarded R649,500. The court judgment noted that all three victims testified in support of their claims, while the municipality closed its case without calling any witnesses.
'The undisputed evidence of the plaintiffs' case is that on 15 December 2012, they were walking in Chatsworth towards the taxi rank, carrying two sealed bottles of beer,' the judgment stated. The men testified that a Metro police officer, who was in a private vehicle, approached them and accused them of drinking in public.
The three denied this, asserting that their beers were sealed. The three boarded a taxi to Durban and the Metro police followed them in their vehicle and then stopped the taxi at a roadblock. Other officers were also at the roadblock. The officer who had initially questioned them pointed them out to other officers, leading to their removal from the taxi.
'When the victims inquired about their alleged wrongdoing, the police did not respond. Instead, they were assaulted publicly. The police fired four shots in the direction of Msizi but missed him; they eventually shot Philani in the knee,' said the judgment. The men said they were handcuffed and placed in a Metro police van and pepper spray was sprayed in the back of the van. When Lukhele, who suffers from asthma, requested his inhaler, one of the officers took it from his pocket and inhaled from it, the judgment said.

It said the police then transported them to Chatsworth police station, where they were further assaulted. The three, according to the judgment, said they had overheard one officer instructing another to fabricate a story that they had attempted to deprive the officer of his firearm. Shortly thereafter, an ambulance arrived, but the driver spoke to the police officer and then drove away. Lukhele was taken to the hospital, where he was treated for his injury while being guarded by police and handcuffed to a bed.
'Msizi and Welcome were taken to Bellair police station, where they were detained for four days before being brought to Chatsworth Magistrates' Court, where they were released without appearing in court.'
During their four days in detention, Msizi and Welcome said they did not eat any food; they were given one meal by another detainee who was receiving food from his family. Philani spent six days in hospital and was released without appearing in court.
The court found that the circumstances of the case demonstrated malice on the part of the Metro police during the arrests. 'The evidence indicated that the police were not investigating any offence and had no reasonable suspicion against the plaintiffs when they were arbitrarily arrested. The police shot at unarmed individuals who posed no threat, victimising those they were meant to protect.'
The plaintiffs were represented by attorney Ajit Severaj.
It is understood that the municipality has made payment to the plaintiffs. The City was contacted for comment last week but had not responded by publication.

It also alleges that the accused attempted to kill Nkosikhona Madlala and Sandile Colin Sambo by hitting them with golf sticks, baseball bats, putting wooden pallets on their bodies, and pouring fuel on them with the intent to burn them to death. The State alleges that Gopal had addressed his co-accused and some community members to attack black Africans outside his tavern. A State witness, Anard Chetty, who said he used to reside at Gopal's tavern after he lost his job during Covid-19, told the court that on July 12, 2021, when the victims were attacked, Tyreece hit Dlamini with a rock on his head. He stated that Dlamini arrived at the tavern in a taxi bearing the Africa Touch logo, accompanied by others. Chetty testified that Gopal used to sell alcohol illegally, as it was banned during that time because of Covid-19 lockdown restrictions. He said a female and two males had alighted from the taxi to go to the tavern, and within minutes, they came back running. At that time, a lot of vehicles came, with one being driven by Gopal's brother, blocking the taxi. He said the taxi occupants, including Dlamini, who were left inside, were told to come out and lie down on the floor. He said there was resistance from the taxi occupants and stated that the people who had come in vehicles had sticks and they assaulted the victims. He said they ran in different directions. 'A female and one male ran to the container behind the tavern and came out the next day around 6.00 in the morning,' Chetty said. He said that when Dlamini jumped out of the taxi, he was tripped by Gopal's brother, and he fell. 'More people came to assault him,' he added. Additionally, Chetty, who would constantly get emotional and cry, said that as Dlamini was being assaulted, Tyreece picked up a rock and hit him with it. 'After the third accused (Tyreece) picked up the big rock, Accused Four (Timothy) took the hammer and beat him with it. Those are the two fatal blows that ended that guy. He couldn't move,' he said, crying. Additionally, Chetty told the court that Dlamini was his friend. He said Tyreece is the son of Timothy. During his testimony, Judge Mluleki Chili kept on reminding him to slow down as they took notes. At some stages, when Chetty got emotional, he would tell him to drink water and take a minute. All the accused are out on bail. The trial continues.

This, as the State presented crucial cellphone evidence on Wednesday, alluding that she had represented herself as three different persons while carrying out the crime. Jacobs, 37, was widely supported by her family at the Bellville Magistrate's Court where she faces charges of kidnapping and defeating the ends of administrative justice. Closing arguments in her much-anticipated bail application continued where Sergeant Dawid Fortuin presented new evidence, that of cellphone records, pertaining to the merits of the State's case. Fortuin, from the Serious and Violent Crimes Unit for Kidnapping, took the witness stand armed with the evidential cellphone records, in which he detailed that they had confiscated cellphones from Jacobs following her arrest, one of which had a dual SIM. He said the records showcased that three persons, namely a Sameemah, Wasiema, and Chevon Classen, had used three different cellphone numbers with three different IMEI numbers - alluding that the person in question was Jacobs who had represented herself as such. He stated that the records showed that on June 18 and 19, the cellphone of Jacobs was found in the jurisdiction of the Mitchell's Plain District Hospital where the mother of baby Mogamat Imaad Sharmar, Imaan Sharmar, had given birth. Fortuin added that queries with management about the the identity of Chevon, who claimed to work for an NPO, the Zoey Project, which assisted mothers, was confirmed to have no staff member with that name Jacobs's lawyer Asongewa Mafuya dropped a bombshell when presenting his arguments as to why she was a candidate for bail. He said Jacobs was diagnosed with bipolar disorder in 2023 and had three children, one of which was a minor aged seven years. Mafuya said the State did not present evidence to prove that she would disturb or interfere with the matter, or that she was a flight risk. He added that Jacobs's children were in the care of her friend while her 67-year-old mother was in hospital. The magistrate asked the State to clarify who Chevon was. "Was Chevon and Sameemah in the vehicle the day of the kidnapping?" he asked. The State clarified that to the Uber driver Jacobs had been presented and to Sharmar, Chevon had been presented. Fortuin stated that with the inquiry relating to another victim, that of a 15 year old girl, who was pregnant, they were waiting for vital video footage of her vehicle. He said her arrest was imminent in that matter. State prosecutor, Salaahuddeen Simon, presented arguments as to why Jacobs was not a candidate for bail, in which he cited that the public's trust in the justice system and that she could evade her trial and that she was a flight risk or could interfere or destroy evidence. The matter was postponed for bail consideration to July 28. The State is set to prove that Jacobs kidnapped Imaad on June 28 at Middestad Mall after pretending to be a sponsor for the Zoey Project and that she had befriended Sharmar prior to that. Earlier, Fortuin detailed that a witness who visited Jacobs behind bars following her arrest, said she claimed she did not kidnap the infant but that she was given the baby by the mother whom she had given money and takkies. 9 prison officials face murder charges after inmate's death in Polokwane

Nine officials from the Polokwane Correctional Centre appeared in the Polokwane Magistrate's Court yesterday on murder charges following the death of an inmate who was allegedly assaulted while in custody. According to Polokwane Review, Limpopo police spokesperson Colonel Malesela Ledwaba said the suspects were arrested after a police investigation linked them to the incident, which reportedly took place in July 2024. 'The inmate succumbed to injuries sustained during the alleged assault. The matter was reported to the police and, at the time, an inquest was registered. However, during the course of the investigation and after autopsy results, the charge was changed to murder,' his statement read. Ledwaba said four of the officials were first arrested in October 2024, but the case against them was provisionally withdrawn. On Monday, the four suspects, along with five additional officials, were re-arrested following new evidence.
