A high school criminal justice teacher and basketball coach at the center of a growing scandal after police say he placed a 15-year-old student in a choke hold owns a lengthy rap sheet, it has been revealed.
Devon Murphy, 41, a teacher at Douglas Byrd High School in Fayetteville, North Carolina, has been charged with felony assault by strangulation and misdemeanor child abuse stemming from an alleged attack that took place in March.
According to court documents, Murphy 'put his arm around the juvenile victim's neck in a choke hold position until the victim lost consciousness,' inflicting visible swelling on the right side of the student's forehead.
'The defendant unlawfully and willfully, being a person providing care and supervision because of a teacher and student relationship… did inflict physical injury on that child,' the arrest warrant states.
Public records reviewed by the Daily Mail show that Murphy has been arrested eight times over the last 16 years, mainly for non-payment of rent.
He has amassed more than $5,000 in unpaid debts, and in at least four cases landlords had to take legal action to have him forcibly evicted from their properties - most recently in 2022.
Murphy was arrested late last month, four months after the alleged incident took place. He was booked into the Cumberland County Detention Center before being released on $25,000 secured bond.
Murphy appeared in court on Friday and is scheduled to return for a disposition hearing on August 20.
The arrest warrant details how Murphy allegedly used a choke hold maneuver that rendered the teenager unconscious.
The alleged assault happened on school grounds, during the school day.
The Fayetteville Police Department has launched a full criminal investigation, and its Youth Services Unit has urged any other potential victims or witnesses to come forward.
'These allegations are concerning and do not reflect the standards we expect of those who serve our students,' the Cumberland County Schools (CCS) district said in a statement. 'The safety of our students and staff remains our top priority.'
The charges against Murphy have already shocked parents and staff.
It is unclear whether Cumberland County Schools conducted a full background check before hiring Murphy in October 2013, or if his prior arrests were disclosed or considered irrelevant to his employment.
In response to the most recent charges, CCS says it immediately suspended Murphy with pay after learning of the allegations.
'As soon as the situation was brought to our attention, we reported it to law enforcement and suspended the employee with pay, pending the outcome of the investigation,' a CCS spokesperson told WCCN.
Murphy has served in both middle and high schools since joining the district more than a decade ago.
He also worked as head coach of the boys' varsity basketball team at Douglas Byrd High.
The school has not commented on whether the student involved in the case was a player on the team or had other personal interactions with Murphy outside of class.
There are questions as to why it took police more than four months to arrest Murphy. The alleged assault took place in March, but Murphy wasn't arrested until July 24.
The district also has not explained whether Murphy continued teaching or coaching students between March and his late-July arrest. His current employment status is 'suspended with pay.'
No motive has been revealed, and neither the victim's identity nor the specific circumstances leading up to the alleged attack have been disclosed publicly due to the juvenile's age.
Murphy remains free on bond and has not commented publicly on the charges.
Murphy is due back in court on August 20, where he is expected to face a preliminary hearing that could determine whether the case proceeds to trial.

This is despite her once claiming he had stomped on her stomach, and dragged her by the hair. In a surprise letter to the judge, Gina has pleaded for Combs to be set free from jail. She also stated that she does not believe Combs is a danger to the community. It's the first time "Victim-3" has identified herself by name. According to court documents cited by Page Six, Gina described her ex as a committed family man 'who has not been violent in many years.' She claimed, 'To my knowledge, [Combs] has not been violent for many years, and he has been committed to being a father first. 'Our relationship, like many, was not always perfect, we experienced ups and downs, and mistakes were made. 'He has substantial ties to his family and community, including children who depend on him for emotional and financial support,' she added. 'I want to assure the Court that if released, I believe Mr. Combs will adhere to all conditions imposed and will not jeopardize his freedom or the well-being of his family.' Her plea was included as an exhibit in the defense's latest filing ahead of the singer 's sentencing in his federal criminal case on October 3. VIOLENCE However, her endorsement has come as a surprise as she had previously claimed Combs had punched her in the head during their five-year relationship. Her allegations were aired during a bombshell 2019 interview with controversial celebrity gossip blogger LaTasha Kebe, known as Tasha K - who was once involved in a defamation lawsuit with Cardi B. Gina alleged during her interview with the blogger, "He stomped on my stomach really hard — like, took the wind out of my breath. 'I couldn't breathe. He kept hitting me. I was pleading to him, 'Can you just stop? I can't breathe.'' She also alleged the rapper then grabbed her by the hair and was 'punching' the back of her head. Gina claimed she defended herself by fighting back as she had had 'enough of his s**t.' She alleged, "He was mentally, emotionally and physically abusing me." DROPPED OUT OF TRIAL Diddy's ex was initially part of the prosecution's case against Combs, and was to have been a key witness. She was expected to testify alongside his other ex-girlfriends, Cassie - the R&B singer whose real name is Casandra Ventura - and Jane Doe, who testified under a pseudonym. However, prosecutors had to tell the jury in New York that 'Victim-3 may not show up' after they lost contact with Gina and her attorney. Gina had claimed to Tasha K that Combs, "would always compare me to Cassie and tell me that I'm the bad one, she's a good one." Cassie and Jane told the court during the star's trial that he forced them into drug-fueled sex marathons they called 'freak-offs' and 'hotel nights." The jury deliberating at his sex trafficking trial heard testimony from 34 witnesses over seven weeks at Manhattan's Federal Court. APPLES THROWN This included testimony from Combs' ex-employees, such as his former assistant, George Kaplan, who testified that he witnessed at least three alleged instances of violence. He alleged that his saw his former boss throw apples at a woman named Gina in 2015. Kaplan said it was "the last straw for me." ABC News reported during the trial that Kaplan told the court that in the fall of 2015 he saw a "very angry" Combs. He alleged that he saw the singer "throwing these green apples that lived in a decorative vessel" in the entryway of his Miami home. 6 6 The apples were allegedly aimed "at another girlfriend" of Combs' who, Kaplan told the court, was "trying to shield herself with her arms." In 2016, security cameras captured Combs hitting, kicking and dragging Cassie as she left his room at the Intercontinental Hotel in Los Angeles. The horrific video was shown repeatedly throughout his trial. VERDICT In early July, Combs, 55, was acquitted of racketeering conspiracy and sex trafficking charges carrying potential life prison terms. But, he was convicted of two counts of transportation to engage in prostitution for arranging for girlfriends and male sex workers to travel to engage in sexual encounters that he filmed. Each prostitution-related charge carries a potential maximum 10 years in prison. After hearing the verdict, Combs held his hands up in a prayer motion, looking at the jury and hugging his defense lawyer Teny Geragos. Prosecutors had alleged the Bad Boy Records founder used physical violence, threats, and the resources of his business empire to coerce two former girlfriends to participate in days-long, drug-fueled sexual performances with male sex workers sometimes called "freak-offs." Combs pleaded not guilty, and his lawyers argued his two girlfriends took part willingly in the encounters. SENTENCING The Associated Press reported that prosecutors said they now expect Combs could face a prison sentence 'substantially higher' than the four to five years they once thought he was likely to face. In a submission to the Manhattan federal court last Thursday, they also opposed his request to be released on $50 million bail while he awaits sentencing. The Illinois governor, JB Pritzker, has vowed to protect the Democratic members of the Texas house of representatives who left the state in an attempt to block Republican efforts to redraw Texas's congressional maps. 'We're going to do everything we can to protect every single one of them and make sure that – 'cause we know they're doing the right thing, we know that they're following the law,' Pritzker said at a press conference on Sunday in Illinois alongside some of the the Texas Democratic lawmakers. The Texas Democrats fled the state on Sunday in an effort to prevent the Texas house from reaching the quorum on Monday needed to vote on a newly proposed congressional map. In response to the Democrats' actions, Greg Abbott, the Republican Texas governor, threatened to expel the Texas Democrats from the state house if they do not return by Monday at 3pm CT – when the legislature is set to resume. Ken Paxton, Texas's Republican attorney general, also condemned their actions on Sunday and threatened their arrest. 'Democrats in the Texas House who try and run away like cowards should be found, arrested, and brought back to the Capitol immediately,' he said in a statement. 'We should use every tool at our disposal to hunt down those who think they are above the law.' But Pritzker, who said he will support the Texas Democrats, described their actions as 'a righteous act of courage', saying that they 'were left no choice but to leave their home state, block a vote from taking place, and protect their constituents'. Pritzker, a billionaire and potential 2028 presidential candidate, is reportedly helping the Democrats find lodging and meeting spaces, but is not assisting with the $500-a-day fine that each lawmaker will have to pay under new rules the house adopted in 2021, according to the Texas Tribune. The outlet reported that the Democrats have been fundraising from large Democratic donors to help pay that fine. The redistricting plan, unveiled last week by Texas Republicans, could allow Republicans to gain as many as five additional US House seats ahead of the 2026 midterm elections. Currently, Republicans hold 25 of Texas's 38 seats, and in the overall House of Representatives, Republicans hold a small majority of 220-212. The proposal came after pressure from Donald Trump, who urged Texas Republicans to redraw the maps. 'There could be some other states we're going to get another three, or four or five in addition. Texas would be the biggest one,' Trump told reporters in mid-July. 'Just a very simple redrawing, we pick up five seats.' Abbott called a special session this summer and included on the agenda the redrawing of Texas's maps in addition to proposals to aid victims of the 4 July Texas flooding and other matters. Many of Texas's 62 house Democrats have gone to Illinois, with others attending the National Conference of State Legislatures in Boston this week and others meeting with the New York governor, Kathy Hochul, in Albany. 'We're leaving Texas to fight for Texans,' Gene Wu, the Texas house Democratic caucus chair who fled to Illinois, said in a statement on Sunday. 'We're not walking out on our responsibilities; we're walking out on a rigged system that refuses to listen to the people we represent' he added. During the news conference in Illinois on Sunday, Pritzker criticized the redistricting proposal, saying it would 'steal five congressional seats, silencing millions of voices, especially Black and Latino voters'. 'Let's be clear, this is not just rigging the system in Texas, it's about rigging the system against the rights of all Americans for years to come,' he added.
