Legal concerns over Borneo.TV: Group

Kota Kinabalu: Sabah Film and Visual Association (Safva) has called for a constructive dialogue between the Sabah Maju Jaya (SMJ) Secretariat, IB Media Consultant Works Sdn Bhd and local creative stakeholders to ensure Borneo.TV operates in a legally compliant and equitable manner. Safva said it supports the State government's effort to promote local talent through Borneo.TV, describing it as 'a commendable initiative to elevate Sabah's creative industry.' However, Safva's legal advisor Yong Yit Jee said several potential legal concerns must be addressed for the platform to function transparently and lawfully. He claimed there needs to be clarity on whether income generated from Sabah content on Borneo.TV is contributing to the state's tax revenue, especially as the platform is owned by a peninsula-based company. 'Any income derived from local productions should contribute to Sabah's tax revenue as it directly pertains to the State's economic growth,' Yong said in a statement. He also raised concerns over the handling of intellectual property and royalties for local creators, stressing that 'transparency in the contractual agreements between the SMJ Secretariat and IB Media is vital'. 'It is crucial to ensure that Sabah's artists will receive appropriate royalties and that their intellectual property rights are protected,' he said. Safva urged the State to ensure that IB Media holds the proper broadcasting licences from regulators like the Malaysian Communications and Multimedia Commission (MCMC). 'Without the proper legal authorisations, the platform could be operating in violation of Malaysian laws,' Yong said, warning of potential legal liability for all parties involved. The association also questioned whether Borneo.TV has adequate compliance with the Personal Data Protection Act (PDPA), as the platform may collect data from creators and viewers. 'Any breach of privacy regulations could result in severe legal consequences for the platform and its stakeholders,' Yong said. Safva further urged the government to ensure that the platform has clear terms of service and content guidelines to reduce liability linked to user-generated content. In addition, Yong said Borneo.TV must uphold the principle of Free, Prior, and Informed Consent (FPIC) when featuring indigenous cultural content. 'Failure to consult with indigenous communities could lead to legal action if cultural elements are used without consent,' he said. Safva called for the public disclosure of the agreement between the SMJ Secretariat and IB Media, stating that 'transparency is essential to safeguard the interests of local creatives'. Despite fierce competition from contenders like Tupai King, Tekka, Kim Hong, and D13, the Musang King's creamy texture and rich, complex flavour won the judges over. Judges included food experts, chefs, and seasoned durian lovers, all in search of the perfect mix of sweetness, aroma, bitterness, and that unmistakable durian punch. Agriculture and Food Security Minister Datuk Seri Mohamad Sabu, who officiated the event, celebrated the fruit's global following while sounding a note of caution. In a Facebook post, he reminded fans that with global recognition comes responsibility, emphasising that Malaysian durians must maintain consistent quality and not become complacent. Marking 30 years with tribute to record holders
Celebration for all: Record holders displaying their certificates at MBR's 30th anniversary dinner. — IZZRAFIQ ALIAS/The Star PETALING JAYA: The Malaysia Book of Records (MBR) marked its 30th anniversary with a gala dinner that paid tribute to the country's most inspiring record holders. Held at a hotel in Petaling Jaya, the event recognised 91 national record holders, ranging from mountaineers and athletes to entrepreneurs and media figures. Deputy Communications Minister Teo Nie Ching, who attended the dinner, said MBR had captured the nation's imagination over the past three decades. 'This iconic publication continues to evolve in print, online, and on social media,' she said. Teo also highlighted Bernama's MBR-certified 25-hour non-stop multilingual broadcast in 2019 as a reflection of excellence and inclusivity in Malaysian broadcasting. Star Media Group (SMG) was among several media organisations honoured for their ongoing support of MBR's mission to document Malaysian excellence. Receiving the award on behalf of SMG was its chief operating officer Lydia Wang. Also present were SMG group chief executive officer Chan Seng Fatt and chief content officer Datin Paduka Esther Ng. MBR chairman Datuk Seri Michael Tio said the organisation has certified over 8,800 records in the past 30 years, with the aim of reaching 10,000 in the coming years by enhancing outreach to all states and communities. 'We are not just about human achievement; we are also about brand activation and community engagement,' he said. 'We hope to inspire more Malaysians to break records.' Tio also announced MBR's collaboration with Bernama to produce a 13-episode record-themed television series (Malaysia Book of Records 2025: Malaysia Luar Biasa) set to air on Bernama TV starting Aug 26. Among the 91 honoured were Datuk M. Magendran, the first Malaysian to conquer Mount Everest, and Soh Wai Ching, a tower-running world champion and the first Asian to win the Empire State Building Run-Up. Over 800 guests attended the black-tie event, including business leaders, public figures and representatives from various media agencies.

Maybank grants US$150m green loan to Austria's AT&S
KUALA LUMPUR: Malayan Banking Bhd (Maybank) is granting a sustainability-linked loan (SLL) amounting to US$150 million (RM638 million) to Austria Technologie & Systemtechnik Malaysia Sdn Bhd (AT&S). In a statement yesterday, the bank said the landmark transaction marks the first SLL issued by a Malaysian and Southeast Asian commercial bank to AT&S, and the first such facility by a local lender to a multinational company in Malaysia's semiconductor sector. Maybank said the financing would support the development of AT&S's first high-end integrated circuit (IC) substrate plant at Kedah's Kulim Hi-Tech Park that will include state-of-the-art equipment and closed-loop recycling systems, adhering to AT&S's comprehensive sustainable energy framework. The facility will produce advanced IC substrates, essential components to meet surging demand for high-performance data processors, data centres, and artificial intelligence (AI) infrastructure. The targets attached to the SLL include reducing annual greenhouse gas emissions by 31% by March 31, 2028, using fiscal year 2022 as the baseline. Maybank Global Banking Group CEO Datuk John Chong said from 2021 to the end of the first quarter of 2025, Maybank mobilised RM125.46 billion in sustainable finance across Asean, surpassing its RM80 billion target by 2025. 'We are pleased to support AT&S in developing its first IC substrate facility in Kulim, a project that not only marks a significant milestone for the company but also further reinforces Malaysia's position in the global semiconductor value chain. 'The financing aligns with our strategic focus on the semiconductor ecosystem in Southeast Asia, where we have identified financing opportunities,' he said. AT&S president/CEO Michael Mertin said the company's sizable investment of over US$1 billion in Malaysia follows the demand from its global clients, and reflects its confidence in Malaysia's semiconductor ecosystem and its growth trajectory. 'It also aligns with the ambitions of Malaysia's National Semiconductor Strategy and the New Industrial Master Plan 2030 to position the country as a leading hub for advanced manufacturing,' he said. – Bernama
