
Consumer forum orders LIC to pay Rs 21 lakh to complainant
The policy had a term of 20 years, with a plan to return the full amount on the 21st year, according to the complainant.
In June 2022, the applicant's daughter suffered from a severe fever and was treated at a hospital in Udupi. She recovered but suffered from fever again, and despite treatment, she passed away on Feb 18, 2023, at a hospital in Manipal. Born in 2015, in Udupi, the child was healthy at birth with no health issues, and the applicant had paid three annual premiums by the time of her death.
After her passing, the applicant submitted all necessary documents to the Udupi LIC office, seeking an insurance claim of Rs 25 lakh. However, the insurance company rejected the claim on April 4, 2024, alleging undisclosed pre-existing health issues at birth, and refunded only Rs 3,96,911, the amount paid in premiums.
The applicant then appealed to the Insurance Ombudsman in Bengaluru but the outcome there was also not favourable. Subsequently, a complaint was filed against LIC with Udupi district consumer disputes redressal commission. The commission president Sunil T Masaraddi and member Sujata B Koralli ruled in favour of the applicant, ordering LIC to pay Rs 21,03,089 with 9% interest, along with Rs 25,000 for mental agony and harassment, and Rs 10,000 for litigation costs, stated advocates H Anand Madivala and Deepak Kumar Poojari, who represented the applicant.

Kozhikode: Dr A K Rairu Gopal, 80, affectionately known as Kannur's 'two-rupee doctor' for his selfless medical service, passed away early Sunday at Manikkavu near Thana. He was battling age-related ailments. For over five decades, Gopal had stood as a beacon of compassion, charging just Rs 2 as consultation fee and offering free medicines to those who couldn't afford them. In an era of rising healthcare costs, he remained a lifeline for thousands of poor patients. The son of Dr A G Nambiar and A K Lakshmikutty Amma, Gopal began his practice at his home near the LIC office in Talap, where he treated patients for around three decades. Later, he continued his service at his residence 'Lakshmi' near Manikkavu. Gopal is believed to have treated over 1.8 million patients in his over 50-year career. Thana resident M Shafeek, who knew him for years, recalled, "He was our beloved doctor - one of a kind. In the early years, he would start seeing patients as early as 5 am, to accommodate labourers, students, and others who had to leave early for work. His diagnosis was remarkably accurate, and he only recommended tests when absolutely necessary. The medicines he prescribed were also affordable." Even when Gopal revised his consultation fee after decades, it was raised only to Rs 10, but he never insisted on even that, ensuring his services remained accessible to all. He announced his retirement last year by pasting a handwritten message on his gate that his health was not allowing him to continue the practice. His wife P O Sakuntala, also a doctor, used to help him in his practice in the early years. He has two children, son Dr Balagopal and daughter Vidya. Chief minister Pinarayi Vijayan was among those who condoled Gopal's death, saying his willingness to serve by charging only Rs 2 as consultation fee for over half a century had brought great relief to poor patients. Hypertension no bar: Insurance agency asked to pay 2L claim
Ghaziabad: Ruling that medical claims cannot be rejected on the grounds that a person has hypertension, the district consumer disputes redressal commission (DCDRC) has directed an insurance firm to pay Rs 2.1 lakh to a Ghaziabad man whose request was denied. DCDRC president Praveen Kumar Jain and members RP Singh and Shailja Sachan also ordered the insurer – Religare Health Insurance Company – to pay Kapil Anand Rs 5,000 as compensation for litigation costs and denial of the claim filed in 2019. The payment must be made within 45 days, and failure to comply will attract 6% simple interest on the outstanding amount. In a plea filed with the consumer commission, Anand said he'd bought the Rs 5-lakh policy from Religare after paying a premium of Rs 17,150 on March 3, 2019. The commission in its July 26 order cited two previous judgments by NCDRC-New Delhi to rule in favour of Anand. In the 2013 Ravindra Bindra vs National Insurance Company case, the Delhi commission had ruled that hypertension history could not be grounds for rejecting heart treatment claims, it said. In another 2013 case (Satish Chandra Madan vs Bajaj Alliance), NCDRC rejected the argument that hypertension was a chronic disease. Centre Cuts Prices Of 35 Essential Medicines
In a move to make medicines more affordable for patients, the National Pharmaceutical Pricing Authority (NPPA) has reduced the retail prices of 35 essential drugs sold by leading pharmaceutical companies. The formulations, which will now cost less, span a wide range of medicines including anti-inflammatory, cardiovascular, antibiotic, anti-diabetic and psychiatric medicines. The Ministry of Chemicals and Fertilisers notified the order based on price regulation by the NPPA. The price reductions, which apply across drugs, are expected to bring relief to consumers, particularly those managing chronic conditions. The key formulations covered by the price control order include fixed-dose combinations of Aceclofenac, Paracetamol and Trypsin Chymotrypsin, Amoxycillin and Potassium Clavulanate, Atorvastatin combinations and newer oral anti-diabetic combinations like Empagliflozin, Sitagliptin, and Metformin. The price of one Aceclofenac-Paracetamol-Trypsin Chymotrypsin tablet manufactured by Akums Drugs & Pharmaceuticals and marketed by Dr Reddy's Laboratories has now been fixed at Rs 13, while the same formulation marketed by Cadila Pharmaceuticals is now priced at Rs 15.01. Similarly, a tablet containing Atorvastatin 40 mg and Clopidogrel 75 mg, widely used for cardiovascular conditions, is priced at Rs 25.61. Oral suspensions for paediatric use - Cefixime and Paracetamol combinations - have also been included, along with critical medications like Cholecalciferol drops for Vitamin D supplementation and Diclofenac Injection, which has been priced at Rs 31.77 per ml. The official order states that retailers and dealers must display these updated price lists prominently in their premises. Failure to comply with the notified prices may attract penal provisions under the DPCO, 2013, and the Essential Commodities Act, 1955, including recovery of overcharged amounts with interest. The NPPA clarified that the prices fixed were exclusive of Goods and Services Tax (GST), which may be added, if applicable. Manufacturers are required to comply with all statutory requirements, issue updated price lists in Form V through the Integrated Pharmaceutical Database Management System and submit the information to the NPPA and state drug controllers. Any prior price orders issued for the specified formulations and manufacturers stand superseded by this latest notification. The NPPA, which functions under the Ministry of Chemicals and Fertilisers, is the drug price regulator in India, responsible for fixing and revising prices of pharmaceutical products and monitoring the prices of both controlled and decontrolled drugs.
