ONOE aims to alter basic principles of Constitution: Singhvi

New Delhi: Legal expert and Congress lawmaker Abhishek Singhvi on Tuesday emphasised that the Constitution (129th) amendment bill proposing simultaneous elections in the country would need ratification by at least half of the state legislatures, noting that the legislation aims at altering the basic principles of the Constitution.
The Rajya Sabha member, who was deposing before the joint parliamentary committee (JPC) examining the bills on one nation, one election (ONOE), made a detailed presentation on legal points and said the draft laws violate the 'will of the people' and principles of federalism.
When Congress MP Priyanka Gandhi Vadra, who is also part of the 31-member JPC, asked Singhvi if simultaneous polls lead to favourable verdict to the ruling party, the latter pointed to reports that suggest favourable results.
The senior advocate told the JPC that changing the schedule for Lok Sabha and assembly elections to hold them simultaneously would amount to curtailing the mandate of the voters as some assemblies' five year-term would be reduced by a few years to sync the polls.
He emphasised that the Constitution amendment bill will need approval from at least half of the state legislatures, noting that it seeks to alter the basic principles of the Constitution. He pointed to certain provisos of Article 368(2) (which empowers Parliament to amend the Constitution) to back his argument on the need of ratification by state legislatures.
Singhvi maintained that federalism is most vital part of the basic structure and when it is interfered with or artificially curtailed, it tampers the basic structure.
The committee headed by BJP lawmaker PP Chaudhary is mandated to examine the bills on simultaneous polls — the Constitution (129th Amendment) Bill and the Union Territories Laws (Amendment) Bill — and give its report on whether they are sound enough for the purpose or need changes. The panel is likely to submit its report in monsoon session in July.
Several lawmakers, Chaudhary, Randeep Surjewala, Ghanshyam Tiwari and Sambit Patra, also asked questions to Singhvi.
BJP leader and Lok Sabha MP Bansuri Swaraj attended the meeting with a bag carrying a message about the 'loot' in the National Herald case.
Talking to reporters later, Congress MP Priyanka Gandhi Vadra said: '(Swaraj) was roaming around with some slogan. I enjoyed it. I even asked her about her bag but she just smiled…'

Mumbai: In the lead-up to the civic elections, the Congress on Wednesday launched a targeted campaign against the Brihanmumbai Municipal Corporation (BMC), vowing to expose alleged land scams on a weekly basis. (Photo by Bhushan Koyande/HT Photo) As a curtain-raiser, Congress leaders in Mumbai have called for an investigation into an alleged ₹ 1,200 crore redevelopment scam involving the MCGM Staff Colony plot in Andheri. The allegations include unauthorised dual approvals granted in 2011 and 2021, illegal demolitions, and misuse of public land. The campaign is being led by Congress MP Varsha Gaikwad, the party's Mumbai chief; former corporators Mohsin Haider and Ashraf Azmi; and party spokesperson Suresh Rajhans. The BMC staff colony is located on a prime plot near Juhu Lane and Barfiwala Road, valued at over ₹ 1,200 crore. According to the Congress's allegations, the 4497.1 square-metre plot, originally reserved for housing Class IV municipal employees, has been simultaneously sanctioned for two separate redevelopment projects—under the Slum Rehabilitation Authority (SRA) and the Ashraya Yojana, a BMC scheme to redevelop and provide housing for its conservancy staff. In a detailed complaint letter addressed to municipal commissioner and administrator Bhushan Gagrani dated May 5, the Congress leaders highlighted the apparent collusion between civic officials and private developers. The letter called for an immediate stay on all construction activity on the site, highlighting procedural violations, land ownership ambiguities, and the unjust eviction of long-standing residents. 'The plot has been sanctioned for redevelopment under both SRA (2011) and Ashraya Yojana (2021), without formally cancelling either,' said Gaikwad. 'BMC has demolished 55 staff quarters, 85 hutments, and a welfare centre, despite no withdrawal of the slum notification or NOC under SRA. No eligibility survey or alternative housing provisions were made for 85 families, violating constitutional rights and housing laws.' Gaikwad added that officials ignored 2011 eligibility guidelines while declaring residents ineligible, even though prior documents listed their occupancy. Haider alleged that the developer was paid ₹ 10 crore between 2021 and 2024, with ₹ 14.36 lakh spent on a welfare centre that was subsequently demolished. While the undivided Shiv Sena ruled over the BMC for over three decades till 2022, India's richest civic body has been under an administrator's rule since then due to ongoing court cases. The Congress leaders have urged Gagrani to initiate disciplinary proceedings against civic officials involved in the allegedly unauthorised demolitions and misuse of authority. They have demanded the restoration of the plot for its original municipal housing purpose and an independent investigation into the alleged ₹ 1,200 crore land misuse scam. They have also asked for all 85 hutment dwellers residing on the site since before 2011 to be either rehabilitated or provided rent compensation. 'We will unearth scams related to BMC every week,' said Haider. 'For 3.5 years, with no elected body, the BMC has arbitrarily passed proposals.' He described how in his previous role as the Civil Aviation Minister in Modi government 2.0, the number of airports in the country went up from 74 to 158. Scindia said that the Congress-led administration was a dismal failure in terms of connectivity, and it was a 'scam-led government", specifically in the vertical of telecom. 'We have today about 1.2 billion mobile subscribers (from 900 million in 2014) and 974 million people with internet connectivity (from 250 million in 2014)—which is nearly a four-fold jump in the last 10 years," Scindia said. The Union Minister went on to say that India had the fastest 5G rollout and will lead the world on 6G. 'Within 22 months, we had close to Rs 4.5 lakh crore of capex by private sector and public sector telcos. 99.6% of districts have been connected. Close to 300 million people are on 5G in India; that is a revolution. PM Modi has the capability to ideate and then execute plans," Scindia told CNN-News18.

BJP MP Jagdambika Pal on Wednesday (July 2, 2025) launched a scathing attack on Rashtriya Janata Dal (RJD) leader Tejashwi Yadav, accusing him of attempting to mislead the people of Bihar ahead of the upcoming Assembly polls. Mr. Pal's remarks came during a press conference in Mumbai, specifically addressing Mr. Yadav's recent statement about 'throwing the amended Waqf Act in the dustbin.' Mr. Pal, who chairs the Joint Parliamentary Committee on the Waqf (Amendment) Bill, asserted that there is a 'competition' between Mr. Yadav and AIMIM leader Asaduddin Owaisi to treat Muslims as a 'vote bank.' His comments followed Mr. Yadav's declaration at a rally in Patna's Gandhi Maidan, held under the banner 'Save Waqf, Save Constitution,' where the RJD leader vowed that the Opposition alliance would jointly abolish the Waqf Act if elected to power. Mr. Pal claimed that while Congress leader Rahul Gandhi, Tejashwi Yadav, Samajwadi Party leader Akhilesh Yadav, and Asaduddin Owaisi are opposing the legislation, 'poor and Pasmanda Muslims across the country support it.' Pasmanda is an umbrella term encompassing Backward, Dalit, and Adivasi Muslims. Elaborating on the purpose of the amended Act, Mr. Pal stated that it aims to ensure better management of Waqf properties for the benefit of needy Muslims. He challenged the Congress and RJD to identify any provision in the legislation that would transfer Waqf land from Muslims to others, accusing them of playing with people's emotions. Regarding Mr. Yadav's 'dustbin' remark, Mr. Pal alleged that the RJD leader is inadvertently supporting those who have illegally encroached upon Waqf land. Mr. Pal highlighted that the Narendra Modi-led government is implementing recommendations from the Sachar Committee Report, officially titled 'Social, Economic and Educational Status of the Muslim Community of India,' which had estimated that Waqf properties could generate ₹12,000 crore annually. He contrasted this with the current realisation of only ₹163 crore, claiming that the unaccounted funds were not reaching the intended beneficiaries, namely 'poor, widowed women among others,' but were 'disappearing somewhere.' He emphasised that the Sachar Committee was formed during the Congress government's tenure due to the poor socio-economic condition of Muslims. He reiterated that while the committee recommended that Waqf properties could generate substantial revenue, previous governments, including the UPA, failed to implement these recommendations, unlike the current Modi government. This, he suggested, is the real reason for the opposition. Mr. Pal also claimed that the Waqf Bill has been accepted across States, with the exception of West Bengal, where he alleged the Trinamool Congress (TMC) instigated 'state-sponsored violence in places like Murshidabad.' He emphasised that the amendment ensures transparent management, with all Waqf properties digitally recorded and their details accessible on the Minority Affairs Ministry's portal. 'Waqf property, where the land is in the name of God, has been misused by people to construct a house, mall, etc,' Mr. Pal said. He criticised Mr. Yadav for repeating what he termed as 'insulting the Constitution,' a mistake he attributed to Rahul Gandhi, whose actions, he claimed, led to his defeat. 'The Parliament exists to make laws. If you have objections, approach the Supreme Court. But playing with people's emotions like this, won't work, this country runs on law and the Constitution,' he stated.
