Leopard parts case: Appellate court ups jail term to four years for Vietnamese offender

PUTRAJAYA, July 11 — The Court of Appeal today reinstated the four-year imprisonment sentence originally imposed by the Sessions Court on a Vietnamese man for keeping 54 parts of a protected leopard species without a special permit.
A three-member bench comprising Justices Datuk Hashim Hamzah, Datuk Mohamed Zaini Mazlan and Datuk Noorin Badaruddin allowed the prosecution's appeal to overturn the Temerloh High Court's decision, which had earlier reduced Nguyen Van Tien's jail term to two years.
Justice Hashim, who delivered the court's unanimous decision, said that the judiciary takes wildlife-related offences seriously.
'Therefore, the sentence imposed by the High Court is set aside, and the four-year jail sentence imposed by the Sessions Court is reinstated, effective from the date of arrest,' he said.
The fine of RM300,000 in default of 12 months' imprisonment imposed by the High Court remains unchanged.
The prosecution had appealed against the High Court's decision to reduce the prison sentence but did not challenge the fine.
On February 24, 2024, Nguyen, 34, pleaded guilty at the Sessions Court to the charge of keeping parts of a leopard (Panthera pardus), a protected species, without a special permit in the National Park, Pahang, at about 12.30pm, on December 12, 2023.
He was charged under Section 68(1)(b) of the Wildlife Conservation Act 2010 and sentenced under Section 68 92) (c) of the same law.
Nguyen was sentenced to four years' imprisonment and fined RM300,000, in default of four years' jail, effective from the date of his arrest on December 12, 2023.
In October last year, the High Court reduced the sentence to two years while maintaining the fine in default of 12 months' jail.
During today's proceedings, deputy public prosecutor Aznee Salmie Ahmad argued that the reduced prison sentence would send the wrong message, portraying Malaysia as a lenient jurisdiction for foreign offenders involved in transboundary wildlife crimes.
She said that Nguyen's actions had not only harmed the environment but also impacted the sovereignty of Malaysian law, thus warranting a stern custodial sentence.
Representing himself through an interpreter, Nguyen told the court that he had come to Malaysia in search of work and claimed that he received the leopard meat from other Vietnamese acquaintances to take home, adding that he was unaware of Malaysian laws.
He apologised and pleaded for the two-year sentence to be maintained, saying he wished to return to Vietnam.
Nguyen also told the court that he is responsible for supporting his elderly parents and young children in Vietnam, noting that his wife is unemployed. — Bernama

PUTRAJAYA: A mother who defamed her two sons, both with the title 'Datuk' and are successful businessmen, has lost her final appeal against the decision that found her liable and ordered her to pay RM200,000 in damages, FMT reported. A three-member Court of Appeal bench chaired by Justice Azimah Omar said the High Court did not err in upholding a Sessions Court ruling that V.T. Menaka had lowered the reputation of M. Natarajen and M. Satishkumar, through a video posted on Facebook. "There is no appealable error that warrants appellate intervention. "Unfortunately, the sons had to take their mother to court," she said, adding that the plaintiffs had proved all the elements of libel. She said the 30-minute Tamil-language video, accompanied by a derogatory caption, had harmed the reputation of Menaka's sons. She said the appellant's defence of justification and fair comment is also not applicable. The other judges on the bench are Justices Wong Kian Kheong and Ismail Brahim. The court also ordered Menaka, 67, to pay RM20,000 in costs to her sons. Lawyer M. Manoharan, who represented Natarajen, 42, and Satishkumar, 41, said Menaka was classified as bankrupt after she had failed to pay the judgment sum and costs of RM10,750 as rdered by the Seremban Sessions Court in 2023. Menaka was ordered to pay RM100,000 in damages each to the sons. "She filed this appeal after obtaining consent from the Insolvency Department," he said. Lawyer Asmawi Ismail appeared for Menaka. In the posting made on Sept 19, 2020, Menaka claimed that her sons were 'big time' criminals, had forged her signature to remove her as a director of their family company Linsun Group of Companies Malaysia and wanted to kill her with a pistol.

JPJ finalising major Kejara system overhaul to get dangerous drivers off the road

BANGI, July 17 — The Road Transport Department (JPJ) is now in the final stage of reviewing new improvements in the Demerit Points System For Traffic Offences (Kejara), which is a safety mechanism to take serial offenders and dangerous drivers off the road. JPJ director-general Datuk Aedy Fadly Ramli said the improvements that will be implemented are part of the massive overhaul of the Kejara system as announced by Transport Minister Anthony Loke recently. 'The Kejara system is currently in the final review stage at JPJ before we take it to the Transport Ministry for consideration on what improvements will be implemented to the new Kejara system,' he said. He said this at a press conference after an engagement session with the Association of Lorry Operators and Express Tourism Bus Operators on road safety initiatives here today. Aedy Fadly said the improvement aspects in this system need to go through a certain period of time because it also involves certain legal aspects and amendments. 'Amendments to the procedures will take time because it needs to go through higher levels such as the Attorney General and so on,' he said. Previously, Loke said Kejara would be overhauled soon because the system is currently ineffective and is deemed to be a failure. Loke said that previously, the deduction of demerit points would only be done after a traffic offender has paid the summons or has been charged in court and not when the summons notice is issued. The Kejara system is a procedure for assigning demerit points to motor vehicle drivers who commit scheduled offences under the Road Transport Act 1987 and the regulations thereunder. A total of 20 offences identified as potentially causing serious or fatal accidents and endangering other road users was included in the list of offences under the (new) demerit point system. Meanwhile, Aedy Fadly said holders of the Public Service Vehicle (PSV) and Goods Vehicle Licence (GDL) who are involved in serious accidents will go through a certain process before a decision is made on whether the licence will be suspended. 'JPJ will not immediately suspend a licence. A show-cause notice will be issued first and an assessment will be made on whether or not suspension is necessary. The state JPJ director is authorised to make this decision,' he said. He said the suspension of licence will only involve PSV and GDL, not the Malaysian Driving Licence (LMMy) for the drivers involved. 'So far, five drivers have had their PSV licences suspended. It is not permanently suspended. It is temporary and comes with a specfic term and duration,' he said. Regarding today's engagement session, he said JPJ informed stakeholders about the progress of efforts so far to improve road safety. 'The participants have given very positive feedback and asked that JPJ regularly hold town hall discussions, which we initiated for the first time this year. 'My team and I have agreed to hold this town hall dialogues periodically at the request of the industry,' he said. — Bernama
