Nishnawbe Aski Police Service's former chief files $2.5M wrongful dismissal lawsuit

The former chief of Canada's largest First Nations police service has filed a more than $2.5-million lawsuit against the its oversight board, alleging he was wrongfully terminated.
Roland Morrison was terminated from the Nishnawbe Aski Police Service (NAPS) in November following an independent investigation. He had been suspended with pay in March over misconduct allegations.
"Following the conclusion of that investigation, the NAPS board of directors had made the decision to terminate Roland Morrison's employment with NAPS, effective immediately," the board said in a statement Nov. 1.
According to a statement of claim filed in Ontario's Superior Court of Justice in Thunder Bay, Morrison is seeking $2.5 million in damages, for wrongful dismissal and breach of contract.
The statement alleges NAPS and its board acted in bad faith in their investigation and termination of Morrison. It describes him as an "exemplary employee" and says the termination was done in a "disrespectful manner".
NAPS and the Nishnawbe Aski Police Service Board "engaged in a fishing expedition to find any conduct, regardless of how stale-dated and untrue, which could be relied on to terminate Chief Morrison for cause," it alleges.
NAPS board to file full defence, chair says
NAPS, which serves 34 First Nations across northern Ontario, is now led by police Chief Terry Armstrong, who came out of retirement to take on the role.
Frank McKay, chair of the NAPS board, provided an emailed statement to CBC News about Morrison's lawsuit, reiterating he was terminated for cause.
"The board arrived at the decision to terminate Mr. Morrison after very careful consideration, following a full and detailed investigation," said McKay.
The board has received Morrison's statement of claim and plans to file a full defence, he said.
McKay said no further comment will be provided.
None of the allegations by either Morrison on the NAPS board have been proven in court.
Document details 2 investigations
Morrison is a member of Chapleau Cree First Nation who was born and raised in Moose Factory, Ont. He was appointed police chief in April 2019.
Before his full-time appointment, Morrison spent six years as deputy chief of police and became acting chief in September 2018, following Armstrong's retirement.
In the statement of claim, two investigations into Morrison are detailed.
He was first placed on administrative leave in March 2024 pending an investigation into a discrimination complaint made my an NAPS employee. The complaint was about a protocol that NAPS's board put in place about his former spouse, who was a detective staff sergeant for NAPS.
"In particular, on Feb. 20, 2024, Chief Morrison was advised of an updated reporting protocol which removed Chief Morrison's involvement in a complaint against his former spouse, Det. Staff Sgt. Morrison," said the statement of claim.
The claim states Morrison did not involve himself in the investigation, but did voice concerns about the way his ex-spouse was told she was being placed on an administrative leave.
"This was communicated to her via a virtual Zoom call prior to a known 10-hour drive from her assignment to Thunder Bay. The method of communication was not culturally sensitive to Det. Staff Sgt. Morrison's Indigenous heritage, nor did it consider the impact on her mental health," said the statement.
Morrison was suspended with pay pending the results of an independent investigation.
The claim alleges NAPS attempted to find a reason to terminate Morrison so it wouldn't have to continue paying him. It said he was contacted at the end of May 2024 about a second investigation.
"It was alleged that Chief Morrison unlawfully provided firearms to the officers of the Navajo Nation, for adornment on their uniforms during ceremonial appearances during their visit to Nishnawbe Aski Nation's traditional territory in Northern Ontario," reads the statement.
The ceremonial visit took place in August 2023, but the statement of claim alleges NAPS said it only became aware of the allegations in April 2024.

The British Columbia government is considering removing supportive housing from the province's Residential Tenancy Act (RTA) as it responds to safety concerns from housing providers. Housing Minister Ravi Kahlon said the potential move is among the options on the table for a new 'short timeline' working group tasked with delivering recommendations to address crime, health and safety concerns raised by housing providers. 'We know that low-barrier housing is needed, but that doesn't mean no barriers,' Kahlon said. 'The steps we are taking will help supportive housing providers be able to put strict rules in place to keep people who are living there safe, keep their workers safe, and the community safe.' The working group will be made up of supportive housing providers, police, unions representing supportive housing workers, staff from the province and BC Housing. It will also consult with First Nations and tenant advocates. They have also told the province they are limited in when they can allow access for police. At the same time, Kahlon said the working group is being tasked with ensuring any changes also protect residents. 'If we are to move away from the RTA, then what are the protections for individuals who are there? How do we ensure they have some basic rights?' Kahlon said. 'But also, how do we ensure that those that are working there and those that are operating these places can make sure the rules are being followed? 'They need the additional HC supports that complex care beds provide, and we are expanding those out,' he said. 'I do think that's part of the solution as we move forward, and that is something we are considering as we move forward on any changes to the RTA around supportive housing, is what does that next step look like?' The working group is expected to deliver recommendations by the end of summer, and Kahlon said his hope is that the government can act on them by September or October.

The SIU report said that during a roadblock attempt, the man sped towards officers and the OPP officer fired two shots at the SUV. No one was injured. Director Joseph Martino was satisfied that the officer, at the time he fired his weapon, did so believing it was necessary to protect another officer from a reasonably apprehended attack at the hands of the man.

So she did what women in her situation are advised to do — she reached out to police. And they failed her. Three days later, she was dead. Const. Anson Alfonso, the more senior of the two officers who responded to her call on Aug. 15, 2022, was found guilty of misconduct Tuesday under the Police Act and demoted for 18 months to a second-class constable. He was also ordered to complete further training. 'I absolutely, positively believe if their actions were done with empathy, professional conduct and genuine concern, I believe my sister would definitely be alive and happy sitting here beside me,' Ingram said fiercely. 'It was very preventable. She was genuinely scared and this was a cry for help. The situation was not handled well at all.' Read More When Alfonso and partner Const. Sang Youb Lee spoke to the frightened woman outside of her apartment building, she told them she believed Dowman was going to kill her. But she didn't want him charged because she didn't want to see another Black man go to jail and she was afraid of what he would do to her if they arrested him. Despite his terrifying threats on her phone — ' You still breathing 'cause I say so. Don't f— with me, ' he texted. ' Ain't no coming back from death. Your done (sic). I promise you that ' — the officers dismissed her fears as a ' he said, she said ' situation, cautioned her and even accused her of instigating the dispute. They spent 39 minutes speaking with Mallia and just three minutes on the phone with the man she feared. Alfonso later emailed Mallia with a warning: ' This is a written caution to (cease) all forms of contact with him and move on with your life. Failing to do so you can get arrested. Three days later, Dowman pulled Mallia into a North York underground parking garage and after four minutes of listening to her beg for her life, he coldly shot her in the head. Earlier this year, the 35-year-old was convicted of first-degree murder and sentenced to an automatic life term. Both Lee and Alfonso were charged with misconduct-related offences for taking ' no action to protect ' Mallia despite having evidence to arrest Dowman for uttering threats. Lee pleaded guilty to neglect of duty and was demoted for one year. RECOMMENDED VIDEO Alfonso, a cop since 2019, pleaded guilty, ' though not at the earliest opportunity, ' but otherwise had a clean record, Supt. Shane Branton said. ' The victim of intimate partner violence called police for help. Instead of receiving the help that she should have received, she was cautioned and not provided the required level of service that the public expects, ' said Branton. ' Ingram said she saw no signs of emotion from Alfonso, though she's been told they'll receive his letter of apology. In addition to the demotion, Ingram would have liked to have seen Alfonso be forced to volunteer with domestic violence victims to gain a better understanding of what her sister was going through. As Branton said, ' Any progress that has been made in building relationships between the police and the community and the victims of intimate partner violence has been severely damaged by Const. Alfonso's actions.' Three years have passed and her grieving sister still can't speak about Daniella in the past tense. 'My sister is the sweetest person you will ever meet. She's friendly, she's funny, she loves animals. It's so sad that her life was cut short because I believe she was developing into somebody so wonderful,' she said, her voice breaking.
