Gerakan's No 2 granted ad-interim stay of execution in LGE defamation suit
PETALING JAYA : Gerakan's Oh Tong Keong has been granted an ad-interim stay of execution of a High Court decision ordering him to pay damages to Lim Guan Eng for falsely accusing the former finance minister of helping a concert organiser obtain tax exemptions.
On Sunday, FMT reported that Oh, who is the party's deputy president, had filed an application for a stay of execution on May 22 pending the outcome of his appeal against the High Court's verdict which awarded Lim RM550,000 in damages.
Penang Gerakan today said that it had successfully raised RM200,000 to help Oh pay the damages.
'In addition, several generous individuals have stepped forward to temporarily advance another RM300,000, allowing us to fully gather a total of RM500,000,' it said in a Facebook post.
The party's state chapter said that it would continue to raise funds to repay the advanced funds.
Oh's Lawyer, Chai Ko Thing, last week said the appeal was filed on May 21.
On May 7, the High Court awarded Lim RM550,000 in damages after ruling that Oh had falsely accused him of helping a concert organiser obtain tax exemptions while the former was the finance minister.
Justice Kenneth St James ruled that Oh had defamed Lim at a press conference on Sept 25, 2019, and through a press release sent out via Penang Gerakan's official email address. The remarks were later published by China Press, which was also found liable.
Oh had questioned why Lim had granted tax exemptions to WGW Entertainment Sdn Bhd and its owner, Hendrik Huang, for a Mandopop concert at Spice Arena.
The judge found that Oh had no basis for his claims and gave no evidence that Lim knew Huang or had granted any tax privileges.
He said although Oh's statements were framed as questions, they were found to be defamatory in nature and did not qualify as fair comment.
Oh was also ordered to publish an unconditional apology to Lim in China Press, online and in print. He was also barred from repeating the claims.
China Press was ordered to pay RM150,000 in damages, RM80,000 in costs, and interest at 5% per annum.

Opposition groups – including democratic lawmakers ousted by the military takeover – and international monitors have called the poll a ploy to legitimise the junta's rule. State newspaper The Global New Light of Myanmar said the 'Law on the Protection of Multiparty Democratic Elections from Obstruction, Disruption and Destruction' was enacted yesterday. Its 14-page text forbids 'any speech, organising, inciting, protesting or distributing leaflets in order to destroy a part of the electoral process'. Individuals convicted face between three and seven years behind bars, while offences committed in groups can result in sentences between five and 10 years. The legislation also outlaws damaging ballot papers and polling stations, as well as the intimidation or harm of voters, candidates and election workers, with a maximum punishment of 20 years in prison. If anyone is killed during an attempt to disrupt the election 'everyone involved in the crime faces the death penalty', the law says. Swathes of Myanmar are beyond the control of the junta and some government census workers deployed last year to gather data ahead of the poll faced resistance and security threats. Data could not be collected from an estimated 19 million of the country's 51 million people, provisional results said, in part because of 'significant security constraints'. Analysts have predicted the myriad of anti-coup guerrillas and ethnic armed groups the junta is battling may stage offensives in the run-up to the vote as a sign of their opposition. A UN expert called on the international community last month to reject the election plan as 'a fraud'. Tom Andrews, the UN special rapporteur on the rights situation in Myanmar, said the junta is 'trying to create this mirage of an election exercise that will create a legitimate civilian government'.

2 cops nabbed for allegedly taking RM635,000 bribe
The two suspects, in their 40s, were arrested at MACC's Johor headquarters at about 2am today while giving their statements. PETALING JAYA : Two policemen have been remanded for seven days on suspicion of soliciting and accepting a RM635,000 bribe to not take action against an individual over a gambling offence. The suspects were placed under remand until Aug 5 by the Johor Bahru magistrates' court following an application by the Malaysian Anti-Corruption Commission. Berita Harian quoted an MACC source as saying the duo, in their 40s, were arrested at the commission's Johor headquarters at about 2am today while giving their statements. 'Both suspects are believed to have conspired to solicit and accept the bribe in return for not taking action against the individual for gambling activities,' the source said. 'The suspects are believed to have received the bribe in cash.' Johor MACC deputy operations director Hairul Ilham Hamzah confirmed the arrests.

JS-SEZ draws RM1.34bil in investment commitments from 5 S'pore companies

(Bernama pic) PETALING JAYA : Johor has secured RM1.34 billion in investment commitments from five Singapore-based companies under the Johor-Singapore special economic zone (JS-SEZ), says menteri besar Onn Hafiz Ghazi. An additional RM78 million in potential investments is under negotiation as part of the second phase, he said. Onn Hafiz said these investments were facilitated by the Johor branch of the Malaysian Investment Facilitation Centre, which helps coordinate and speed up strategic investment processes in the state. 'To date, 70 companies from countries including Singapore, China, Germany, the UK, and the Netherlands, as well as local investors, have expressed interest in investing in the JS-SEZ,' Bernama quoted him as saying during his official visit to Singapore as the 82nd recipient of the Lee Kuan Yew Exchange Fellowship. He also met with Singapore's deputy prime minister and minister for trade and industry Gan Kim Yong to strengthen economic ties and discuss the implementation of the JS-SEZ. Onn Hafiz said among the topics discussed were establishing a free trade zone within the JS-SEZ, improving cross-border movement of goods and talent, and developing a second Rapid Transit System link on Johor's western side. He said they also discussed addressing the rising cost of living, infrastructure improvements, and a more efficient transport system. He emphasised Johor's readiness to adopt progressive policies that promote growth and ensure real benefits for the people, and reaffirmed the importance of strong cooperation between Johor, Malaysia and Singapore. 'I believe the strategic cooperation between Johor, Malaysia and Singapore must continue to be strengthened to realise a development agenda that is inclusive, equitable and sustainable, so that no one is left behind,' he said. JS-SEZ was formally established in January through an agreement between Malaysia and Singapore to boost economic connectivity between the state and the republic. It aims to attract 100 projects worth RM100 billion and create about 100,000 jobs in high-value sectors such as manufacturing, digital economy, logistics, clean energy, and tourism over the next decade.
