Rajasthan deer hunting case: Salman Khan's transfer plea and govt's appeal to be heard on Sep 22

The government's plea challenges the lower court's decision to acquit co-accused superstars Saif Ali Khan, Neelam, Tabu, Sonali Bendre, and Dushyant Singh by giving them the benefit of the doubt.
The blackbuck hunting case dates back to October 1998, when superstar Salman Khan and a group of Bollywood actors were accused of poaching endangered blackbucks near Kankani village in Jodhpur during the shooting of the film 'Hum Saath Saath Hain'.
The case has since seen multiple legal turns, with superstar Salman Khan convicted in one of the cases and sentenced to five years in jail in 2018, though he is currently out on bail.
Justice Garg has now clubbed both superstar Salman Khan's transfer petition and the state's appeal against the acquittals for a combined hearing. The High Court will take up the matter on September 22.
This joint hearing is expected to be crucial, as the court may decide on whether the appeals against the acquittals have merit and if the ongoing legal proceedings require transfer for a fair trial.
The case has remained in the public eye for over two decades, symbolising both the complexity of India's legal process and the scrutiny faced by celebrities involved in legal battles.

NEW DELHI: In a significant ruling, the Supreme Court has set aside an order of the Jharkhand High Court which granted anticipatory bail to a man, allegedly accused of cruelty and attempt to murder of his wife, on the condition that he would resume conjugal life with her and maintain her with dignity and honour. A two-judge bench of the apex court, headed by Justice Dipankar Datta and Justice Augustine George Masih, held that conditioning the grant of pre-arrest bail on the accused resuming conjugal life with his wife is improper and not permissible under the law. The court quashed the order passed by the Jharkhand High Court. 'The spouses seemingly, at one point of time, had drifted apart and resided separately for some time. Imposing a condition that the appellant (accused husband) would maintain the respondent no.2 (wife) with dignity and honour is beset with risk in that it can generate further litigation. In such state of affairs, we are of the considered opinion that the High Court should have considered the prayer of the appellant for pre-arrest bail entirely on its own merit instead of imposing a condition,' the court observed in its order. According to the prosecution, the husband, Anil Kumar, was allegedly an accused in a case registered under Sections 498-A (cruelty), 323 (voluntarily causing hurt), 313 (causing miscarriage without consent), 506 (criminal intimidation), 307 (attempt to murder), 34 (common intention) of the Indian Penal Code, along with Sections 3 and 4 of the Dowry Prohibition Act, 1961.

HC upholds charges against suspended Delhi govt official Khakha
NEW DELHI: The Delhi High Court has reportedly refused to quash the charges framed against suspended Delhi government official Premoday Khakha, who allegedly raped a minor girl several times. The High Court also upheld the charges of causing the minor girl's miscarriage and the disappearance of evidence framed against the official's wife, Seema Rani. It further refused to set aside the charge against his two children and wife under Section 21 of the POCSO Act for failure to report the offence despite having knowledge. 'This court is of the considered opinion that there is no perversity or legal infirmity in the order passed by the sessions court framing charges against petitioner Premoday Khakha for offences under Sections 376(2)(f), 376(3), 323, and 354 of the IPC, and Sections 6 and 8 of the POCSO Act,' Justice Swarana Kana Sharma said in the judgment passed on July 15 and made available on July 28.
