Mother saw gunman shoot son near Damilola Taylor centre, court told
Jesse Lloyd-Smith, 20, was fatally injured close to the Damilola Taylor centre in Peckham, south-east London, the Old Bailey was told on Thursday.
At around 4.50pm last July 10, a silver-coloured Ford S-Max car containing the alleged killers drove slowly towards the alleyway, jurors heard.
Prosecutor James Dawes KC said: 'The S-Max passed the Damilola Taylor centre, turned the corner and stopped.
'One of the two men exited the S-Max. He was holding a gun, and he ran towards Jesse firing the gun as he went. There were at least five shots.
'Some of the shots hit Jesse knocking him to the ground. The gunman ran back to the car which drove away.'
The victim's mother Ty Lloyd-Smith was in her flat only yards away and heard the noise of shots, the court was told.
Mr Dawes said: 'She saw the shooter but what she could not see was her son because he was in the alleyway. She feared the worst and she shouted out Jesse's name.'
She ran downstairs to find her son lying on the ground, shot in the head, jurors heard.
His friend Jamie Burgess was frantically trying to help him and an ambulance was called.
Mr Burgess allegedly told police a person called 'S' was involved.
The trial is being heard at the Old Bailey (Daniel Leal-Olivas/PA)
The victim was taken to hospital for emergency surgery but he died the next day.
A search of the scene with dogs, led to the recovery of four spent cartridges and two unfired bullets all from a 9mm automatic pistol, the court was told.
The shooting was partly captured on CCTV footage although it was from some distance away, Mr Dawes said.
The occupants of the S-Max car were 18-year-old Kywan JN Pierre and the alleged gunman, 19-year-old Gabriel Charles, both of whom fled the country after the shooting, the court was told.
JN Pierre, from Selhurst, south London, and Charles, from Southwark, south London, are on trial accused of murder.
Mr Dawes said a key issue for jurors would be whether the pair were in the car, as each had denied they were there.
He said: 'It is the prosecution's case that the first two defendants acted together as part of a joint plan or agreement to shoot Jesse.
'It is the Crown's case that both occupants of the car intended that Jesse would be shot and consequently killed or at least caused really serious harm.'
Charles and JN Pierre are also charged with conspiring to pervert the course of justice with Ben Nguyen, 20, of no fixed address, Enver Francis, 22, from Southwark, Abdoul Guene, 18, from Peckham, Kadjo Kadio, 20, from Dartford, and a 17-year-old youth, who cannot be identified.
It is alleged the group had plotted to take away the Ford S-Max used in the fatal shooting and destroy it in a fire two days later.
Kadio and Nguyen are accused of assisting an offender by making and receiving transfers of funds 'with intent to impede the apprehension or prosecution' of Charles.
Kadio is charged with a similar offence relating to JN Pierre.
The defendants have denied all the charges against them as the trial continues.

Inquest into ketamine death of The Vivienne as rules could change
Inquest into ketamine death of The Vivienne as rules could change Lee Williams, 32, died at home in January The Vivienne at RuPaul's Los Angeles DragCon at Los Angeles Convention Center The inquest into the death of The Vivienne, the winner of the first series of RuPaul's Drag Race UK, is to take place on Monday. James Lee Williams, 32, died at home in Chorlton-by-Backford, Cheshire, on January 5. In March, the star's family revealed the drag queen had died 'from the effects of ketamine use causing a cardiac arrest', saying they wanted to raise awareness about the dangers of the drug. The inquest will be heard by senior coroner Jacqueline Devonish at Cheshire Coroner's Court in Warrington. The Vivienne was found dead in the bathroom of their home near Chester, the opening of the inquest was told. Police attended and confirmed there were no suspicious circumstances. During their time on the show, The Vivienne admitted having been a drug addict for four years. Speaking on the the first series of RuPaul's Drag Race UK, they said: 'It was party, drugs, but I couldn't leave the drugs at the party, it was constant for me.' They added that their addiction was a 'habit that caught on a bit too quick and a bit too hard'. The star performed as the Wicked Witch of the West in a UK and Ireland tour of The Wizard Of Oz musical and reprised the role in the West End at the Gillian Lynne Theatre last year. Article continues below They were due back on stage in March as the Childcatcher in a tour of Chitty Chitty Bang Bang, a role they first played last year. Their funeral in Bodelwyddan, Denbighshire, North Wales, was attended by RuPaul's Drag Race UK contestants Tia Kofi and Baga Chipz, along with singers Ian 'H' Watkins and Aston Merrygold and Coronation Street actress Claire Sweeney. The Government is seeking expert advice after illegal use of ketamine surged to record levels. In the year ending March 2023, an estimated 299,000 people aged 16 to 59 had reported use of the substance, which is controlled as class B, according to the Home Office.

Man sentenced after brutal machete murder bid in Glasgow
Sean Gilhooley, 29, was in a four-strong mob who ambushed Raymond Dyer in broad daylight in Glasgow's Drumchapel on March 23, 2024. Dyer, 35, was left for dead by the laughing assailants after he was struck with machetes, swords and a baseball bat. He was discovered stricken in the street by his mother. Dyer survived the hit bid, despite his horrific injuries. Gilhooley was sentenced at the High Court in Glasgow, having earlier pleaded guilty to an attempted murder charge. As well as the jail term, he will also be supervised for a further three years on his release. Gilhooley had previously been jailed for five years in 2017 for discharging a shotgun. Prosecutors revealed in court how Gilhooley had teamed up with others that morning, including Jordan Steele, who has since passed away. Advocate depute Eilidh Robertson stated Steele - before his death on May 4, 2024 - was said to be "extensively documented as being involved in serious and organised crime during his life". Steele was known to Dyer and his mother, Jacqueline. Miss Robertson said: "It is not clear what caused this incident, but there appears to be a suggestion that Raymond Dyer had in some way wronged local drug dealers who Steele controlled." The court heard Dyer had left his home that morning and appeared "worried". He had been in a local shop and asked someone to look outside to check if there was a car following him. Dyer went on to leave before a grey 4x4 vehicle sped to catch him. READ NEXT: Four men leapt out, clutching weapons and turned on Dyer even after he had fallen to the ground from the vicious blows. It was Dyer's mother who discovered her badly injured son. He groaned: "Mum, the blood is pumping out of my back." The grey SUV then pulled up beside them again. Steele was said to be driving and Gilhooley was the front seat passenger. The mum stated Steele shouted: "You are getting done next." Another witness described the woman "screaming and begging them to leave". Miss Robertson: "This person did not see the driver, but the window behind was down. "The male in that seat leaned out the window and he was holding a long knife, like a sword. "The witness could hear people laughing in the car." The court heard Dyer suffered "significant" injuries to his legs and hands. Other wounds included one described as "very deep" on his chest. He also had a collapsed lung. Miss Robertson: "At no time, did he say how he came by these injuries." The hearing was told Dyer's life had been in danger had he not been treated in time. He has been left with restricted movement in his hands and left leg. The 4x4 driven during the attack was traced by police. It was found to be a grey Volkswagen Tiguan linked to Steele. He had been captured on CCTV driving it away from a local McDonald's days after the murder bid. The vehicle was discovered at an address in Drumchapel on April 10. Gilhooley's DNA was later traced in the SUV. The advocate depute said the Crown cannot say for definite who wielded what weapon, although Gilhooley stated he had been armed with the baseball bat. Miss Robertson added Gilhooley's guilty plea was accepted on basis that he had been part of a "concerted attack" on Dyer with others. Lady Drummond cut the prison term from 10 years due to the thug admitting to the crime. The judge told him: "I am satisfied having regard to your record, the circumstances of the offence and the (social work) report that an extended sentence is necessary to protect the public from serious harm from you."

Bus driver spared jail after he ran over pensioner had curfew lifted to take son to Legoland
Norman Hamilton avoided a prison sentence for seriously injuring Andrew Milton last March. A bus driver who was spared jail after he ran over a pensioner had his curfew lifted so he can take his son to Legoland. Norman Hamilton, 58, failed to stop for a red light and hit Andrew Milton, 77. The bus motored over his legs and left him bleeding heavily on the ground in Hamilton, Lanarkshire. Dad-of-two Hamilton appeared at Hamilton Sheriff Court and admitted causing serious injury by dangerous driving. Sheriff Colin Dunipace ordered him to carry out 250 hours of unpaid work, banned him from driving for five years and put him on a tag for a year. But he returned to court in a bid to have the order varied and go on holiday with his pharmacist wife and five-year-old son to Legoland and Chessington World of Adventures. Sheriff Dunipace agreed with 'some hesitation' and said he did not want to deny the youngster the trip that had been booked in February. Ronnie Simpson, defending, said: "There is a motion to vary this order for a family holiday. "This was booked in February when there was still a chance it would be a trial and negotiations were still ongoing with the Crown and this holiday was booked while discussions were ongoing, it was not done with any disrespect to the court. "The outlay for the holiday has been fairly significant for the family. It is within the UK and only for seven days and they are going to Legoland and Chessington World of Adventures. "I cannot see any prejudice in allowing the holiday to proceed." Sheriff Dunipace said: "I'm slightly surprised by this given I was considering a custodial sentence in this matter. "He was aware that these proceedings were in the offing and that the court would be looking at a custodial sentence so I just wonder why someone would book a holiday knowing that a custodial sentence may be imposed. "There is a punitive element which has to be considered but with some hesitation and on the basis that it is also his son's holiday then I will allow the variation, I don't want to stop his son going on holiday." The court previously heard Mr Milton was rushed to the Queen Elizabeth University Hospital in Glasgow where medics told him he had suffered 'life-altering' injuries. He was kept in for two months for a number of surgeries on his legs including skin grafts. Hamilton lost his job after the incident of March last year and vowed never to drive a bus again.
