It dismissed a petition by Dinanath Sharma, a retired official of the varsity, who had argued that the university must follow the 2023 UGC regulations, which had revoked APS's authority over key appointments.
The court cited a March 3, 2025 letter from the central govt granting the university permission to function under the UGC (Institutions Deemed to be Universities) Regulations, 2019 until March 31, 2028. This exemption allows APS to retain appointment powers that were otherwise curtailed by the 2023 regulations.
In its May 21 judgment, the court observed that "without considering provisions of the UGC Act, 1956, especially the interplay between Sections 20 and 26 of the said Act, the issues raised in the writ petition cannot be decided."
Respondents' counsel Ajay Veer Pundir noted that with the dismissal of Sharma's appeal, the earlier stay on the central govt's letter had been lifted. He added that the exemption is conditional and if stipulated terms are not met, the university will be required to amend its Memorandum of Association (MoA) to align with the 2023 regulations after the 2027–28 financial year.
The court had initially stayed the letter's operation on May 9, scheduled a hearing for May 16, and on May 20, a two-judge bench disposed of the case and referred it to a single bench, granting Sharma liberty to seek an expedited hearing.
Faculty members expressed concern over the court's decision, fearing that administrative control reverting to APS would invite political interference. "The court verdict will mark the return of the university's bad days," a faculty member said on condition of anonymity, warning that appointments could be influenced by factional interests rather than merit.

Reacting to the verdict, Shrawan Kumar Sharma, a retired English professor of the university, said, "The MoA will have to be amended in accordance with UGC Regulations 2023. Bringing down the university's funding to less than 50% within three years is not feasible. Since that's one of the conditions for the exemption, the university will eventually have to adopt the 2023 regulations."
As of now, the university continues to function without a chancellor and under an officiating vice-chancellor, according to a university official.

In a statement issued from the party's state headquarters, BJP spokesperson Ranjib Kumar Sharma said that a section of political leaders and left-leaning intellectuals appeared to be intentionally creating public confusion using false narratives and misleading information to serve their own political interests. He stated that the so-called citizen transformation movement was merely an extension of this agenda. Sharma alleged that by opposing the government's eviction drives aimed at removing encroachments from government lands, forest areas, and Vaishnavite sattra property, the assembly had effectively extended tacit support to what he described as aggressive land encroachment by 'Miya Muslims,' which, he claimed, pose a grave threat to Assam's social, cultural, economic, and political landscape. The BJP spokesperson also pointed out that no mention was made during the event of the large-scale encroachments that had reportedly taken place during the regimes of former Congress Chief Ministers Hiteswar Saikia and Tarun Gogoi. He cited that, under their administrations, settlers of suspected Bangladeshi origin had illegally occupied over 15,000 bighas of land belonging to more than 900 sattras across the state. Instead of addressing this history, Sharma claimed, the organisers had focused on distorting facts related to recent eviction measures in an attempt to mislead the public. Sharma further commented on remarks made during the event by Raijor Dal president and Sivasagar MLA Akhil Gogoi and Assam Jatiya Parishad president Lurinjyoti Gogoi. He said both leaders had openly expressed willingness to ally with the Congress Party in the upcoming Assembly elections, even if their own parties received a limited share of seats. According to Sharma, such statements reflected a calculated political compromise driven by ambition, rather than ideological conviction. He added that this apparent alignment with the Congress,a party historically associated with 'suppressing' the Assam Movement and the deaths of 855 Assamese youths amounted to a betrayal of the regional and nationalist principles that both leaders had once claimed to uphold. Sharma remarked that the decision to embrace the Congress, which had inflicted long-standing trauma on thousands of Assamese families during the six-year-long agitation, disrespected the sacrifices made during that period and diminished the identity of the Assamese people. The BJP spokesperson also cast doubt on the intentions of the event's key organisers, including Dr Hiren Gohain, Paresh Malakar, and Abdul Mannan. He said these individuals had consistently opposed the Assam Movement and had openly supported the cause of illegal immigration from Bangladesh. Mumbai (Maharashtra) [India], July 6 (ANI): Shiv Sena (UBT) MLA Aaditya Thackeray on Sunday slammed the Bharatiya Janata Party (BJP) for comparing the Pahalgam terror attack to incidents of violence in Maharashtra amid the ongoing language controversy, and said that the ruling party holds 'a lot of poison' in its mind towards the state. He further questioned the ruling BJP in the centre over the delay in arresting the terrorists responsible for the Pahalgam terror attack. 'There is a lot of poison in the BJP's mind when it comes to Maharashtra. Today, the BJP has compared Maharashtra to the terrorists in the Pahalgam incident - the terrorists whom the BJP could not catch or stop. It has been three months since the Pahalgam incident, but where did those terrorists go? Nobody knows if they fled to Pakistan or joined the BJP. But comparing them to Maharashtra shows the malice and poison that the BJP has for the state,' Thackeray told reporters here. Amid the political sparring over Hindi imposition charge by the opposition Maha Vikas Aghadi (MVA) government, Maharashtra Minister Ashish Shelar on Sunday compared the agony of the Pahalgam terror attack, where Hindus were killed in the name of religion, and those getting 'beaten up' in the name of language. He said that these incidents were distressing for him. 'All these incidents cause pain, suffering, and mental distress. In Pahalgam, they shot them after asking about their religion. In another incident, as per a viral video, a group of men allegedly associated with a regional party beat up a shop owner for not speaking in Marathi. The incident occurred in the Mira-Bhayandar area near Mumbai. On Friday, Maharashtra Chief Minister Devendra Fadnavis warned of strict legal action against those engaging in 'hooliganism' in the name of Marathi. He said that the Mahayuti government will not tolerate violence against commoners. Although the Maharashtra government withdrew its April 16 orders on the implementation of the three-language policy that made Hindi a 'mandatory' third language for school students in Classes 1 to 5 studying in English and Marathi medium schools, the political controversy over the same has brought together long-time estranged Thackeray cousins after nearly two decades. Mumbai: Supreme Court Chief Justice of India (CJI) Bhushan Gavai on Sunday visited Chikitsak Samuh High School, Girgaum where he studied from classes 3 to 7, between 1969 and 1973, in Marathi medium. Tired of too many ads? go ad free now The CJI praised his teachers for shaping him, crediting the debating skills he honed there and values of equality and social benevolence inculcated in students for his rise to the topmost post in the Indian judiciary. Walking down memory lane, the CJI shared nostalgic moments. "Mother would give me 20 paise. I would walk towards Mantralaya to catch BEST bus 5 to Gaiwadi and walk some more to school The bus ticket cost 5 paise. In those days, a samosa patti would cost 5 paise with home-made jam, and misal pavcost 10 paise." The school was then surrounded by chawls. "...The chawls are still visible from the school. The Marathi sanskriti is still intact here. This is part of the real 'amchi Mumbai'," he said in Marathi to a gathering of his former batchmates, teachers, and current school students, some of whom, as part of NCC, practised hard to form a band within six months to welcome him. "Of all welcomes I received so far across India and even abroad as CJI, the little children's performance today as a band was the warmest," Justice Gavai gushed. "I was interested in debates. My journey in public speaking began on this stage. Also, PT class by Joshi sir induced the necessary discipline in us as students. On Sunday, local MLA and minister, MP Lodha, who was also present, promised to help with paperwork to install one.
