Soldier hurt on kerosene collection duty in J&K entitled to war injury pension: High court

"Once a working party is detailed for collection of kerosene oil and they proceed on a govt vehicle it would be a part of 'Operation Rakshak'…. Any injury caused to any person, which is of the nature of causing permanent disability or death, would invite war injury pension or war death pension as the case may be," the high court has held.
"Operation Rakshak" is the Army's ongoing counter insurgency and counter terrorism operation in Jammu and Kashmir.
A division bench comprising Justice Sanjeev Prakash Sharma and Justice Meenakshi I Mehta has passed the orders while dismissing a petition filed by the Central govt. In its plea, the Centre had challenged the order dated May 17, 2023, passed by the Chandigarh bench of Armed Forces Tribunal (AFT) in which it had allowed the application filed by former Sepoy B Rama Krishna for claiming the war injury pension. The benefits were allowed to him from 2012 when the incident took place.
The govt contended that the AFT has misinterpreted the rules because the soldier had injuries in a simple accident while he was a member of the working party for collecting kerosene oil and thus, it cannot be said to be a war injury or an injury caused during the operation.
After hearing the plea, the HC observed that it is an admitted position that when the applicant (Sepoy B Rama Krishna) suffered injuries, the operation had been notified in the area and while being a member of the working party detailed for collection of the kerosene oil, the accident occurred, and the Gypsy occupied by him skidded.
"We find that the AFT has correctly interpreted the said provisions and proceeded to grant war injury pension, w.e.f Sept 21, 2012, for life along-with attendant allowance as applicable to the concerned injured soldier," the HC has held while dismissing the Centre's petition. The case was heard on July 1 and a copy of the order released on Thursday.

New Delhi: The disappearance of a 19-year-old Delhi University student, whose last known location was the Signature Bridge, has put the spotlight on the gaps in CCTV coverage of the national capital's streets. Sneha Debnath, a student of Atma Ram Sanatan Dharma College, is from Tripura and moved to Delhi for higher studies. On July 7, she went to drop a friend at the Sarai Rohilla railway station. She has been missing since. Sneha's family members are desperately looking for her and have reached out to authorities for help in finding her. Tripura Chief Minister Manik Saha's office has taken note of the incident and directed the state police to join the search for the 19-year-old. Sneha Debnath is the daughter of an Army veteran, Subedar Major (Honorary Lieutenant) Pritish Debnath (retired), who is currently battling kidney failure and is undergoing dialysis. In a statement, the family has said Sneha told her mother on July 7 that she was going to drop her friend at Saral Rohilla Railway Station for a 6.45 am train. "Her mother's last contact with her was at 5.56 am. When we called again a 8.45 am, her phone was found switched off. We later learned that her friend had not met Sneha that morning. Upon contacting the cab driver, we were horrified to learn that, instead of dropping her at (the) railway station, he had dropped her at Signature Bridge, a known critical spot where not a single CCTV camera is functional, creating a huge blind spot," the family said. The statement added that the National Disaster Response Force scanned the area around Sneha's last known location. "A 7-kilometre radius search was conducted by the NDRF on 9th July based on Crime Branch's request, yet no trace of Sneha has been found. She had carried no belongings, only her phone. Sneha has not withdrawn any cash for 4 months and her small remaining balance has remained unchanged," it said. "What is most heartbreaking is that we still have no answers. A First Information Report (FIR) was filed more than 48 hours after Sneha went missing. We firmly believe that had the CCTV cameras on and around Signature Bridge been functional, we might have known by now what happened to our daughter," the family has said. The Signature Bridge across the Yamuna river connects Wazirabad in north Delhi to the northeastern parts of the national capital. This is not just about Sneha, but about the safety and dignity of every young woman in this city. "A 19-year-old college student vanishes from the national capital, and over 96 hours later, we are still in the dark. We appeal to the public, the media, and the authorities to not let Sneha become just another missing person's statistic," said the statement issued yesterday. "She is our daughter, and she deserves to be found. If anyone has any information, no matter how small, please come forward," it added. Police have registered a kidnapping case based on a complaint by Sneha's family. The Tripura Chief Minister's Office has taken note of the incident. "The report of Miss Sneha Debnath, a resident of Sabroom, who has reportedly gone missing in New Delhi, has come to the notice of the Chief Minister's Office. Following this, necessary instructions have been promptly issued to the police to take immediate and appropriate action," it said in a post on X. Members of Sneha Debnath's family, including her ailing father and mother, have posted videos on social media and have sought help from the public and the authorities in finding their daughter.

Discrimination against SC community remains: Kerala High Court
KOCHI: The Kerala High Court has observed that despite protective provisions for Scheduled Caste communities in the Constitution and laws like the SC and ST (Prevention of Atrocities) Act, discrimination and ostracisation against them have not been fully eradicated. Justice V G Arun said the Scheduled Castes in India have faced systemic ignominy like exclusion, untouchability and violence rooted in centuries-old caste hierarchy. They had restricted access to resources, land and quality education. Still, the discrimination continues. 'One cannot be oblivious of the fact that the tolerance level of persons from vulnerable sections will not be the same as that of those who have not suffered any such ignominy. To put it pithily, only the wearer knows where the shoe pinches,' the court said. The HC made the remarks while dismissing a petition filed by C K Kusuman, former principal of DB College in Kottayam's Keezhoor, seeking to quash the case against him for allegedly making casteist remarks against an assistant professor in 2022. Advocate Thomas J Anakkallunkal, the assistant professor's counsel, said the principal made the comments with the deliberate intention of insulting him by reason of his parentage. The remarks were made during the staff meeting of the college, the counsel said. The court said the question of whether the insulting remark made inside the hall can be perceived as something done within public view can only be decided based on evidence, and the HC cannot conduct a mini-trial or microscopic scrutiny of documents.

Govt will rope in Army officials to expedite irri projects: Uttam
Hyderabad: State Government expedited land acquisition and Relief and Rehabilitation ( R and R ) for all pending and ongoing projects. Two high profile experts from the Army in tunnel engineering would also be appointed to speed up tunnel works in the ongoing project soon. State Irrigation minister N Uttam Kuamr Reddy instructed officials to give top priority to Palamuru Rangareddy and Sitarama sagar and complete the works in a time bound manner. At a review meeting held Saturday, the minister assessed the projects' status across districts, identifying key stumbling blocks. Chronic land acquisition delays, he noted, have become a major drag on timelines and cost estimates. To fix that, he called for proactive engagement with affected landowners and communities. Compensation, rehabilitation, and resettlement, he insisted, must be handled transparently and sensitively. 'If we delay, we risk public backlash and legal trouble that could stall everything,' he warned. Uttam said that Palamuru-Rangareddy and Sitarama Sagar, both are critical to irrigating large, drought-hit regions and asked for top priority to be given to every stage of these works, from canal lining to tunnel boring, with no interruptions. He emphasised the critical role of tunnel works in several key projects, especially in regions where the terrain makes open canals impractical. To boost the department's technical capabilities, the Telangana Irrigation Department is bringing in two high-profile Army officers with deep experience in tunnel construction. General Harpal Singh, the former Engineer-in-Chief of the Indian Army, will come on board as an honorary advisor. Meanwhile, Colonel Parikshit Mehra, a globally recognised expert in tunnel engineering, will be joining the department full-time. Both officers played key roles in the construction of the Rohtang and Zojila tunnels - two of India's most challenging infrastructure undertakings.
