
World court climate ruling: nonbinding but game changing
An advisory opinion like the one issued by the International Court of Justice (ICJ) this week is not binding and so is not directly enforceable, but that does not mean it has no weight.
By saying that all countries were firmly bound to a swathe of legal obligations under existing laws and treaties, experts say the ruling will influence courts, climate negotiations and policy decisions across the world.
The ICJ "couldn't have been clearer" on the binding nature of a range of climate duties, said Cesar Rodriguez-Garavito, Professor of Law and Director of the Climate Law Accelerator at New York University.
He said the ruling, which was responding to questions on countries' climate responsibilities from the U.N. General Assembly, was "as strong as we could have imagined."
"The consensus among the judges is fully behind the conclusion that international law establishes clear and binding obligations for states not to cause massive harm to the environment in general and not to harm the climate system in particular," he said.
These included ensuring national climate plans reflect the highest possible ambition to stay within the Paris agreement's safer global warming cap of 1.5 degrees Celsius above preindustrial times — a level that the world could reach this decade.
If those obligations are not met, the court said states may be obliged to repair damaged infrastructure or ecosystems — and if that is not possible, they could face compensation claims.
This will ripple into future litigation, said Markus Gehring, professor of European and international law at the University of Cambridge.
"We are a far cry from a contentious case between two countries, where someone is demanding liability for past and present climate change damage, but in theory, the court lays out an avenue towards such claims," he said.
Major petrostates like the United States may take little heed of the court's warning that expanding production of oil, gas and coal could constitute an "internationally wrongful act."
But Gehring said countries could choose to ignore ICJ advisory opinions "at their peril."
He cited the court's 2019 advice that the United Kingdom should end its occupation of the Chagos islands.
After Britain initially rejected the ruling, a U.N. General Assembly resolution demanded it cede the islands to Mauritius, which it eventually did in 2024.
Gehring said that while the court's climate decision is not directly binding on individual states, it would be indirectly binding through subsequent domestic or international court action and through U.N. institutions.
The move by U.S. President Donald Trump to withdraw from the Paris deal also would be unlikely to absolve the country from its duties, Gehring added, because the obligation to address climate change is now "crystal clear in international law."
"So even leaving the Paris Agreement and the climate treaty regime does not eliminate those obligations," he said.
ICJ judge Sarah Cleveland said countries' "significant responsibilities" to protect the climate system may also affect interpretation of international investment law.
The ruling was "a decisive legal vindication" for Vanuatu — which spearheaded the push for an ICJ opinion — the country said in a legal analysis of the decision.
The Pacific island nation, which is at risk from rising seas, said the court's conclusions would strengthen its hand in global climate negotiations, helping it demand greater climate ambition and attract financial support for countries suffering climate loss and damage.
It could also open the way for legal action against countries and possibly companies that have by their actions and omissions caused climate harm, the statement said.
"For Vanuatu, the opinion is both shield and sword: a shield affirming its right to survival and a sword compelling the world's major emitters to act in line with science and justice," it added.
Manuel Pulgar-Vidal, former president of the U.N. COP20 climate conference in Peru and now WWF Global Climate and Energy lead, said he expects the ICJ ruling to "move the needle strongly."
"The timing is so fantastic because we are in difficult times in the climate debate, so to have that opinion in the current time, it is showing that we should never lose our hope," he said.

Delayed pricing policy for cleaner ethanol keeps India burning food for fuel
India's push for ethanol, mixing crop-based biofuel with petrol to run vehicles, is being stalled by slow progress in making an environmentally cleaner version of the fuel, producers and experts say. Standing in the way is the government's failure to pay more for cleaner ethanol, which is made from waste but costs more to produce, they say. Second-generation (2G) ethanol, which uses crop waste instead of valuable food crops, offers a way to cut planet-heating emissions, reduce oil imports and avoid making fuel from food needed for human consumption. But producers say the government must pay a separate, appropriate price for the more costly 2G ethanol. "Without a separate pricing policy for 2G ethanol, the economics do not work," said Monish Ahuja, managing director of Punjab Renewable Energy Systems (PRESPL), which supplies farm waste to 2G plants. Investors will not join in unless they see returns that reflect the higher cost of making the biofuel, Ahuja said. "That's the bottleneck," he said. The Indian government wants all petrol sold in the country to contain 20% ethanol by October 2025, and has ramped up ethanol production by diverting food crops like sugarcane, maize and surplus rice to make fuel known as first-generation (1G) ethanol. The 1G production reduces the availability of grains for people and cattle and shifts land away from food production. India allocated a record 5.2 million metric tons of rice for 1G ethanol, nearly 9% of global rice shipments, in the course of a year spanning 2024 and 2025. The 2G ethanol can be made by breaking down tough plant waste like straw or husk into fermentable sugars using newer technology. It also could help curb stubble burning, a key cause of air pollution in India, in which crop remnants are set ablaze post-harvest. So far, 2G ethanol makes up very little — some say less than 1% — of India's annual biofuel production, which the government said topped 7 billion liters in October 2024. The lack of 2G ethanol production is mostly due to a lack of differentiated procurement pricing by the government and higher production costs, experts say. The Indian government does not make specific figures available on its 2G ethanol production. The government has considered a separate rate for 2G ethanol, according to minutes of a high-level committee meeting from July 2023. The price was expected in April 2025, according to reports in Indian media, but no announcement has been made. To promote the newer fuel, the Indian government launched a national program in 2019, with a budget of 1.97 billion Indian rupees ($227.76 million) to provide financial assistance for setting up commercial and demonstration-scale 2G ethanol plants. However, of the 12 plants it set out to establish across India, only one demonstration plant is operational. The Indian ministry responsible for biofuel production did not respond to requests for comment. Among the challenges in scaling up 2G ethanol production are the costly enzymes, pre-treatment of waste and logistics required by the process, said Y.B. Ramakrishna, senior vice-president of the Indian Federation of Green Energy (IFGE). India generates hundreds of millions of metric tons of agricultural waste annually, which could fuel hundreds of 2G biofuel plants, experts say. But the waste needs to be collected, dried, stored and transported from small farms scattered across wide areas, said Ramya Natarajan, a research scientist at the Center for Study of Science, Technology and Policy (CSTEP). The costs can add up, making financial support and pricing clarity for 2G ethanol critical, experts said. "At least for the initial three to four years, a higher price is essential," Ramakrishna said. Without a separate price for 2G and a target for its procurement, even financially ready firms are unable to raise funds from banks or commit to long-term plans, Ahuja said. Unlike 1G ethanol, which has a guaranteed market through oil marketing companies' procurement, the lack of a separate 2G ethanol blending target leaves the greener alternative to compete for customers with the cheaper 1G ethanol. Contained in India's ethanol blending policy of 20% ethanol in petrol by the end of 2025, there is no subtarget for 2G ethanol blending to help guarantee production.

France calls on the EU to pressure Israel to come to the table on Palestinian two-state solution
UNITED NATIONS (AP) -- France on Monday called on the European Union to pressure Israel to agree to a two-state solution with the Palestinians, the latest escalation from the French as they seek an end to the deadly Gaza war days after pledging to recognize Palestine as a state. Jean-Noel Barrot, the French foreign minister, told reporters at the United Nations that while there is international consensus that the time for a political solution to the Israeli-Palestinian conflict is now, world powers need to back up their words with actions. "The European Commission, on behalf of the EU, has to express its expectations and show the means that we can incentivize the Israeli government to hear this appeal," he said. Barrot spoke on the first day of a high-level U.N. meeting on a two-state solution to the decades-old Israeli-Palestinian conflict, which is being co-chaired by France and Saudi Arabia. The conference, which was postponed from June and downgraded to the ministerial level, is taking place in New York as international condemnation of Israel's handling of the war in Gaza reaches a fever pitch. Both Israel and its closest ally, the United States, refused to participate in the meeting, which Barrot said is being attended by representatives of 125 countries, including 50 ministers. The aim of the conference, Barrot said, is "to reverse the trend of what is happening in the region -- mainly the erasure of the two-state solution, which has been for a long time the only solution that can bring peace and security in the region." He urged the European Commission to call on Israel to lift a financial blockade on 2 billion euros he says the Israeli government owes the Palestinian Authority, stop settlement building in the West Bank, which threatens the territorial integrity of a future Palestinian state, and end the "militarized" food delivery system in Gaza by the Israeli-backed U.S. Gaza Humanitarian Foundation, which has resulted in hundreds of killings. Israeli Prime Minister Benjamin Netanyahu has rejected the two-state solution on both nationalistic and security grounds. Ahead of the meeting, French President Emmanuel Macron announced that France would recognize Palestine as a state at the annual gathering of world leaders at the U.N. General Assembly in September. The bold but mostly symbolic move is aimed at adding diplomatic pressure on Israel. France is now the biggest Western power and the only member of the Group of Seven major industrialized nations to recognize the state of Palestine, and the move could pave the way for other countries to do the same. More than 140 countries recognize a Palestinian state, including more than a dozen in Europe. At the conference opening, Palestinian Prime Minister Mohammed Mustafa called for all countries that have not yet recognized Palestine as a state to do so "without delay." "The path to peace begins by recognizing the state of Palestine and preserving it from destruction," he said. The other issue being discussed at the conference is normalization between Israel and the Arab states in the region. Prince Faisal bin Farhan, the Saudi foreign minister, stressed that normalization of relations with Israel "can only come through the establishment of a Palestinian state." U.S. President Donald Trump on Monday called for increasing aid to Palestinians, a rare glimpse of daylight between him and Netanyahu, who has said there is no starvation. Both Barrot and Farhan said Monday that the U.S. is an essential actor in the region and that it was the president in January who secured the only ceasefire in the 21-month war. "I am firmly in the belief that Trump's engagement can be a catalyst for an end to the immediate crisis in Gaza and potentially a resolution of the Palestinian-Israeli conflict in the long term," Farhan said.

Israel announces daily pauses in Gaza fighting as aid airdrops begin

Israel has been facing growing international criticism, which the government rejects, over the humanitarian crisis in Gaza, and indirect ceasefire talks in Doha between Israel and the Palestinian militant group Hamas have broken off with no deal in sight. U.S. President Donald Trump, on a visit to Scotland, said Israel would have to make a decision on its next steps in Gaza, and said he did not know what would happen after the collapse of ceasefire and hostage-release negotiations with Hamas. Military activity will stop daily from 10 a.m. to 8 p.m. (0700-1700 GMT) until further notice in Al-Mawasi, a designated humanitarian area along the coast, in central Deir al-Balah and in Gaza City, to the north. The military said designated secure routes for convoys delivering food and medicine will also be in place between 6 a.m. and 11 p.m. starting from Sunday. The United Nations food aid agency needs quick approvals by Israel for its trucks to move into Gaza if it is to take advantage of Israel's planned humanitarian pauses in fighting, a senior World Food Programme official said on Sunday. United Nations aid chief Tom Fletcher said on Sunday that some movement restrictions appeared to have been eased by Israel in Gaza on Sunday after Israel decided to 'support a one-week scale-up of aid.' Initial reports indicate that more than 100 truckloads of aid were collected from crossings to be transported into Gaza, Fletcher said in a statement. 'This is progress, but vast amounts of aid are needed to stave off famine and a catastrophic health crisis,' he said. In their first airdrop in months, Jordan and the United Arab Emirates parachuted 25 tons of aid into Gaza on Sunday, a Jordanian official said, but added that it was not a substitute for delivery by land. Palestinian health officials in Gaza City said at least 10 people were injured by falling aid boxes. Work on a UAE project to run a new pipeline that will supply water from a desalination facility in neighbouring Egypt to around 600,000 Gazans along the coast would also begin in a few days, the Israeli military said. Dozens of Gazans have died of malnutrition in recent weeks, according to the Gaza Health Ministry in the Hamas-run enclave. The ministry reported six new deaths over the past 24 hours due to malnutrition, bringing the total deaths from malnutrition and hunger since the war began in 2023 to 133, including 87 children. On Saturday, a 5-month-old baby, Zainab Abu Haleeb, died of malnutrition at Nasser Hospital, health workers said. "Three months inside the hospital and this is what I get in return, that she is dead," said her mother, Israa Abu Haleeb, as the baby's father held their daughter's body wrapped in a white shroud. The Egyptian Red Crescent said it was sending more than 100 trucks carrying over 1,200 metric tons of food to southern Gaza on Sunday. Some had been looted in the area of Khan Younis after entering Gaza, residents said. Aid groups said last week there was mass hunger among Gaza's 2.2 million people, and international alarm over the humanitarian situation has increased. A group of 25 states including Britain, France and Canada last week said Israel's denial of aid was unacceptable. "People are happy that large amounts of food aid will come into Gaza," said Tamer Al-Burai, a business owner. "We hope today marks a first step in ending this war that burned everything up." Health officials at Al-Awda and Al-Aqsa Hospitals in central Gaza said Israeli firing killed at least 17 people waiting for aid trucks. Israel's military said it fired warning shots at suspects endangering troops and was unaware of any casualties. Prime Minister Benjamin Netanyahu said Israel would continue to allow the entry of humanitarian supplies whether it is fighting or negotiating a ceasefire and vowed to press on with the campaign until "complete victory". Hamas said Israel was continuing its military offensive. "What is happening isn't a humanitarian truce," said Hamas official Ali Baraka. The war began on October 7, 2023, when Hamas-led fighters stormed southern Israel, killing 1,200 people, mostly civilians, and taking 251 hostages back to Gaza, according to Israeli tallies.
