Abrego Garcia lawyers ask US judge to order return to Maryland amid ongoing criminal case
Lawyers for Salvadorian migrant Kilmar Abrego Garcia filed an emergency motion Thursday asking a federal judge to order their client's return to Maryland, and to block ICE officials from deporting him while his criminal case in Tennessee continues to play out.
In an emergency filing, lawyers for Abrego Garcia urged U.S. District Judge Puala Xinis to order their client's return to the District of Maryland "immediately upon his release from confinement" in the Middle District of Tennessee, and to order the government to refrain from moving him outside the U.S., or the District of Maryland, ahead of his looming criminal trial in Tennessee.
It's the latest move in a months-long legal fight over the status of the wrongfully deported Salvadorian migrant.
In the filing, Abrego Garcia's lawyers clarified they are not seeking to litigate his Tennessee criminal case — a separate matter from the civil case Xinis handled earlier this year, when she ordered Abrego Garcia's return from El Salvador after he was deported in March in what Trump officials called an administrative error.
Abrego Garcia's March deportation kicked off a months-long court fight to secure his release and return to U.S. soil, despite both a federal court order and a Supreme Court ruling requiring the administration to "facilitate" his return. The government eventually complied after months of delay and threats from a federal judge in Maryland to pursue potential contempt proceedings.
Upon return, he was immediately taken into custody for alleged federal crimes stemming from a 2022 traffic stop — prompting a flurry of questions as to when the investigation and impaneling of a grand jury, which indicted him on May 21, 2025, would have taken place.
Lawyers for Abrego Garcia told Xinis Thursday that their motion "simply seeks to ensure that when Abrego Garcia is released from criminal custody, he returns to, and remains in, this District (other than to travel to Tennessee as needed), until further order from this Court."
Their remarks come just days after a federal magistrate judge in Tennessee ordered Abrego Garcia's release pending trial in his criminal case.
U.S. Magistrate Judge Barbara Holmes said in her Sunday order that the government failed to prove its case during an arraignment hearing earlier this month that Abrego Garcia was a "serious risk" of fleeing or obstructing justice if he were to be released pending trial for the criminal charges.
The Trump administration has repeatedly vowed that Abrego Garcia would be taken into ICE detention, should he be released from federal custody — something the new emergency order sought to prevent.
"If this Court does not act swiftly, then the Government is likely to whisk Abrego Garcia away to some place far from Maryland," lawyers told Xinis on Thursday.

L.A. County leaders to weigh legal action following violent ICE arrests
Citing a recent arrest by immigration agents that bloodied a man in the unincorporated area of Valinda, Los Angeles County Supervisor Hilda Solis said she wants the county to explore a legal counterattack against what she described as the federal government's "unconstitutional immigration enforcement practices." "As these immigration raids continue to terrorize our communities, I'm deeply disturbed by the forceful detainment of a man in unincorporated Valinda. This incident raises serious concerns about the conduct and legality of these actions, and demonstrates a violation of constitutional rights and due process," Solis, whose district stretches from Eagle Rock to Pomona, said in a statement. This has had a "tremendous negative impact" on not only the county's economy, but also its "ability to provide for the health and welfare of our residents," according to the motion. The L.A. City Council introduced a similar motion earlier this month seeking to prohibit federal agents from carrying out unconstitutional stops, searches or arrests of city residents. Federal officials have said their agents are defending themselves against increasingly hostile crowds, which in some cases are interfering with arrests. For weeks, social media has been flooded with videos of federal agents, their faces often shrouded by masks, violently arresting bystanders who are filming their actions, dragging a taco stand vendor by her arm and tossing smoke bombs into a crowd of angry onlookers. One widely circulated clip showed a military-style vehicle accompanying federal law enforcement officers during an apparent raid at a home in Compton earlier this month — part of what critics have called an alarming escalation in tactics. Footage reviewed by The Times shows a person in the turret of the vehicle pointing what appears to be a less-lethal projectile launcher downward, but it's unclear whether any shots were fired. Several agents are later seen kneeling on top of the man who is bleeding from an apparent head wound, even as a crowd of onlookers demand that the man be released. Man arrested in connection to fatal Cache 42 shooting
MEMPHIS, Tenn. — A man charged with murder was arrested on Thursday in connection to the Cache 42 shooting that left one person dead and two people injured earlier this month. Jerod Lawson, 24, was charged with three counts of Criminal Attempted First-Degree Murder. On June 8, deputies say they were called to a shooting in the parking lot of Cache 42 in the 4200 Block of Hacks Cross Road around 10 p.m. Two male adults and a 16-year-old were reportedly shot and taken to nearby hospitals. ORIGINAL: Man killed in shooting outside Cache 42, 2 people injured Two of the victims were taken to Germantown Methodist Hospital in non-critical condition. One of the adult male victims was transported to Regional One in critical condition and later pronounced dead. Bullet holes could be found in nearby vehicles and even in the restaurant's window. On June 26, after an extensive investigation, SCSO detectives with the Violent Crime Unit, along with the SWAT team and Fugitive Apprehension Team, executed an arrest warrant in the 6600 block of Whitten View Lane. Lawson is scheduled to appear in court on Friday morning. His bond has not been set. Deputies have not revealed a motive for the killing. Bond set for man charged in deadly Cache 42 shooting
MEMPHIS, Tenn. — The man charged in a deadly triple shooting outside Cache 42 that left two people, including a 16-year-old, injured and a third victim dead, appeared in court Friday morning. The accused, 24-year-old Jerod Lawson, is charged with three counts of attempted first-degree murder and employing a firearm. He is now held in jail on a $500,000 bond. ORIGINAL STORY: Man killed in shooting outside Cache 42, 2 people injured 'Gunfire breaks out between multiple groups in the parking lot,' is how the Shelby County Sheriff's Office described the events that took place outside Cache 42 earlier this month. Court documents say that around 10:30 p.m. on June 7, surveillance video showed multiple suspects running from the business to their cars to grab firearms. While this is happening, deputies say a man, later identified as Jerod Lawson, was seen on camera standing between two groups that were shooting at each other. Court documents say at no point did it appear that anyone was firing at Lawson. However, deputies say that as one group hopped in a car to leave, Lawson allegedly shot at their vehicle multiple times. A passenger in the vehicle, 18-year-old Cornelius Otis, was shot. Otis later died at the hospital. The other two people in the car were not hit. Man arrested in connection to fatal Cache 42 shooting Lawson was later charged and entered a not guilty plea in court on Friday. 'We're not going to worry about the bond. We're going to worry about fighting the case, and once I think more facts come out, I think it'll be better to address the bond at that time,' said Arthur Horne III, Lawson's defense attorney. Due to the nature of the charge, it is unclear if Lawson is accused of firing the shot that killed Otis or if Otis was shot by someone else. Court documents do not say exactly how many people opened fire that night. Amid the chaos, deputies say two other people were also struck by gunfire. 'We just don't want the community to have a rush to judgment against Mr. Lawson. I think all the facts will come out eventually, and we're going to keep working, fighting this case,' Horne said.
