Pensacola police supporting proposed Florida bill criminalizing artificial intelligence generated explicit photos

PENSACOLA, Fla. (WKRG) — Some Florida lawmakers want to close a loophole that allows people to make artificial intelligence generated nude images without consequences.
Current law allows for punishment only for those who distribute those images.

Florida House Bill 757 would make it illegal to create an AI generated explicit photo of a real person without their consent.
Pensacola Police Public Information Officer Mike Wood said this bill could eliminate what he called a 'huge loophole.'
'People that have images out there on the internet of them, it's caused very bad problems in the past especially with teenagers even to the point of suicide in some cases,' Wood said. 'So hopefully this will take care of that problem; it was a huge loophole, and it needs to be filled.'
In November 2024, Pensacola police charged a 17-year-old girl with a felony after she allegedly sent out AI generated nude photos.
However, the 18-year-old boy who created the images was not charged because police said creating the images was legal.
'If the law passes, then it's not only illegal to make them but distribute them as well, which is exactly the way it should be,' Wood said.
According to the bill's text, anyone who 'willfully generates any altered sexual depiction of an identifiable person, without the consent of the identifiable person,' could face a third-degree felony charge if passed.

If approved, the law would take effect Oct. 1.
Anyone found guilty of this third-degree felony could face up to five years in prison and a fine of up to $5,000.

UPDATE (6:30 p.m.): News 5 spoke with a witness to a shooting on Rapier Avenue Tuesday morning. Dennis Weston was working outside on Fry Street when he said he heard six gunshots and a victim cry out. 'I heard some shouting from behind that house over there,' Weston said. 'And somebody was saying 'I was hit in the leg' or something like that. And then I heard, you know, some crying and stuff like that.' When officials arrived on scene, they found two women with gunshot wounds. Both were rushed to nearby hospitals and sustained serious injuries, according to Mobile Police Department. Officials have also said that both women were sitting inside a parked vehicle when the suspect came and fired into it. The victims told officials they knew the person who shot them. The names of the victims and the known suspect have not been released. This is an active investigation. UPDATE (10 a.m.): Mobile Police Department officials have provided more information on a shooting Tuesday morning. According to MPD, two females were shot and transported to local hospitals. GRAND HAVEN, Mich. (WOOD) — A man is heading to prison for a minimum of about eight years for his role in a road rage incident last year near Allendale that killed an uninvolved party. Ethan Luke Oosterhouse, 24, earlier to involuntary manslaughter stemming from the August 2024 crash on Lake Michigan Drive. An Ottawa County judge on Monday sentenced Oosterhouse to between 100 months and 15 years in prison. His driver's license was also forfeited. Court docs: Men admit to 'road rage' in deadly crash The case against his co-defendant, , 43, is pending, with a court appearance scheduled in two weeks. The pair were charged last August with second-degree murder, manslaughter and reckless driving causing death. According to court documents, on June 25, 2024, a Jeep Grand Cherokee driven by Oosterhouse and a Dodge Charger driven by Perez were engaged in aggressive 'road rage style driving' while traveling eastbound on Lake Michigan Drive. A eventually occurred between Perez and Oosterhouse, who are accused of driving well over the posted speed limit. That collision caused Perez's vehicle to hit a car in the westbound lanes near Trillium Drive. The head-on crash killed 27-year-old Sha-Tera Coleman of Grand Rapids. Members of the victim's family addressed the court Monday prior to sentencing. During an earlier hearing, an Ottawa County deputy said both men to engaging in a road rage incident for several miles.
