
NWSL says it has ‘no duty of care' for women suing San Diego Wave over assault claims
The 2024 suit contains allegations of sexual assault of an employee by a co-worker while both employed at the club, along with claims of sexual harassment, racial discrimination, disability discrimination, failure to investigate and prevent harassment and discrimination.
In the answer to the allegations filed on 8 July to the Superior Court of California in San Diego, the NWSL's legal representatives, Los Angeles firm Arentfox Schiff, deny that the six former Wave employees were 'damaged or harmed' because of any act of the league.
The NWSL's lawyers claim 'the doctrine of consent,' inferring that the sexual assault and harassment claims were based on consensual encounters, and also that certain allegations are beyond California's statute of limitations. The NWSL's defense also claims it had no duty of care to San Diego Wave employees as any incidents that occurred were between the individuals and the club – not the league.
According to legal experts interviewed by the Guardian, the NWSL's response to the lawsuit is a catch-all answer that aims to cover all possible angles of defense.
'The defendant has simply listed every affirmative defense that could apply to any of the claims,' said Professor David Oppenheimer, clinical professor of law at the University of California, Berkeley School of Law. 'The common term for such an answer is 'boilerplate.' The purpose is to preserve any conceivable defense.'
An NWSL spokesperson said the league could not comment on pending litigation. Arentfox Schiff did not respond to requests for comment and clarification.
The six women who filed the lawsuit include one who claims she was sexually assaulted by a San Diego Wave co-worker, another who claims she was sexually harassed by the same co-worker, and Brittany Alvarado, a former videographer for the Wave, claiming workplace-related violations. Three other women are named in the suit for similar alleged violations. Alvarado brought attention to the workplace environment at San Diego Wave after she posted on social media in 2024 that the 'NWSL must take immediate action to remove Jill Ellis from both the San Diego Wave and the league entirely.'
Ellis, the former USWNT head coach, was Wave president at the time of the events alleged in the lawsuit and had a hands-on role in managing the club. Ellis has since departed San Diego to take a senior role at Fifa as its chief football officer. Ellis is not a defendant in the lawsuit but is named within it, described as having 'set an abusive and toxic workplace culture' and 'once asking random men in Kansas City about their penises'. (Ellis has filed a separate defamation suit against Alvarado based on her social media post.)
The Guardian previously revealed that a 2024 investigation by the NWSL into San Diego Wave management found that the club's front office 'could have done more' to address a sexual assault allegation but found no specific issue with how the claim was handled because the alleged victim did not use the term 'sexual' when describing her experience. The San Diego Wave is a co-defendant in the case with the NWSL.
As reported by the Guardian, Jane Doe 1 alleges that a night out in San Diego with a co-worker led to 'inappropriate activities including a game of 'Sexy Jenga' that led to him pressuring her into non-consensual sexual acts'. Jane Doe 1 alleges that later at her apartment, while she was drunk, she was pressured into 'sexual activity that she explicitly stated she did not consent to'.
The NWSL's defense argues that consent was given. Under California law, consent requires an individual to freely give agreement to engage in sexual activity 'and voluntarily and have knowledge of the nature of the act or transaction involved.'

Another woman, 'Jane Doe 2', alleged in the lawsuit she was sexually harassed by the same San Diego Wave employee who this time sent her non-work related messages and images via Snapchat that became increasingly sexual in nature. Jane Doe 2 claims she was terminated by the club after she did not work the minimum number of shifts in her non-full-time role – shifts that were assigned by the alleged harasser.
'In a negligence case, consent is a potential defense when the plaintiff has agreed to participate in an activity knowing that there are significant risks of harm, and willing to subject themselves to them,' Oppenheimer said. 'The best examples come from sports, but for the athletes … In this case, for the statutory claims under the civil rights laws, there is no defense of consent.'
Oppenheimer offered a hypothetical scenario for the NWSL to launch a successful defense:
'[The] defendant proves that as each employee was hired they were warned, 'You need to know that this is a toxic workplace. We permit emotional and sexual harassment, we retaliate against people who complain, and we fire people in bad faith. If you don't want to subject yourself to this, don't work here.' That might be enough to defend themselves on the negligent hiring and management claim, but it would subject them to liability on the statutory discrimination claims.'
The defense also claims the case should be dismissed because the plaintiffs delayed bringing the lawsuit and that a two-year statute of limitations under California law should be enforced. The earliest claims made in the case took place in mid-2022. The suit was filed in October of 2024. The NWSL's lawyers cite a section of California code of civil procedure stipulating that there is a two-year statute of limitations to sue for 'An action for assault, battery, or injury to, or for the death of, an individual caused by the wrongful act or neglect of another.' California law stipulates elsewhere that there is a 10-year statute of limitations for criminal sexual assault claims (the NWSL case in question is civil).
The NWSL claims it cannot be held accountable for events described in the lawsuit because they fall outside the relationship between the league and the Wave. The league claims it did not know the incidents occurred nor should it have known.
The former San Diego Wave employees have requested a trial by jury.

'Ketamine Queen' accused of selling Matthew Perry fatal dose gets September trial date
A woman charged with selling Matthew Perry the dose of ketamine that killed him is headed for a September trial. Jasveen Sangha's trial — the only one forthcoming in the death of the 'Friends' star after four other defendants reached plea agreements with prosecutors — is now set to begin Sept. 23 after an order Tuesday from a federal judge in Los Angeles. The 42-year-old Sangha, who prosecutors say was known to her customers as 'The Ketamine Queen,' is charged with five counts of ketamine distribution, including one count of distribution resulting in death. She has pleaded not guilty and has been held in federal custody since her arrest last year. Her trial had been scheduled to start Aug. 19, but the judge postponed it for the fourth time since her April 2024 indictment after both sides agreed it should be moved. Sangha's lawyers said they needed the time to go through the huge amount of evidence they have received from the prosecution and to finish their own investigation. Sangha was one of the two biggest targets in the investigation of Perry's death, along with Dr. Salvador Plasencia, who pleaded guilty to ketamine distribution last month. Perry's personal assistant, his friend and another doctor also entered guilty pleas and are cooperating with prosecutors. All are awaiting sentencing. Perry, who was found dead at age 54 at his home on Oct. 23, 2023, had been getting ketamine from his regular doctor for treatment of depression, an increasingly common off-label use for the surgical anesthetic. But prosecutors say when the doctor wouldn't give Perry as much as he wanted, he illegally sought more from Plasencia, then still more from Sangha, who they say presented herself as "a celebrity drug dealer with high quality goods.' Perry's assistant and friend said in their plea agreements that they acted as middlemen to buy large amounts of ketamine for Perry from Sangha, including 25 vials for $6,000 in cash a few days before his death. Prosecutors allege that included the doses that killed Perry.

America's Most Wanted: Texas senator calls on FBI director Kash Patel to hunt down ‘fleeing' Democrats
Republican Senator John Cornyn is calling on the FBI to track down and arrest Texas Democrats who left the state to derail a vote on new congressional districts explicitly designed to elect more Republicans to Congress. In a letter to FBI Director Kash Patel on Tuesday, Cornyn requested the agency's help to 'locate the out-of-state Texas legislators who are potentially acting in violation of the law.' 'The FBI has tools to aid state law enforcement when parties cross state lines, including to avoid testifying or fleeing a scene of a crime,' he added. Democrats did not break the law by denying the Texas House of Representatives a quorum. Texas House rules allow lawmakers to issue civil arrest warrants to force members back to the capitol, but leaving the chambers is not a criminal offense, and federal law enforcement does not have authority to compel lawmakers to come back to Texas. But Cornyn, echoing claims from Texas Republicans, has accused Texas Democrats of 'potential criminal acts' — including bribery or 'other public corruption offenses' — for allegedly receiving monetary support to leave the state until the end of a 30-day legislative session. The senator's allegations have escalated law enforcement threats against Texas lawmakers who are protesting a GOP plan, requested by Donald Trump, to redraw political boundaries in the hopes of electing five more Texas Republicans into the House of Representatives in next year's midterm elections. Trump on Tuesday claimed he is 'entitled' to those seats. The office of Governor Greg Abbott, who launched the legislative session to explicitly approve the new congressional maps before 2026 midterm elections, said he supports Cornyn's move. Gene Wu said from Illinois on Sunday night after leaving the state with several other Democrats. On Monday, state Republicans voted in favor of their arrest. Republican House Speaker Dustin Burrows said he would immediately sign civil warrants for those missing Democratic members, giving the greenlight to the chamber's sergeant-at-arms and state troopers to make arrests and bring them to the state Capitol. The warrants only apply within state lines, making the legislative threats a largely symbolic maneuver. The House met for roughly five minutes on Tuesday before adjourning. Death row inmates challenge new Arkansas law allowing executions by nitrogen gas
Several Arkansas death row inmates sued the state Tuesday to block a new law allowing executions by nitrogen gas, saying the measure gives prison officials unconstitutionally broad authority to decide how they should die. Ten inmates filed the lawsuit in state court challenging the law signed this year by Republican Gov. Sarah Huckabee Sanders. Supporters have promoted the law as a way to carry out executions for the first time in eight years. Arkansas has 23 people on death row. Arkansas hasn't executed an inmate since 2017, when the state put four men to death before a drug used in its lethal injection process expired. The state has been unable to purchase more lethal injection drugs since because of manufacturers' opposition to their use in executions, the attorney general's office has said. Attorneys for the inmates argue the law violates Arkansas' constitution by giving the Division of Correction authority to decide whether to use lethal injection or nitrogen gas for an execution. The law is also unclear on details surrounding the use of nitrogen gas, the suit says. 'This leaves only questions,' including how the gas would be obtained and how it would be administered, the lawsuit said. Attorney General Tim Griffin said in a statement that his office was aware of the lawsuit and was ready to 'vigorously defend' the new law. Under the nitrogen hypoxia execution method, an inmate is forced to breathe the gas and deprived of the oxygen needed to stay alive. Opponents say the method increases suffering, citing accounts from witnesses to Alabama executions who said inmates gasped and shook during executions. State officials say those are involuntary movements associated with oxygen deprivation. Arkansas is the fifth state to approve nitrogen gas executions. Alabama, the first state to use nitrogen gas, has carried out five executions using the method since it began last year. Louisiana staged its first in March, putting to death a man convicted of killing a woman in 1996. Two other states — Mississippi and Oklahoma — have laws allowing the method but have not used it so far. Alabama's law is being challenged in federal court. The Arkansas inmates also argue that the law cannot be applied retroactively to them, since they were sentenced to die by lethal injection. Attorneys for the inmates said the lack of details on how the state would carry out nitrogen executions raises the risk of a "gruesome and torturous execution." 'Arkansas juries explicitly sentenced our clients to execution by lethal injection – not gas – and the General Assembly cannot rewrite those verdicts to impose death by this very different and highly problematic method,' Heather Fraley, an attorney for the inmates, said in a statement. Arkansas' law took effect Tuesday, and Sanders in April said she had no timeline for resuming executions and wasn't in a rush.
