SRC International board responsible for transactions, Najib's lawyer argues
Muhammad Farhan Muhammad Shafee, Najib's lawyer, argued that his client did not have exclusive control over SRC's operations or the handling of funds obtained from the Retirement Fund Inc (KWAP). 'The board executed all relevant transactions and bore responsibility for oversight. If any misappropriation occurred, it was due to the board's own decisions,' he said.
The submission was made during the hearing of SRC's USD1.18 billion civil suit against Najib and former CEO Nik Faisal Ariff Kamil, who remains at large. Muhammad Farhan contended that Najib neither controlled the board's decisions nor owed fiduciary duties as a director.
'Any formal roles or shareholder approval rights he held were part of lawful governance structures and did not make him the 'controlling mind' of SRC in breach of duty,' he said before Judge Datuk Ahmad Fairuz Zainol Abidin.
SRC, under new management, filed the suit in May 2021, alleging Najib breached trust, abused power, and misappropriated funds. The company seeks repayment of RM42 million in losses.
Najib is currently serving a reduced six-year jail term for misappropriating SRC funds. His petition for a royal pardon led to a halved sentence and a reduced fine of RM50 million. The case resumes on Aug 25. - Bernama

Lorry driver killed in predawn crash on NSE
MUAR: A 46-year-old lorry driver was killed in a predawn crash involving two heavy vehicles at Km144 of the North-South Expressway (southbound) early this morning. Initial police findings suggest the lorry had abruptly switched from the left to the right lane, leading a Hino lorry travelling in the same direction from Penang to Johor Baru to crash into its rear. District police chief Assistant Commissioner Raiz Mukhliz Azman Aziz said the Hino lorry driver, 42, attempted to brake but collided with the rear right corner of the Nissan, causing it to veer off to the left side of the highway. "The Nissan driver sustained serious internal injuries and was pronounced dead at the scene. The Hino driver and his 42-year-old passenger escaped unhurt," he said in a statement today. The case is investigated under Section 41(1) of the Road Transport Act 1987, which carries a jail term of up to 10 years and a fine of up to RM50,000 upon conviction. He urged witnesses to contact investigation officer Inspector Khairun Izham Noor Yusry at 013-9121508 or visit the Muar district traffic police station to assist in the probe.

Wan Rosdy: A-GC's acknowledgement confirms royal addendum's validity
KUANTAN: Pahang Menteri Besar Datuk Seri Wan Rosdy Wan Ismail has reiterated his stand that the royal addendum order concerning Datuk Seri Najib Razak is genuine, following the Attorney-General's Chambers (A-GC) acknowledgement of its existence. In a Facebook statement today, Wan Rosdy said the A-GC's stance, whether directly or indirectly, confirms the validity of the royal decree, and reinforces the truth of the affidavit he had submitted to the court earlier. "This further affirms that the affidavit I presented, stating my awareness of the royal addendum, is truthful and not hearsay. "Since the Attorney-General's Chambers has acknowledged the addendum's existence, it is only right that the court proceedings be halted and the decree enforced," he said. Wan Rosdy added that all parties involved, including the A-GC, the judiciary, and the government, must uphold the principle of separation of powers and respect the authority of the Yang di-Pertuan Agong and Malay Rulers, as enshrined in the Federal Constitution. "Personally, and on behalf of the people of Pahang, I pray that Datuk Seri Najib receives the justice outlined in the royal addendum," he said. On Wednesday, senior federal counsel Shamsul Bolhassan informed the court that the A-GC does not dispute the existence of the royal addendum, which allegedly allows Najib to serve the remainder of his prison sentence under house arrest, but is instead challenging the procedure of its submission as new evidence in Najib's ongoing judicial review.
