Business rescue practitioners tell MPs they've turned SAPO around

Eyewitness News28-05-2025
CAPE TOWN - The South African Post Office's business rescue practitioners say they've managed to turn around the ailing entity.
The team of rescue practitioners is now preparing to exit the business rescue process and hand control of the entity back to management after almost three years.
The rescue team briefed Parliament's communications and digital technologies committee on the finalisation of the rescue process, which saw over 4,000 retrenchments and the closure of hundreds of branches.
The business rescue practitioners have previously come under fire from the committee, which said that progress was not evident over the last two years.
The practitioners were also criticised in April for failing to provide the committee with an update in over four months.
But on Wednesday, Fathima Gany, SAPO acting group CEO, presented a positive outlook, saying that they were in the best shape since 2012.
"This resulted in the strengthening of the balance sheet and a positive net asset value of R1 billion at the end of March. This was the first time since 2012 that SAPO had a positive net asset value, so you see the benefits that you gain from a business rescue process."
In terms of the status of the business rescue exit process, the team said they were in discussions with the department and were preparing a court application to terminate the business rescue proceedings.

Eskom faces R1 billion penalty in high-stakes Koeberg steam generator dispute

Eskom has been ordered to pay French company Framatome almost R1 billion by the Western Cape High Court in a contractual dispute over the replacement of steam generators at the Koeberg Power Station. Image: Supplied Power utility Eskom must pay French nuclear power company Framatome nearly R1 billion in a contractual dispute over the replacement of steam generators at the Koeberg Power Station. Eskom hauled the company formerly known as Areva to the Western Cape High Court to challenge adjudicator Peter Ramsden's decisions on the merits and the quantum delivered in December 2022 and March 2023, respectively. The entity's contention was that both decisions were beyond his jurisdiction and failed to apply the rules of natural justice. On the merits, Eskom complained that Ramsden failed to take into account its submissions, issue a reasoned decision and decide the issues that he was required to decide. Video Player is loading. Eskom was also unhappy that the adjudicator accepted the amounts in the company's amended claim without having enquired into the supporting documents or the details of the claim, failed to issue a reasoned decision and/or follow the procedure he laid down by himself. The dispute dates back to 2014 when the parties concluded an agreement to replace the steam generators at Koeberg. In terms of the contract, Framatome work included the supply and installation of two sets of three replacement steam generators, with one set to be installed in each of the reactor buildings at units one and two at Koeberg during their separate planned outages. The work of replacing the steam generators can only be performed during maintenance and refuelling outages when the power station is offline and the outages are planned in advance and around Eskom's operational requirements. Eskom had scheduled the outage dates and planned to replace the steam generators but then twice postponed for a later date. The power utility then informed Framatome that it would not be continuing with the steam generator replacement work during one of the outages. However, the company notified Eskom of an event which required it to notify the power supplier of such an event and that it required compensation after the postponement. This was acknowledged by the project manager. Eskom then unsuccessfully approached the adjudicator, claiming that both decisions were unenforceable as contractual obligations and need not be complied with as he exceeded his powers. It later filed an application for several declarators, which acting Judge Renata Williams dismissed with costs on Thursday. Framatome succeeded in its counter-application and Eskom was ordered to pay the company €35,288,582 (about R729 million) exclusive of value-added tax (VAT) and subject to the price adjustment for inflation pursuant to secondary option clause of the contract. Payment is also pursuant to certain clauses of the contract, interest thereon calculated at the London Interbank Offered Rate applicable at the time for amounts due in other currencies Additionally, Eskom must pay Framatome more than R256.6m exclusive of VAT and subject to the price adjustment for inflation pursuant to secondary option clause of the contract and pursuant to certain clauses including interest. The power utility was also ordered to pay the costs of Framatome's counter application including the costs of the company's France-based attorneys. 'There is no basis to set aside the decisions of the adjudicator which are valid and binding. In terms of the parties' contract Eskom was obliged to comply therewith,' acting Judge Williams ruled. Eskom spokesperson Daphney Mokwena did not respond to requests for comment on Saturday.

START of controversial AARTO traffic fines system 75 days' away

It's been two years since we last discussed AARTO traffic fines in South Africa. For those who are unfamiliar or who have simply forgotten, AARTO traffic fines work on a points-based demerit system. Essentially, instead of motorists only being fined for traffic indiscretions, they will also start to accrue demerit points on their licence. Rack up enough demerits against your name (the maximum is 15) and you'll have your licence suspended for three months. Do this twice and the department will revoke your driver's licence and you will have to reapply from scratch and recomplete the learners' and drivers' tests. Getting the AARTO traffic fines system to work all around the country is a huge IT undertaking, hence the years of delays. Image: File In theory, AARTO traffic fines sound like a good way to reform motorists from repeat offences. And now, the system that's taken nearly a decade to come into action nationwide, has finally been given a start date – Wednesday 1 October 2025. This is according to the Department of Transport Deputy Minister, Mkhuleko Hlengwa. Speaking in Parliament, Hlengwa confirmed that AARTO traffic fines will go live in all 69 major municipalities – including Cape Town and Johannesburg in just 75 days' time, reports TopAuto . Key to the implementation of AARTO traffic fines is municipal readiness. As The South African covered previously, the new centralised AARTO system promises to take money out of the pocket of local municipality law enforcement efforts. The IT system alone, to track and coordinate fine issuance nationwide is a huge undertaking. Moreover, the deputy minister confirmed that there will also be a phased approach to the current rollout. First major metros, then phase 2 and 3, which will commence on 1 February and 1 October 2026 across another 144 municipalities. Excessive speeding, drunk driving and reckless endangerment are the highest accruing AARTO traffic fines. Image: File From 1 October 2025 onwards, motorists should note the new system for challenging AARTO traffic fines. Infringements can be issued to motorists on the side of the road or affixed to the vehicle (parking violations). Likewise, camera-recorded infringements (speeding), can be legally served to the infringer by email. Upon receipt of AARTO traffic fines, an admission of guilt fine is uniformly applied, giving you a 50% discounted rate. The notice will also state the number of penalty points incurred due to the infringement. You then have 32 days in which to do the following: Settle the traffic fine immediately at the discounted rate. Demerit points still apply. Pay the traffic fine in instalments, in which case the discounted rate falls away. Demerit points still apply. You may appeal the violation. Download a form HERE. If you're not the motor vehicle owner/operator (a juristic person), you may nominate another driver for the fine. Download a form HERE. If the AARTO traffic fines are not settled after 64 days, a R200 late fee is added on top of the existing fine. Demerit points still apply. late fee is added on top of the existing fine. Demerit points still apply. Thereafter, if there's still no action, an enforcement order will be issued. And the infringer is blocked from performing any transactions on the NATIS system (vehicle licence renewals, etc). Certain serious infringement may be considered criminal offences, and you can be prosecuted under the Criminal Procedure Act. SARS refunds R10.6 billion to 5.8 million auto assessed SA tax payers

The South African Revenue Service (SARS) has hailed a significant milestone in its digital transformation drive, confirming that 5.8 million taxpayers were issued auto assessments this year – an increase from 5 million in 2024. According to SARS Commissioner Edward Kieswetter, 99.6% of these assessments remained unchanged by taxpayers, underscoring the growing accuracy and public trust in the automated system. So far, R10.6 billion in refunds have been paid to qualifying taxpayers – within 72 hours of assessment. That's an average refund of R1 828. 'Auto assessment has truly been a game changer,' Kieswetter said. 'We are delivering faster, more efficient services that remove the need for in-person visits, making it easier for taxpayers to comply.' SARS auto assessment is a system where SARS pre-fills tax returns using third-party data, such as salary, medical aid, and retirement contributions. For most taxpayers, no action is required, unless they need to add missing information via eFiling or the SARS MobiApp. The auto assessment period ran from 7 to 20 July 2025, ahead of the manual filing season opening on 21 July. SARS also reported a dramatic increase in the use of digital platforms: 10.2 million unique logins to SARS platforms since 4 July 2.1 million digital queries processed 1.1 million handled via the SARS Online Query System (SOQS) 707 000 via WhatsApp 290 000 through the Lwazi Chat Bot 'Ultimately, our aim is to make the best service to be no service at all,' Kieswetter said, reiterating SARS's vision to make tax compliance seamless and digital-first. Auto-assessments : 7–20 July 2025 : 7–20 July 2025 Individual Taxpayers : 21 July – 20 October 2025 : 21 July – 20 October 2025 Provisional Taxpayers and Trusts: 21 July 2025 – 19 January 2026 Most online submissions now receive an assessment outcome in under 5 seconds, supported by AI-driven risk detection tools that help block fraudulent or impermissible refunds. With the growing use of online services, SARS is also warning taxpayers to remain alert for scams. They stressed that SARS will never send clickable links via email or SMS. Phishing attempts should be reported to phishing@ SARS reminded those who owe tax to make payment arrangements promptly to avoid penalties and interest. Only refunds over R100 will be automatically paid into taxpayer accounts. As the 2025 filing season officially begins, SARS is encouraging all taxpayers to use digital channels rather than visiting physical service centres. 'There is no need to queue. Use our digital tools to get assessed and stay compliant,' Kieswetter concluded.
