
‘Anti-competitive practices'; CAT upholds Rs50mn fine on Vanaspati Manufacturers Association
PVMA, an association representing nearly 100 ghee and cooking oil manufacturers across Pakistan, had challenged the CCP's 2011 decision that found it in violation of Sections 3 and 4 of the Competition Act, 2010.
According to the statement, the case originated from an inquiry and subsequent show cause proceedings initiated in April 2011 after CCP observed coordinated price hikes in the edible oil sector.

'The commission concluded that PVMA had used its platform to orchestrate price-fixing arrangements, whereby it negotiated prices with government authorities and advised its members to implement uniform pricing.'
Though PVMA claimed these were mere recommendations, the commission found that such directives were in fact enforced, resulting in reduced price competition.
The CCP also established that PVMA had entered into agreements with oil tanker associations and the National Logistics Cell (NLC) to fix transportation rates.
'These arrangements, in the commission's view, distorted fair competition in the logistics sector and disadvantaged non-member market players. In addition to collusive pricing and logistics agreements, PVMA was found to have abused its dominant position by charging discriminatory fees for the verification of import invoices—a responsibility delegated to it by customs authorities to address under-invoicing concerns,' the statement said.
PVMA charged its own members Rs4 per metric ton for this service, while charging commercial importers Rs10 per metric ton without offering a valid justification.
In its defense, PVMA argued that its members paid a substantial membership fee and annual dues, and that the commercial importers ultimately sold their products to PVMA's member manufacturers.
It further claimed that it lacked the statutory authority to enforce any pricing arrangements and had only acted on government pressure to stabilise prices in response to fluctuating international palm oil rates. However, both the CCP and the Tribunal rejected these justifications.
The tribunal observed that the verification service was delegated to PVMA by customs authorities for all importers, and that distinguishing between members and non-members in charging service fees was unjustified.

The order stated that such discriminatory charges could not be rationalised under the concept of 'objective justification,' especially when the burden of these charges ultimately fell on the members of PVMA.
While the CAT upheld the Rs50 million fine imposed by the CCP, it modified the commission's order by granting PVMA a 15-day period to rectify its discriminatory conduct.
'Should PVMA fail to comply within the stipulated timeframe, an additional penalty of Rs1 million per day of default—originally part of CCP's order—would be reinstated.'
The tribunal emphasised that even non-binding or advisory decisions taken by associations can violate competition law if they lead to a reduction in market competition.

Federal Finance Minister Muhammad Aurangzeb on Monday dismissed criticism surrounding the Federal Board of Revenue's (FBR) enhanced powers, calling it "propaganda" and reaffirming that the new authority was approved lawfully and designed only to counter large-scale sales tax fraud. He clarified that the additional FBR powers apply exclusively to cases involving over Rs50 million in tax evasion not on ordinary businesses. Boosting investor confidence Aurangzeb called for stronger cooperation between local and foreign investors, saying such collaboration is critical to boosting economic recovery and long-term stability. He said that the government had paid $2.3 billion in profits to multinational companies, a move aimed at reinforcing investor trust amid ongoing fiscal reforms. He added that refund issues facing multinational firms would be resolved soon, as part of wider efforts to improve Pakistan's business environment. In a bid to deepen engagement, the senior leadership of the Overseas Investors Chamber of Commerce and Industry (OICCI) has been invited to Islamabad for a meeting with Prime Minister Shehbaz Sharif. Aurangzeb also said remittance volumes were commendable, and that macroeconomic indicators are expected to show further improvement in the coming days. Commenting on the financial sector, the minister noted that Pakistan's banking industry is consistently supporting the national economy, especially in the wake of recent liquidity and lending shifts. He cited a fresh survey by the OICCI which he said reflects renewed investor confidence and signs of economic stability. Aurangzeb said Pakistan's banking sector must now increase lending to the private sector, as the country moves toward sustainable economic development. The finance minister confirmed he had held a meeting earlier in the day with the Governor of the State Bank and presidents of commercial banks to discuss the financial sector's evolving role. He stated that Pakistan's financial outlook has improved, leading to an increase in bank liquidity, which should now be directed toward boosting private sector credit, particularly for SMEs and agriculture. Aurangzeb added that the Privatisation Commission has been handed 24 state-owned enterprises (SOEs), signalling a fresh push for divestment of loss-making public sector firms, including Pakistan International Airlines (PIA). 'Banks have a critical role to play, especially in privatisation initiatives like PIA,' the minister said, suggesting that financial institutions collaborate with sponsors to revive distressed industries. Shehzad Akbar named key accused in £190m reference case
Listen to article Former Asset Recovery Unit (ARU) chief and ex-special assistant to the prime minister on accountability, Shehzad Akbar, has been identified as a central figure in the ongoing £190 million reference case, according to investigative sources. They alleged that Akbar acted as the mastermind behind an illegal scheme that caused significant financial losses to Pakistan. As part of the investigation, it was revealed that Akbar signed a Deed of Confidentiality on November 6 2019, ahead of the formal approval of the ARU's restructuring and a key cabinet meeting — a move investigators cite as evidence of bad faith. According to the findings, the £190 million — part of a civil settlement with the UK's National Crime Agency (NCA) — was diverted to a "designated account" in the name of the Registrar of the Supreme Court. The amount was originally held in the responsibility account of a major private housing society in Karachi. The agreement was also signed by co-accused Ziaul Mustafa Naseem. Investigators stated the funds were falsely portrayed as being transferred to an official account of the State of Pakistan, while in reality, they were redirected to benefit a private entity. Records show that Akbar travelled to the United Kingdom twice in 2019 — from February 4 to 8 and again from May 22 to 26 — where he reportedly met with the UK Home Secretary and the Director General of the NCA. During these meetings, he allegedly negotiated a secret road map for the repatriation of funds. This, sources argue, led to substantial financial loss to the Supreme Court and diverted nearly £190 million (approximately Rs50 billion) away from the state. Sources further revealed that even before cabinet approval, criminal proceeds were transferred from the UK to Pakistan in late November 2019. The move came following a high-level meeting on March 2, 2019 involving Akbar, then prime minister Imran Khan, and principal secretary Azam Khan. The discussion reportedly focused on a settlement with the NCA and the repatriation of funds. Akbar allegedly overstepped the jurisdiction of the ARU and, in coordination with the then-prime minister, concealed critical facts from the cabinet. Despite presenting the agreement to the cabinet on December 3, 2019, he had already signed the confidential deed on November 6. According to UK authorities, the NCA had frozen around £120 million before December 14, 2018 under the UK Proceeds of Crime Act 2002. The funds were seized based on suspicion against two Pakistani nationals and related investigations into assets, including the prime London property at 1 Hyde Park Place. The ARU had reportedly reached a settlement with the housing society on March 13 and 21, 2019, under application No 8758. The respondents offered an out-of-court settlement with the NCA and their legal representatives. The Supreme Court, in March 2019, imposed heavy fines and conditionally suspended criminal proceedings related to the case. Investigators say Akbar played a pivotal role in misusing authority, acting in bad faith, and concealing corruption-related funds. As a result, legal action continues, with the National Accountability Bureau (NAB) and other authorities conducting inquiries. Akbar has since been declared a proclaimed offender in the case. What is the £190 million case? The case alleges that Imran Khan and others involved adjusted Rs50 billion—equivalent to £190 million at the time—that was transferred by the UK's National Crime Agency (NCA) to the Pakistani government. As PM, Imran Khan obtained cabinet approval for this settlement on December 3, 2019, without disclosing the confidential details of the agreement. The arrangement had stipulated that the funds would be submitted to the Supreme Court. According to NAB officials, Imran and his wife received land worth billions of rupees intended for the construction of an educational institute. NAB filed the reference on December 1, 2023 against eight accused persons including Imran and his wife. The court on January 6, 2024 declared the rest of six accused proclaimed offenders as they did not face the trial and escaped to foreign countries. The prosecution presented 35 witnesses, whom the defence later cross-examined. Key witnesses in the case included PM's former principal secretary Azam Khan, former defence minister Pervez Khattak and former federal minister Zubaida Jalal. Three different judges presided over the case at various stages of the trial while the final investigative officer, Mian Umar Nadeem, was cross-examined after 38 hearings. The accountability court provided the accused 15 opportunities to complete their statements under Section 342. However, no witnesses were presented by the defence.

Transporters raise fares across Pakistan
ISLAMABAD: Following the consistent increase in petrol and diesel prices, transporters across the country have raised fares, adding further burden on the public. Intercity transport fares have seen an increase of up to Rs50-500, while Pakistan Railways within past one month has twice notified an increase in passenger, express trains, and mail trains' fares owing to increase in the diesel prices. Moreover, the Pakistan International Airlines (PIA) has also increased domestic and international fares. According to a notification issued by the Pakistan Railways, a two percent fare increase has taken effect from July 4, for express and passenger trains. The two percent fare hike has also extended to advance bookings as per the notification. The PR on June 18 also increased passenger train fares by three percent, while freight train fares by four percent. The private transporters plying buses between Karachi-Islamabad has increased the fare of normal bus service by Rs400 from Rs6,400 to Rs6,800, business class from Rs8,000 to Rs8,500 and sleeper bus from Rs9,500 to Rs10,000 per passenger. As per the latest fare revisions, the bus operators have increased the bus fare from Lahore to Islamabad from Rs2,000 to Rs2,200 for normal bus service, from Rs2,750 to Rs3,000 for business class and from Rs3,500 to Rs4,000 for sleeper. The bus fare from Islamabad to Mansehra has gone up from Rs900 to Rs1,000, while the fare from Islamabad to Jehlum also went up from Rs1,300 to Rs1,500. Bus and coaster fare from Islamabad to Naran increased from Rs1,500 to Rs1,700. Moreover, local transports including taxi, rickshaws, mini bus, online taxi services and bike riders have also increased the fares in the range of five to 10 percent. A rickshaw charging Rs300 from Faizabad to Raja Bazaar now takes minimum Rs330. Similarly, online taxi charging Rs500 from Zia Masjid area to Blue Area Islamabad now costs Rs600, minibus operators have increased stop to stop fare by Rs3 from Rs35 to Rs38 per passenger. Moreover, motorcycle rickshaw operators have increased stop to stop fare by Rs5 per passenger from Rs35 to Rs40. Passengers have voiced concerns, urging authorities to establish a proper monitoring system at bus terminals to regulate fare adjustments and ensure that the public is protected from unfair increases. The secretary of the Regional Transport Authority has stated that strict action is being taken against transporters who impose excessive fare hikes beyond approved limits. The fare from Islamabad to Muzaffarabad, Azad Jammu and Kashmir has been increased by Rs50 from Rs700 to Rs750. Bus fare from Islamabad to Neelum has increased from Rs1,500 to Rs1,750 and from Rawalpindi to Leepa Valley from Rs1,600 to Rs1,800. Sources in PIA, while disclosing the airfares mentioned about significant changes in airfare from Islamabad to various international destinations over the months of May, June, and July, with notable increases following the federal budget announcement in June. According to the data: Fares to Saudi Arabia (e.g., ISB-JED) surged from Rs165,482 in May to Rs163,795 in July, after dipping to Rs115,329 in June — marking a 42 per cent increase post-budget. Similarly, ISB-RUH dropped from Rs117,492 (May) to Rs61,174 (June), then rose to Rs131,266 in July — a 114 per cent spike post-budget. For UAE destinations like ISB-DXB, the fare dropped from Rs131,125 (May) to Rs30,086 (June), before climbing to Rs84,957 (July) an 182 per cent increase over the June rate. ISB-RUH saw a plunge from Rs142,535 (May) to Rs149,336 (June), followed by a rebound to Rs127,547 in July, up by 159 per cent. PIA officials attributed the June dip to off-peak seasonal travel and a temporary fare reduction ahead of the budget announcement. However, post-budget tax adjustments and rising operational costs have driven fares back up in July. The sources maintained that the government introduced a carbon levy on air travel, reportedly at the request of the International Monetary Fund (IMF) as part of broader fiscal and environmental reforms. This levy, aimed at discouraging excessive carbon emissions and boosting non-tax revenue, has also impacted airline ticket prices. Industry insiders say the added burden is being passed on to passengers, particularly affecting routes to the Gulf and Middle East, which see high volumes of travel from Pakistani workers and families. According to a spokesperson of PIA, international and domestic fares have been consistent during Jan-Jun due to macro-economic stability including fuel prices and exchange rate. However, there are natural adjustments in fares upward and downward due to change in demand/seasonality and fare offers from international and Pak-based competitors. Overall, there is no drastic change in fares. The spokesperson added though, airline fuel is not regulated by OGRA, any changes in tax/levies regime do impact cost of fuel, same is adjusted in fares to the levels at which fares are easily absorbed in market. Since it is a recent development, an absolute outcome cannot be determined at this stage including change in pricing strategy and profitability, the PIA official maintained.
