
Why ‘review committee' was not being questioned in telephone tapping case, Prabhakar Rao's counsel asks in High Court
Presenting contentions for Mr. Rao (who is in USA and sought protection from arrest in the telephone tapping case) before Justice J. Sreenivas Rao, the senior counsel said the 'review committee' comprising Chief Secretary and two other officials of the rank of Secretaries should give consent to tap a person's phone. Mr. Rao was an officer of only the rank of Inspector General of Police. The police were only targeting Mr. Rao, who was a cancer patient, but did not question or record statements of any member of the review committee, the counsel said.
He said that none of the members of the review committee were made an accused in the case though they played a crucial role and had the power to check illegal tapping of phones or eavesdropping on phone calls of others. 'He was made an accused not because he was the mastermind, but because police wanted someone to be held accountable,' the senior lawyer said.
Referring to allegations that Mr. Rao destroyed hard discs containing telephone tapping and other crucial data while operating from the Special Intelligence Branch office, he contended that the same review committee was empowered to take a final call on destruction of such data. It was for the review committee to decide whether to destroy the data and Mr. Rao being an officer of the rank of IGP had no role to play, Mr. Niranjan Reddy argued.
There was not an iota of evidence to connect Mr. Rao with the destruction of data and evidence relating to tapping of telephones from SIB office. Barring the statements of some officers who maintained that Mr. Rao directed them to erase the evidence, there was no clinching material to prove the allegation, the advocate said. He argued that another accused in the case, Sravan, who too initially left the country and eventually returned to India was granted anticipatory bail by the Supreme Court.
When Mr. Rao was ready to cooperate with the police in further investigation of the case and ready to return to India, the police should not oppose his petition to seek protection from arrest, the lawyer said.
Senior counsel of Supreme Court Sidharth Luthra (appearing for Telangana police), opposing contentions of Niranjan Reddy, contended that Mr. Rao blatantly violated the provisions of Indian Telegraph Act by indulging in tapping of telephones for the benefit of politicians in power. He sought to know why Mr. Rao opted for employment in police department in the capacity of Officer on Special Duty when he was suffering from cancer. Health ailment did not come in the way while accepting job after retirement but was being cited as a ground for protection from arrest despite being involved in serious offence of telephone tapping, the senior counsel said.
The judge posted the matter to Tuesday for next hearing.

NEW DELHI: Supreme Court has said that public sector units should not be guided only by commercial interests for making money like a private company but their conduct must be like a model citizen and came down on Gujarat Urja Vikas Nigam Limited (GUVNL) for behaving like "Shylock" and getting into unnecessary litigation on tariff against wind power producers in Gujarat from which it purchases power. A bench of Justices Sanjay Kumar and Satish Chandra Sharma rejected the plea of GUVNL which contended that tariff rate of Rs 3.56 per kWh as mentioned in power purchase agreements (PPAs) was binding on the four power generating companies. The court said govt has been promoting renewable energy to reduce carbon footprint and to make the country energy self-sufficient and less dependent on fossil fuels and GUVNL should be mindful of the policy. The PSU took the stand that these wind energy projects had willingly entered into PPAs with it, binding themselves to the tariff rate of Rs 3.56 per kWh, and were, therefore, not at liberty to seek determination of tariff on a case-to-case basis thereafter, a plea which was rejected by the SC. "GUVNL cannot be guided only by its own commercial interests, like a private business entity and it's conduct, as a state-instrumentality, must be of the standard of a model citizen. However, patently unfair treatment was sought to be meted out by GUVNL to the respondent companies by binding them to a rate that was wholly inapplicable to them. Such conduct, akin to a Shylock, does not reflect positively upon GUVNL," the bench said.

Supreme Court cancels bail granted to Dheeraj Wadhawan in Rs. 34,000 crore bank fraud case
New Delhi, Aug 5 (UNI) In a significant development, the Supreme Court of India today set aside the order passed by High Court of Delhi granting bail on medical grounds to accused Dheeraj Wadhawan in a case involving bank fraud to the tune of Rs. 34,000 crores. During the course of hearing the matter, the apex court constituted a board of Doctors of Sir J.J. Hospital, Mumbai to assess the medical condition of accused Dheeraj Wadhawan. The board examined the medical condition of the accused and submitted its report to Hon'ble Supreme Court. Considering the findings of the report that the accused does not require any immediate medical support/treatment, despite serious contesting by the advocates for the accused, Supreme Court set aside the order of Delhi High Court. Gujarat set to implement Uniform Civil Code, report likely in monsoon session
After Uttarakhand, Gujarat is poised to become the second state in the country to implement a Uniform Civil Code (UCC). A key meeting was held on Tuesday between Gujarat Chief Minister Bhupendra Patel and the UCC Committee, during which the committee's draft report was to sources, the committee has submitted its report during this meeting. Committee chairperson and retired Supreme Court judge Justice Ranjana Desai described the meeting as a formal interaction to discuss the work done so far. She said that the committee has visited every district, interacted with people from all sections of society, and incorporated their feedback into the report on the Uniform Civil Code. She also added that the final report will be officially submitted in the coming days, following which the government will decide on implementation.A spokesperson for the Gujarat government confirmed that the committee had collected public feedback both online and offline and held meetings across communities. The spokesperson said that the discussions focused on those findings on Tuesday. Once the report is officially submitted, the government will decide whether to introduce it in the monsoon is worth noting that the UCC committee was constituted on February 4 by Chief Minister Bhupendra Patel. The five-member panel, led by Justice Ranjana Desai, was initially given a 45-day timeline to submit its report.
