Why ‘review committee' was not being questioned in telephone tapping case, Prabhakar Rao's counsel asks in High Court

The police were targeting telephone tapping case prime accused and retired IPS officer T. Prabhakar Rao instead of questioning the State government's 'review committee' which was aware and accepted the telephone tapping operations, said senior counsel T. Niranjan Reddy.
Presenting contentions for Mr. Rao (who is in USA and sought protection from arrest in the telephone tapping case) before Justice J. Sreenivas Rao, the senior counsel said the 'review committee' comprising Chief Secretary and two other officials of the rank of Secretaries should give consent to tap a person's phone. Mr. Rao was an officer of only the rank of Inspector General of Police. The police were only targeting Mr. Rao, who was a cancer patient, but did not question or record statements of any member of the review committee, the counsel said.
He said that none of the members of the review committee were made an accused in the case though they played a crucial role and had the power to check illegal tapping of phones or eavesdropping on phone calls of others. 'He was made an accused not because he was the mastermind, but because police wanted someone to be held accountable,' the senior lawyer said.
Referring to allegations that Mr. Rao destroyed hard discs containing telephone tapping and other crucial data while operating from the Special Intelligence Branch office, he contended that the same review committee was empowered to take a final call on destruction of such data. It was for the review committee to decide whether to destroy the data and Mr. Rao being an officer of the rank of IGP had no role to play, Mr. Niranjan Reddy argued.
There was not an iota of evidence to connect Mr. Rao with the destruction of data and evidence relating to tapping of telephones from SIB office. Barring the statements of some officers who maintained that Mr. Rao directed them to erase the evidence, there was no clinching material to prove the allegation, the advocate said. He argued that another accused in the case, Sravan, who too initially left the country and eventually returned to India was granted anticipatory bail by the Supreme Court.
When Mr. Rao was ready to cooperate with the police in further investigation of the case and ready to return to India, the police should not oppose his petition to seek protection from arrest, the lawyer said.
Senior counsel of Supreme Court Sidharth Luthra (appearing for Telangana police), opposing contentions of Niranjan Reddy, contended that Mr. Rao blatantly violated the provisions of Indian Telegraph Act by indulging in tapping of telephones for the benefit of politicians in power. He sought to know why Mr. Rao opted for employment in police department in the capacity of Officer on Special Duty when he was suffering from cancer. Health ailment did not come in the way while accepting job after retirement but was being cited as a ground for protection from arrest despite being involved in serious offence of telephone tapping, the senior counsel said.
The judge posted the matter to Tuesday for next hearing.

NEW DELHI: It's been over two weeks since armed assailants shot dead a double murder witness inside his car in southwest Delhi. In the last one year, witnesses in three cases have been killed and several have faced intimidation. With the apex court on Thursday expressing the need to protect witnesses and calling them police's eyes and ears, legal experts said there was a dire need to implement the witness protection programme in spirit. However, sources said that a more robust threat analysis of witnesses needed to be carried out in critical cases and measures taken to secure them. "This is crucial so that important witnesses are not harmed or don't turn hostile in critical cases. Any complaint of witness intimidation should be given high priority given the extent to which Delhi Police 's cases rely on witness statements," said a retired senior cop. Delhi govt notified the new witness protection scheme in April this year. It categorises witnesses into three threat levels-high, moderate and low- and provides tailored protection measures accordingly. "The scheme is financed through a state witness protection fund, which is supported by budgetary allocations, court-imposed costs, donations and CSR contributions. Witnesses or their representatives can file applications for protection with the authority concerned, who will then prepare a threat analysis report and recommend protection measures," an officer explained. The protection orders are implemented by the witness protection cell of Delhi Police or the trial court, while the home department handles identity changes and relocation. The scheme emphasises confidentiality and record preservation, with stakeholders required to maintain strict secrecy and preserve records until legal proceedings conclude. An appeal mechanism allows aggrieved parties to challenge decisions within 15 days, and filing false complaints may result in expense recovery from the witness. Besides strict enforcement of this scheme, retired police officers also highlighted that witness protection was not just about short-term safety but long-term support and monitoring were crucial to ensure the witness's continued safety and well-being. "Psychological support and counselling are crucial to help them cope with the emotional impact of testifying," said a retired senior cop. Delhi Police said it had a dedicated witness protection cell at the district level, headed by an additional DCP rank officer, to implement the scheme and the cell acts on threat analysis reports. In various countries, the police's witness protection plan comprises various measures, including installation of security doors, CCTV cameras, alarms and fencing in witnesses' homes. Their identities are protected by changing their names or alphabets. In cases of grave threats, witnesses and their families are relocated to a safe location too. The US Marshals Service operates the witness security programme, which provides protection and new identities, including social security numbers to witnesses and their families.

A relative of Naved Hussain, who was given the death sentence by a trial court and was acquitted by the high court, said it was a process of law. "We would have been disappointed if the apex court had asked the men to return to jail. That is not the case. We will fight this case legally in Supreme Court and are sure to win it there too," said the relative. Dr Tanvir Ansari, who was termed a conspirator in the case and was acquitted, said, "Chor ko darr lagta hai (A thief feels scared). We are innocent. We are not scared. The high court judgment has covered all the angles. We will see it legally." Ansari had lost his mother while in jail. Sohail Shaikh said, "This stay is not the victory of lies of the ATS. This is a procedure. The ATS should not think it has won. The lies have been going on for the last 19 years." Another acquitted accused said the trial court ignored the torture they had suffered and the fake confessions prepared by the police. He said the high court looked into all aspects, examined all angles and acquitted them. Sajid Ansari, another acquitted accused, said he had faith in Allah and the judiciary. "The lawyers and Jamiat-ul-Ulema are fighting our case. We are sure of winning it at SC," Sajid said. While in prison, he completed seven certificate courses including those on human rights, Arabic language, tourism studies, AIDS and family education, teaching of English, and BA, MA in political science; he has also completed two years of LLB. His mother and two sisters passed away while he was in jail. Another acquitted accused, Muzammil Shaikh, who worked as a database administrator in Bengaluru, said that he lost both parents during his time in jail.

Delhi govt asked its transport and environment departments to study the current guidelines on end-of-life vehicles, enforcement against overaged vehicles and the reaction of the public and stakeholders to the action. Govt will also assess the removal of vehicles so far and the impact of this on air quality levels, officials said on Thursday. One official added, "Govt may then file a review petition on the policy in the Supreme Court based on the findings and reports submitted by the two departments." Environment minister Manjinder Singh Sirsa said, "The environment and transport departments are studying, separately, the guidelines, their impact on the public and the benefits and consequences on ground and air quality levels. Once they complete their studies and submit the report, govt will take further decisions on filing a petition in the court." The departments will also mention the other measures they took in the last five months to curb air pollution in the city and their results, said a govt official. A 2014 order of the National Green Tribunal also prohibits the parking of vehicles aged over 15 years in public places. Following the NGT and Supreme Court's order, in 2021-22, the transport department began de-registering petrol and diesel vehicles that had completed, respectively, 15 years and 10 years of life. Then in 2023, the transport department launched an enforcement drive against these overaged vehicles found parked in public places or running on the roads. However, several vehicle owners moved court, following which govt was asked to come up with proper guidelines to handle ELVs in Delhi. The current govt relaunched the enforcement drive in July and banned provision of fuel to ELVs, both cars, trucks and bikes. However, after facing public heat the drive was halted on grounds of "critical operational and infrastructural challenges". Sirsa also wrote to pollution watchdog Commission for Air Quality Management pleading the city authorities could not accommodate the panel's imposition of the anti-ELV measure. After this, lieutenant governor VK Saxena wrote to CM Rekha Gupta, asking Delhi govt to seek a review petition before the apex court against its 2018 order restricting petrol vehicles beyond 15 years and diesel vehicles beyond 10 years from plying in Delhi-NCR. "How can a vehicle banned as unfit in Delhi run lawfully in other cities? This is against equal treatment," LG queried in the letter. Citing equality and socio-economic reasons, Saxena underlined that such rules should be proportionate, non-arbitrary and not solely based on a rigid age-based classification. He also said that the ban should be put on hold unless it was implemented across NCR. He sought a comprehensive air pollution mitigation plan within three months. Talking on similar lines, Gupta said, "Just as we requested CAQM to review its decision on overage vehicles, we will approach the Supreme Court to give us a detailed overview of our preparation in the fight against pollution, and we will let the court know of public grievances. We will fight for the rights of people.">
