
High court hears DA's case against employment equity amendment in critical examination of transformation
'Leave good enough alone.' This was the Democratic Alliance's (DA) argument in the Gauteng Division of the High Court on Tuesday, 6 May 2025, as the party challenged the constitutionality of the new draft employment equity targets proposed in the recently gazetted Employment Equity Amendment Act.
The courtroom was filled with members of the public, including prominent individuals like DA MP Willie Aucamp and Cosatu Secretary-General Solly Phetoe.
The DA's legal representative, Ismail Jamie, told the court that the previous iteration of the Employment Equity Act struck an appropriate balance between fostering transformation and protecting the rights of undesignated groups in that it was flexible, prohibited quotas, and gave employers the power to set their own targets based on their specific circumstances.
Jamie argued that the amended act violated Section 9 of the Constitution because it 'replaces a nuanced, flexible system with one that is blunt and rigid'.
In April, the Department of Employment and Labour gazetted the amendment act, which introduced five-year numerical targets for the top four occupational levels (junior, middle, senior and top management) across 18 sectors, ranging from finance to manufacturing.
'Rights violated'
While the party's main argument was that Section 15a of the amended act violated the rights of coloureds, Indians and white people, another key argument was that the draft law was tagged incorrectly, therefore making it invalid.
Jamie argued that the amendment bill was passed under Section 75 (which excluded provinces) of the Constitution instead of Section 76 (which governs legislation on a national level). Section 76 governs how bills affecting provinces must be passed, and its focus was to ensure that provincial interests were considered.
The party's representative maintained that if the court found that Section 15A of the amended act was indeed invalid because it had been tagged incorrectly, then a natural consequence of the finding would be that the entire amended act be deemed invalid on a technicality.
The DA also claims that:
Section 15A violates Section 9 of the Constitution by enabling discrimination based on race.
The minister's discretion under Section 15a lacks clear legal standards, contravening the Dawood principle of administrative law.
The implementation of demographic targets disproportionately prejudices coloured and Indian communities in certain provinces, particularly the Western Cape and KwaZulu-Natal.
Exemptions for small businesses and the government's settlement in the Solidarity case suggest an acknowledgement of the potential economic harm of the quotas.
Drama unfolds
While the proceedings were relatively calm, they were unceremoniously interrupted by two unidentified individuals, who said that they were aggrieved parties who deserved to submit to the court.
In a dramatic turn, the men told the judge that they would consider the case a mistrial if the judge refused to hear them, as Parliament had ignored their interests when drafting a law that worked against their interests.
The judge refused to hear them and summarily dismissed the pair.
The case is ongoing with the Department of Employment and Labour's representatives presenting the State's argument. DM

Now that the Budget has finally been approved, GNU partners look ahead
For some parties, the GNU will endure despite tensions, urging focus on service delivery and economic reforms post-Budget approval. 'The GNU will survive, full stop,' said Democratic Alliance (DA) spokesperson Karabo Khakhau after a marathon session on Wednesday to pass the Appropriation Bill, which all Government of National Unity (GNU) parties supported. While the 10-party coalition united in pushing through the important Bill that ensures South Africa does not fall into a fiscal crisis, where to next for the GNU? For some parties, the GNU will survive its teething pains, and for others, now is the time to put aside party politicking in favour of getting the work done. After a protracted process since the firing of the DA's Andrew Whitfield, the deputy minister of trade, industry and competition, and the DA's announcement that it would not support votes for 'corruption-accused' ministers from the African National Congress (ANC), the DA eventually agreed to support the Bill and thus, the Budget. This came after President Cyril Ramaphosa fired Higher Education Minister Dr Nobuhle Nkabane over the unfolding scandal in the Sector Education and Training Authority (Seta) boards. But does this mean the GNU has managed to work out its differences? DA leader John Steenhuisen said, 'To preserve stability within the GNU, it is imperative that the Presidency urgently implements the dispute resolution mechanism outlined in the GNU Statement of Intent. Without it, governance risks being undermined by internal conflict. 'With the Budget now passed, the focus must shift decisively to service delivery and the rapid implementation of critical reforms to unlock economic growth and create jobs. DA-led ministries have already demonstrated measurable success, and we remain committed to delivering with excellence, professionalism, and integrity.' The fights between the two biggest parties in the GNU have often taken centre stage, from the signing into law of contentious legislation such as the Expropriation Act and the Basic Education Laws Amendment Act to Budget issues around the planned VAT increase, and recently, Whitfield's dismissal. Patriotic Alliance leader Gayton McKenzie dismissed the squabbles as 'growing pains'. He told Daily Maverick, 'We are voting together — let me tell you, all families fight.' The controversial minister of sports, arts and culture, whose party is the fourth-biggest in the GNU, said the formation was a 'family' that fought internally, but stood together externally. ANC spokesperson Mahlengi Bhengu said, 'The passing of the Budget is a crucial process in the order of business by the National Legislature. We thank all parties that voted for the Budget.' The Sunday Times has reported that the ANC was looking to reconfigure the GNU. This week, ANC parliamentary chief whip Mdumiseni Ntuli told Daily Maverick that at some point the GNU must be reset or reconfigured, 'but we never really drill it down to the details as to exactly what we mean by a reset or a reconfiguration'. But for other parties in the GNU, there needs to be clarity and re-evaluation. Rise Mzansi's national communications director, Mabine Seabe, said: 'Coalitions are by their very nature unstable, but the GNU can avoid many of the growing pains through maturity, particularly through an understanding that all political parties are equals — the often-peddled notion that smaller parties are in the GNU as a favour smacks of arrogance. We are all elected by constituencies, however big or small.' Seabe said that for this, the Leaders Forum and the Clearing House Mechanism needed to function and meet regularly, 'so that disagreements do not happen through media statements. 'This period has been punctuated by tussles over the Budget; therefore, all parties need to start those discussions earlier and with honesty so that the work of government and the Budget aren't held hostage by differing views.' The Good party's secretary-general, Brett Herron, said: 'Party political manoeuvring in the Government of National Unity is a distraction, defocusing the state from its parallel priorities to grow the economy and meet its constitutional obligations to provide social justice. 'Now that the nation has an approved Budget, the GNU partners must resist the creation of further crises and prioritise the work for which South African taxpayers, regardless of political affiliation, richly reward them.' Economic Freedom Fighters (EFF) leader Julius Malema hosted a press conference on Thursday, 24 July, ahead of the party's 12th anniversary. During the briefing, he addressed a range of political issues, including President Cyril Ramaphosa's recent decision to remove Dr Nobuhle Nkabane from her position as Minister of Higher Education and Training. Malema, who has been a prominent figure in politics from a young age, shared some advice for Nkabane in the wake of her dismissal. The Red Berets leader believes that with just three changes, the former minister can make a comeback. 'It's so painful. She's so young, she still has a chance to come back. I've seen people get demoted politically, and then they go rework on themselves, and then they come back,' said Malema. The politician offered some constructive advice. 'The first thing she must do is to stop chewing gum in a meeting. She was still doing it even yesterday, there in parliament. The second thing is she must be humble and know that she doesn't know and be prepared to be guided and be advised by proper people,' said the EFF leader. Finally, Malema said Nkabane must go back to her branch and learn, saying she was not ready to be a minister. In an interview with eNCA , Nkabane said she accepted her removal and viewed it in a positive light. Ramaphosa dismissed Nkabane in terms of Section 91(2) of the Constitution of the Republic of South Africa. He has since appointed Buti Kgwaridi Manamela as Minister of Higher Education and Training.
