Since the suspects in the deadly Grapevine Lake jet ski crash were confirmed to be in the country illegally, federal immigration officials are now involved in the investigation.
The investigation into the watercraft death of Ava Moore is ongoing, according to investigators. The current criminal charges for Daikerlyn Gonzalez and Maikel Perozo do not reflect capital murder.
Contrasting statements from authorities on the severity of charges and immigration proceedings highlight the complex legal and immigration issues surrounding the case.
What we know about the legal hierarchy in the Grapevine Lake jet ski crash:
Texas Gov. Greg Abbott revved up criminal responsibility in the death of Moore. He posted on social media, "Welcome to Texas. Here's your death penalty."
CBS News Texas pressed Abbott for clarity because the suspects' charges and the facts, as written by investigators, have not reflected a capital crime.
In response to the inquiry, Abbott's press office shared the following statement:
"The State of Texas has no tolerance for heinous criminals who kill Texans. The victim's family deserves swift justice, and the criminal illegal immigrants should be prosecuted to the fullest extent of the law. All Texans deserve protection from unchecked criminal activity."
Moore was killed, according to the Grapevine Police Department and Texas Game Wardens, on May 25. Investigators said Daikerlyn Gonzalez and a passenger, who does not face criminal charges, were riding on a jet ski. Witnesses, police said, told them Gonzalez was speeding and driving recklessly. Investigators said she hit a kayak with Moore in it.
Police said Perozo helped Gonzalez flee the area, allegedly crashing into two vehicles to escape.
A joint investigation led to the arrests of the two Venezuelan nationals, who were in the country unlawfully. Gonzalez faces a charge of manslaughter. Perozo faces charges of collision involving a vehicle and hindering an arrest.
Dallas ICE agents said the two had been in the country illegally since 2023. They were caught and released, according to ICE's leader in Dallas.
"They were arrested at the time of entry, processed for a notice to appear, and then released on their own recognizance," said Joshua Johnson, the acting field office director for ICE Enforcement and Removal Operations Dallas.
But federal involvement doesn't mean agents have taken over.
Grapevine PD is the lead investigative agency with layers of support from the state and federal government. Nor does it mean the suspects' immigration issues will outweigh what they currently face in state court, especially Gonzalez.
"[When] there sort of like a loophole where folks are charged with serious state crimes, they bond out, get put into immigration custody, and then are whisked away back to their country as a means to avoid the state charges," Daniel Stewart said.
The Carrollton-based immigration attorney spoke with CBS News Texas about what happens next in a high-stakes criminal case involving a felony, a death, immigration, and a joint investigation.
"In my experience, while there are some gaps in communication between the state and federal immigration, typically, especially with charges this serious, that doesn't happen," Johnson said.
ICE said that it has immigration detainers and has initiated removal proceedings for Perozo and Gonzalez, but that does not mean that agents can take over.
ICE's scope is limited to immigration, not manslaughter or other criminal charges. He said the case could provide perspective to an immigration judge eventually.
ICE was open about its stance, which Johnson spoke about in a news conference on Wednesday.
"Once the State of Texas goes through the process and the criminal charges, we'll take custody of them," Johnson said.
A victim's advocate for Grapevine PD read a statement from Ava Moore's family. It snuffed the fire of Abbott's statement with a note of mercy:

Sleazy failed mayoral wannabe Brad Lander earned himself the title of absolute worst politician in New York on Wednesday when he suggested, evidence free, that Mayor Eric Adams was an associate of sexual predator Jeffrey Epstein. The remark came totally out of the blue, with Comptroller Slander — er, Lander — saying Adams' criticism of ICE arrests was a ploy. 'I have heard some people say maybe the mayor is in the Epstein files, and he's just trying to distract,' smirked the ethics-challenged fiscal watchdog. 'I have heard some people say'? Who, Brad? Don't throw the slime if you won't drop the dime. Lander's poo-flinging insinuation that Adams is a pedophile is a new low, even for this morally bankrupt poltroon. Now he disingenuously claims it was just a joke, but that damage is done. In any event, it's unseemly for him to be indulging in blatant electioneering on behalf of Zohran Mamdani's mayoral campaign instead of focusing on his day job — the city's shaky finances — in the hope of winning a spot in a Mamdani administration. FBI confirms it assisted Avon police and ICE with traffic stop arrests on July 22
The Federal Bureau of Investigation confirmed that it provided federal warrants to U.S. Immigration and Customs Enforcement agents and the Avon Police Department, who were conducting arrests of undocumented migrants on July 22. Fox59 first broke the news on July 23 that ICE and Avon police were working together to conduct a "traffic blitz" in Avon, Indiana, approximately three miles from the Marion County border. The "traffic blitz" resulted in the arrests of approximately 20 people after police conducted traffic stops based on traffic violations, registration violations and aggressive driving, according to Fox59. When Avon officers encountered individuals who were "undocumented and/or unlicensed foreign nationals," officers contacted ICE agents to investigate the person, according to a statement Avon Police Chief Sean Stoops provided to Fox59. It's unclear where the people arrested currently are. They did not appear in the Hendricks County jail roster on July 23 or July 24. In an email to the IndyStar, an FBI spokesperson confirmed that the agency had been assisting ICE with operations for several months, and that it provided federal agents with federal warrants "as needed." The spokesperson added that FBI agents did not physically assist in July 22 arrests. IndyStar reached out to the Avon Police Department for comment but did not receive an answer by the time of publication. Neither the Avon Police Department nor the Hendricks County Sheriff's office have sent in a formal application to participate in ICE's 287(g) program, which allows ICE Enforcement and Removal Operations to partner with state and local law enforcement agencies to identify and remove criminal migrants who agree to leave the U.S. In late May, Stephen Miller, a deputy White House chief of staff and architect of Trump's immigration agenda, set a quota for at least 3,000 arrests per day and told ICE leadership to target anyone without legal status. This call to action has led to a significant spike in migrants detained by ICE, according to data collected by the Deportation Data Project, which is a dataset built by journalists, researchers, lawyers, and policymakers using the Freedom of Information Act. The database showcases that in June 2025 the number of non-criminal arrests had surpassed the number of people being arrested with either a criminal conviction or pending charges. Axios Indianapolis recently reported that in June, "23% of the 309 people ICE arrested in the state had no criminal charge," according to Axios. Indiana Governor Mike Braun told Axios that, "If that data is correct, I'd say that should raise eyebrows." "Because I've been clearly on record: the worst first. And there are many of them out there," he said. In June 2025, IndyStar reported on several ICE detainments that had either been captured on file or shared by community leaders. These detainments were a notable contrast to how federal agents had conducted arrests in prior months. Witnesses told IndyStar that some of those arrests started off as traffic stops before the person found themselves detained by federal agents. In July 2025, U.S. Immigration and Customs Enforcement posted on social media that its Indianapolis team had made more than 30 arrests in a 24-hour period, saying that this number was due to the "cooperative agencies across Indiana, including 287(g) partners."
