'No mechanism for victims to remove revenge porn' - Lawyers' group

GEORGE TOWN: Existing laws aimed at protecting people, especially children, from sexual exploitation are insufficient to tackle the rise of revenge and Artificial Intelligence (AI)-generated pornography, said a lawyers' group.
Jasmine Wong, president of the Association of Women Lawyers (AWL), said laws, such as the Sexual Offences Against Children Act and the Penal Code provisions that criminalise child sexual abuse material, focused on punishment after the fact.
She said Malaysia lacked a mechanism for victims to swiftly demand the removal of harmful content, such as the United States' new "Take it Down" Act.
Wong said Malaysia's Online Safety Bill 2024, passed last December and awaiting to be gazetted, expanded the government's regulatory powers over child sexual abuse material and cyberbullying.
"However, it does not address the rapid spread of deepfake or AI-generated sexual abuse content, leaving a critical gap in protection.
"The current laws are reactive and rely heavily on criminal prosecution, which is often slow and emotionally draining for survivors.
"There is no legal right for minors or their guardians to request the immediate takedown of non-consensual explicit images, forcing survivors to endure prolonged trauma and public stigma," she told the New Straits Times.
Earlier this year, a teenager in Johor was arrested for producing and selling deepfake sexual images of his female classmates.
He is being investigated under Section 292 of the Penal Code for distributing obscene material and Section 233 of the Communications and Multimedia Act for sharing offensive content.
Wong said a central takedown platform, possibly under the Malaysian Communications and Multimedia Commission (MCMC), could improve coordination and response times.
She added that social media companies should adopt the best practices in the US' "Take it Down" Act, which sets timelines for content removal or risk penalties under MCMC's licensing regime.
"AI developers must build safeguards to detect and prevent the misuse of AI-generated content, and schools and educators play a vital role in addressing digital abuse promptly and educating students on safe online behaviour.
"Digital literacy campaigns and parental guidance are essential to equip children with the skills and support needed to navigate the online world safely."
AWL vice-president Denise Lim said the "Take it Down" Act has been hailed by advocates and victims' families as a powerful tool to protect dignity and privacy in the digital age.
"Malaysia needs urgent legal reform that reflects the realities of digital sexual abuse, combining punitive measures with proactive protections for victims.
"Effective enforcement, swift takedown procedures, and multi-sector collaboration are key to safeguarding young people in an increasingly online world," she said.
Lim added that as digital sexual abuse evolved, so must laws meant to combat it.

SHAH ALAM: Police have confirmed that nudity occurred during the recent eHati marriage motivation programme. Selangor police chief Datuk Hussein Omar Khan said four facilitators were involved in a "rebirth" ritual during the event where they were naked. "Based on our investigations, participants were charged between RM6,000 and RM9,000 for two separate packages. "Those who paid for the RM9,000 package were granted access to a 'Queens Night' scene where nudity was involved," he told reporters today. He said investigations revealed that participants included professionals and civil servants. "The participants came from all over the country. One of them was traced and caught in Kedah. "Based on our checks, the event was not religious or Islamic in nature but based more on motivation," he said, adding that participants from different religions were also involved as it aimed to help them rediscover happiness. He said these programmes had been conducted in the past but police believed this was the first time the "Queens Night" ritual was performed. "We have gathered various liquid samples from the event for further analysis by the Chemistry Department to identify if they were laced with drugs or prohibited substances. "We have a list of the 50 people, including participants, who attended the event. "To date, we have already recorded statements from 30 of them, including the organisers and facilitators. "Those who have yet to come forward should do so immediately," he said, adding that stern action would be taken, including making arrests. It was reported that eHati International Sdn Bhd founders Diyana Tahir and Rahim Shukor, along with four others, have been remanded for three days. The remand order was issued by magistrate Ameera Mastura Khamis after the four women and two men, aged 26 to 57, were brought before the Shah Alam Magistrate's Court. They are being investigated under Section 509 of the Penal Code for insulting the modesty of a person, Section 294 of the Penal Code for indecent behaviour, and Section 14 of the Minor Offences Act. Lawyer Datuk M. Reza Hassan, who is representing four of the six, including the couple and their child, said he has filed an application to review the decision to allow a three-day remand. Yesterday, it was reported that Diyana and Rahim were detained after giving their statements at the Petaling Jaya police headquarters. The couple have denied allegations of spiked drinks and deviant practices at one of their recent events. They also said they have lodged a police report and a report with the Malaysian Communications and Multimedia Commission over the claims.

READ MORE: The programme's founders were arrested by police Following the allegations, police arrested eHati founders Diyana Tahir and her husband Rahim Shukor yesterday (15 July) under Sections 294 and 509 of the Penal Code pertaining to obscene acts or words in public and insults to modesty respectively. Their arrest was also made under Section 14 of the Minor Offences Act 1955 (Act 336) which pertains to insulting behaviour. The duo's home was also raided by the police after they had given their statements at police headquarters. Diyana and Rahim issued a joint statement denying the allegations In a statement published on Facebook on 15 July, the eHati founders said their programmes are safe spaces for women and denied deviant teachings and alleged 'spiked drinks' at their event in Ideal Convention Centre (IDCC) in Shah Alam last year. They explained that they are certified practitioners in hypnotherapy, and that all of their company programmes follow the ethical standards of local values and cultures. According to their website, eHati's programme modules include sessions on breathwork, Trauma Release Exercise, and hypnotherapy to help participants achieve inner and mental calmness. READ MORE: The controversy was sparked by a Facebook user An individual Masyitah Ashari shared on Facebook about eHati's programme at IDCC last year conducting lewd activities including a female speaker stripping off her bikini and dancing with members of the programme, which led to other participants also stripping down and joining the dance. She also claimed there was a drink called 'Piya' being given to participants, which was allegedly spiked with a hallucinogenic substance to discard inhibitions. Masyitah has been actively criticising eHati and its programmes on Facebook, calling them out for conducting lewd activities and deviant practices that go against the teachings of Islam. The potential corridor, which Baku is keen to secure, would run roughly 32 km (20 miles) through Armenia's southern Syunik province, linking the majority of Azerbaijan to Nakhchivan, an Azerbaijani exclave that borders Baku's ally Turkey. Azerbaijan does not want the corridor to be controlled solely by Armenia due to concerns that Yerevan could revoke access too easily. Asked at a news conference if Armenia had received a specific proposal from Washington regarding the proposed corridor, Pashinyan said: "Yes, we have received proposals from the United States," Armenpress, a state news agency, reported. The transit link is one of several stumbling blocks to a peace deal between Azerbaijan and Armenia, neighbours in the South Caucasus region who have fought a series of wars since the late 1980s and remain arch rivals. The countries said in March they had finalised a draft peace deal, but the timeline for signing it remains uncertain. Pashinyan's comments came days after the U.S. ambassador to Turkey, Tom Barrack, said that Washington has proposed taking over the planned transit corridor. "They're arguing over 32 kilometres of road, but this is no joke. It's been going on for a decade – 32 kilometres of road," Barrack told reporters in New York last Friday, according to a State Department readout. "So what happens is America comes in and says, 'Okay, we'll take it over. Give us the 32 kilometres of road on a hundred-year lease, and you can all share it."
