HC orders probe into 900+ Mhada notices for redvpt by dubbing bldgs dangerous
The HC dubbed such notices and the redevelopment powers invoked by the executive engineers and the Mhada repair board, without any jurisdiction, a "regime of colossal arbitrariness and abuse of powers by such officials in committing bald, brazen and patent acts of illegalities". Observing that a mere stay of the notices — those that Mhada did not withdraw later — was not enough, the court ordered an enquiry by a two-member panel of former HC judge Justice J P Devadhar and retired principal district judge Vilas Dongre to examine all 935 notices issued under Section 79A of the Mhada Act.
This section enables the authority to acquire dangerous cessed buildings and carry out redevelopment when both the owners and tenants' associations fail to do so after the building is declared dilapidated and dangerous.

Section 79A has had a vexed presence. It was introduced in Dec 2022 to enable the redevelopment of a building on the premise that the structure is dangerous. "However, whether a building is dangerous or not cannot be the ipse dixit of the concerned officers...and is required to be decided as stipulated by law," the HC said.
The two-member committee named by the Bombay high court will also examine subsequent actions to withdraw such notices, and the role of the officials and motives, if any, in the issuance of the notices.
Justice Kulkarni, who authored and read out the order in court, said the "committee shall examine the purpose, basis, intention, and the authority of the vice-chairman to issue the SOP dated Dec 5 2024". The SOP creates a parallel machinery and cannot be interpreted by officials to assume power to issue notices, the HC said.
The section was introduced since Mhada said there were over 13,000 old and dilapidated cessed buildings in Mumbai constructed prior to 1940.
Mhada was tasked with their repairs.
The law was also amended to enable owners with 51% consent of tenants to redevelop, but Mhada said despite the repair board declaring buildings "dangerously dilapidated", owners do not come forward to redevelop.
The HC said executive engineers invoke Section 79A by a "visual examination" of a building to declare it dilapidated and proceed to issue notices for redevelopment.
"By issuance of these notices, ultimately what is sought to be achieved, and certainly at the behest of vested interests, is a fait accompli by exploiting the incentives on the redevelopment by such vested interests by misuse of the official machinery of Mhada and the repair board for the benefit of either the landlord or tenants."
The HC stressed, "The issuance of such notices by such officials in the manner as resorted is only to enable and aid the sinister motives, to be achieved at the instance of one party against the other, in the redevelopment of a building without verifying whether it needs to go for redevelopment."
The court posted the matter on Aug 12 and called for a report from the committee in six months.
The court rejected a plea by Mhada lawyer P G Lad for a stay of the order.

High court junks bribery FIR & case against transport official; cites malafide intention
Chhatrapati Sambhajinagar: The Bombay High Court's Aurangabad bench has quashed and set aside an alleged bribery FIR as well as the case pending before a special (anti-corruption) court, against the then regional transport office (RTO) inspector Ravikiran N Bhad in Beed. Tired of too many ads? go ad free now The court held that the complaint and the FIR "appear to have been filed with mala fide intention." The anti-corruption bureau (ACB) unit in Beed registered a case of demand of bribes against Bhad on January 20, 2022, almost four months after a complaint was lodged against him on September 16, 2021, and three months after the ACB unsuccessfully tried to trap Bhad on October 20, 2021. A Beed lawyer, who also works as an agent in the RTO, lodged the complaint stating that on September 15, 2021, Bhad demanded Rs 2,000 for each of the four vehicles the complainant got inspected by him between September 9 and 14, 2021, for the grant of fitness certificates. Bhad, who was suspended for eight months after registration of the alleged bribery case, is presently posted as an RTO inspector in Panvel. He moved the HC through his lawyer V D Salunke for the quashing and setting aside the FIR and the case before the special court. In its order on July 28, the HC bench of Justice Vibha Kankanwadi and Justice Sanjay A Deshmukh found several gaps in the prosecution's case. Like, no demand for bribe could be made out from the audio transcript of the conversation between the complainant and Bhad that was recorded as part of a pre-trap panchanama exercise besides there was an inordinate delay in the registration of FIR. "Everything is in the mouth of the present complainant and not from the applicant. The interesting part is that while recording the transcript, even the gestures have been stated. It was not a video recording and, therefore, how the gestures could have been noted in such panchanama is a question," the bench observed. The HC referred to a statement recorded by Mohd Rehman Mohd Yusuf, a junior clerk in RTO, Beed, to the effect that the complainant was issued the fitness certificates for the four vehicles on Sept 30, 2021. "Now, the question is that if the complainant had received those documents on 30.09.2021 itself, where was the question of any such incident that would take place on 20.10.2021 i.e. on the day on which the trap was arranged, but failed. That means, even the complainant had not disclosed to the concerned officer of Anti-Corruption Bureau that he had already received the fitness certificates in respect of those four vehicles on 30.09.2021 itself," the bench observed.

Killer warned ex-fiancee: ‘Shankar won't see sunset'
Jaipur: Hours before gunning down labour inspector Shankar Lal Balai in cold blood, RAC constable Ajay Katariya called his former fiancée with a chilling message that he was leaving Delhi with 50 cartridges and one mission — to ensure Balai is dead. Police sources told TOI that the fiancée, a woman constable posted in Jaipur, dismissed the threat as just another of Katariya's rants. She did not warn Balai, her distant cousin. She did not know Katariya meant it. After surrendering to police, Katariya, a constable with the 12th Battalion of Rajasthan Armed Constabulary (RAC) in New Delhi, narrated how he went off the radar after his duty shift on Monday. Instead of depositing his service-issued self loading rifle (SLR), he dismantled it, packed it in a bag and boarded a bus to Jaipur. He arrived at Sindhi Camp bus stand early Tuesday, booked an offline cab, and headed straight to Vatika Infotech City township in Bagru, around 47 km from Jaipur, where Balai lived. Near the house, Katariya unzipped the bag inside the cab, assembled the SLR and pointed it at the stunned driver. "Hand over the keys and run," he said. The driver obeyed. He sprinted to the township gate and alerted a guard. The two then began running back toward the villa. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like Villas For Sale in Dubai Might Surprise You Villas in Dubai | Search Ads Get Info Around 6:30am, Balai stepped outside his home with neem twigs in hand, brushing his teeth by the gate. His two children were asleep inside. His wife, Saroj, had stepped out to buy milk from a nearby house. Katariya was waiting. He parked the cab outside the house. As Balai walked out the gate, an argument broke out between the two. Suddenly, Katariya pulled the rifle and aimed at his victim. Balai bolted, trying to escape through an empty plot. He chased Balai for nearly 20 metres, shooting as he ran. Bullets struck Balai in the back, neck and thigh. He collapsed, bleeding on the road — just moments before the guard and driver returned. Hearing the gunshots, they froze about 100 metres away. Local resident Sita Ram Gora recalled how Balai's wife came running, horrified. "She saw him lying in a pool of blood," Gora said.
