'Key state witness in Joshlin Smith trial is an opportunist', says defence

Raquel 'Kelly' Smith's defence attorney on Wednesday accused the state's key witness in her kidnapping and human trafficking trial of being an opportunist who 'only looked out for her own interest'.
Attorney Rinesh Sivnarain told the Western Cape High Court sitting in Saldanha Bay Lourentia 'Renz' Lombaard — once good friends with his client — had used Smith to her advantage.
Lombaard, a former co-accused in the case, became a section 204 witness — a person implicated in a crime but allowed to testify truthfully against other accused in exchange for indemnity from prosecution.
Smith, her boyfriend Jacquin 'Boeta' Appollis and Steveno van Rhyn are accused of being behind the disappearance of six-year-old Joshlin Smith on February 19 2024. They pleaded not guilty.
The court previously heard that of the three accused and Lombaard, Smith was the only one who worked to provide for her family and feed her and Appollis' drug addiction.
Sivnarain said during Lombaard's cross-examination it emerged she often sustained her children by asking Smith for food.
Lombaard, he argued, was an opportunist and only decided to tell the truth seven months after being arrested because she was expecting to be given money by Smith which she had agreed to.
'When Lombaard made these confessions she expected to receive some benefit and therefore only looked out for her own interest,' said Sivnarian.
Lombaard had 'thrown Smith under the bus' to save herself and had many opportunities to come clean about the truth but continued to lie 'even when given her last opportunity'.
Prosecutor Zelda Swanepoel said during her closing arguments on Tuesday that despite discrepancies in Lombaard's evidence, she was a credible witness.
'The most reliable and most important corroboration for Lombaard's testimony is that of [another witness Nico] Coetzee.'
Swanepoel said Coetzee specifically referred to R20,000. Lombaard testified overhearing Smith tell Appollis, ' Hier is die geld wat ek by die sangoma gekry het [here is the money I got from the sangoma]'. Smith answered R20,000 when he asked how much.
The court heard the same amount was mentioned in Appollis' and Van Rhyn's statements.
However, Sivnarain argued that when Coetzee told his employers Tertia and Johan Kruger about the plan Smith had relayed to him, he only mentioned the plan, nothing about Joshlin being taken away.

Cape Town City had been hoping for a last-minute lifeline that might see them reinstated in the Betway Premiership, but those hopes were crushed on Thursday night when the PSL Disciplinary Committee (DC) handed Gallants a R200,000 fine — half suspended — for violating registration rules. That means the MTN8 will go ahead without delay, and the top-flight calendar remains intact, even though the decision leaves many with more questions than answers. City had taken the matter to arbitration through the South African Football Association (SAFA), arguing that Gallants breached league regulations by fielding Mphambaniso in 26 of their 28 league matches last season despite not securing the correct clearance certificate. With that transaction, Mphambaniso effectively became a Leruma United player — and thus should have been cleared anew to feature for Gallants. Instead, Gallants simply carried on with him in their squad, setting the stage for a dispute that could've derailed the entire league kickoff. PSL prosecutor Zola Majavu confirmed on Thursday that Gallants had pleaded guilty to misconduct, acknowledging their failure to follow proper procedure in registering Mphambaniso. 'The PSL finalised a disciplinary matter, in which I had proferred charges of misconduct against Marumo Gallants FC and its player Monde Mphambaniso,' said Majavu. 'The case stems from the registration of Mphambaniso, which was procured by Gallants without the required clearance certificate in accordance with the rules of the league.' Limpopo man sentenced to life in prison more than decade after raping 12-year-old girl

A Limpopo man has been sentenced to life in prison more than a decade after raping a 12-year-old girl in the Bolobedu area near Tzaneen. Nelson Letsoalo, 46, was convicted in the Tzaneen regional court on Thursday after an investigation by the family violence, child protection and sexual offences (FCS) unit. According to provincial police spokesperson Col Malesela Ledwaba the incident happened in 2013 when the minor was visiting her grandmother in Khapamadi Section under Bolobedu policing area. 'The victim went to a shop that was next to the tavern and Letsoalo, who was known by the victim as a cleaner, called her to come inside the tavern,' said Ledwaba. 'The accused forced the victim to lay on the floor and she was raped. Afterwards, Letsoalo threatened the victim with death if she told anyone about it.' The child later disclosed the traumatic incident to her mother in January 2020, which led to an immediate report to local police. Letsoalo was arrested the next day on January 5 2020 at his home in Kgapane and the matter was immediately transferred to Tzaneen FCS. 'The accused made numerous court appearances until he was granted R1,000 bail,' Ledwaba said. Despite the time that had passed, Letsoalo was found guilty of rape of a minor and sentenced to life in prison. Provincial police commissioner Lt-Gen Thembi Hadebe welcomed the court outcome.
