Convicted rapist who harassed three Sunday World journalists gets more jail time

A convicted rapist handed an 11-year sentence last month for harassing three female journalists has been told he will spend an extra ten months in prison.

He pleaded guilty last month to harassing three female journalists in August 2023. At that time, McAnaw was under the suspended portion of a sentence for an aggravated burglary, committed in 2018.

McAnaw received a sentence of eight years and four months, backdated to when he went into custody in 2018, for the aggravated burglary. The final 16 month of this sentence was suspended for 16 years on strict conditions.
McAnaw was released from custody on this sentence in July 2023, several weeks before the harassment of the three journalists took place.

He was before Dublin Circuit Criminal Court today for a hearing in relation to the activation of the suspended portion of the 2023 sentence.
Judge Martin Nolan was told that the application to re-activate the suspended portion of the sentence had been triggered by McAnaw breaching the conditions of the suspension. These were his convictions for the harassment of the three journalists and a separate District Court conviction for a breach of the Sex Offenders' Act.
Rebecca Smith BL, defending McAnaw, said her client was homeless following his release from custody and struggled to access medication he had been on. McAnaw also found it difficult to abide by the conditions imposed, counsel said.
The judge noted he could activate none, all or part of the suspended portion of the 2023 sentence, which would run consecutive to the 11-year sentence imposed on McAnaw last month.
Judge Nolan said McAnaw had committed 'rather serious offences' following his release from custody in 2023, which had already been dealt with by another judge.
Having considered the totality principle, Judge Nolan reactivated 10 months of the 16 months suspended portion of the 2023 sentence and directed it to run consecutively to the 11-year sentence McAnaw is currently serving.
Last month, Judge Pauline Codd handed McAnaw an 11-year sentence for the harassment of Nicola Tallant, Amanda Brunker and Deirdre Reynolds.
The court heard McAnaw repeatedly sent the three women emails and messages of a violent and sexually threatening nature, which escalated to him threatening to put a 'bullet' in one of them. He also referred to himself as an 'IRA Top Boy'.
He also turned up at the offices of the Sunday World on Talbot Street and, when refused entry, he went to a cafe across the road. When gardai approached him there, McAnaw was in the process of writing an email to Ms Tallant.
McAnaw is currently detained in the Central Mental Hospital (CMH). McAnaw does not accept his diagnosis of schizophrenia and has declined to take medication, the court was told.
His previous convictions include rape, kidnapping and for assaults causing actual bodily harm from a court in Northern Ireland.
McAnaw refused to enter a bond before the court last month, which would have suspended the final 12 months of the 11-year sentence imposed.
After imposing the 11-year sentence, Judge Codd ordered that McAnaw should have no contact either directly or indirectly with the women, should not approach them, go within 10 miles of their homes and workplaces or communicate with them for life.

His solicitor, Myra Dinneen, presented a statement of means to the court and legal aid was granted. Conrad Murphy, acting as agent for solicitor Eddie Burke, was told by Judge Carroll that if a statement of means was filed for his client, Christopher Hibbett, aged 44, of Lower Park, Tresillian, Truro, England, an application for legal aid could be adjudicated upon. Solicitor Plunkett Taaffe for Mark Doherty, aged 40, of Waterfoot Avenue, Glasgow, Scotland, said the question of legal aid in relation to his client was still outstanding and said he was also seeking directions from the DPP in relation to the matter of venue. Judge Carroll said that Mr Taaffe was entitled to a response by July 25. Mr Taaffe also represented the fourth man, Ben Sandford, aged 42, of Woodgreen, Drum Road, Keith, Moray, Scotland, on behalf of solicitor Frank Buttimer. Anti-immigration activist Derek Blighe had his appeal against a public order conviction allowed on Tuesday on payment of €500 to the Irish Red Cross. He was convicted originally at Fermoy District Court following his failure to make a €350 contribution to the Irish Refugee Council. In March, when the matter came up at Cork Circuit Appeals Court, his then barrister Alan O'Dwyer said: 'It is purely a religious matter.' He explained Mr Blighe's difficulty was with the position taken by the Irish Refugee Council on the repeal of the 8th amendment to the Irish Constitution in relation to abortion. Judge Helen Boyle adjourned the appeal until Tuesday for the appellant to pay €500 to Nasc, the organisation that advises migrants and refugees on their rights. And Mr O'Dwyer said the appellant would make this contribution. However, when the appeal was mentioned on Tuesday, Mr Blighe, who represented himself in court, said paying this contribution to NASC was against his faith because they had taken the same position on the abortion amendment. Judge Boyle let the matter stand at 11.30am and said she would return to the case later. When the case was called again at about 4pm, Judge Boyle asked Mr Blighe if he had the €500 in court. He said he had. The judge then directed him to hand it over to An Garda Síochána, which he did. Judge Boyle said: 'I am going to direct the sergeant to pay it to the Red Cross and thereafter to allow the appeal.' A woman who kicked a detective in the crotch while he was carrying out a search of her home in Co Donegal has appeared in court. Jana Milaniakova appeared at Letterkenny District Court charged with assaulting the Garda at her home on January 2nd, 2024. Garda Pauline Doherty gave evidence of the arrest, charge and caution of Milaniakova at Letterkenny Courthouse yesterday. Judge Eiteain Cunningham asked if the detective was injured following the assault. Sergeant Doyle said there was "initial discomfort" but that the detective did not suffer any long term issues. The assault charge is Contrary to Section 3 (1) and 3(2) of the Non-Fatal Offences against the Person Act 1997 (as amended by Section 20 of the Criminal Justice (Miscellaneous Provisions Act 2023). Sergeant Doyle added that the Director of Public Prosecutions had decided the incident can be dealt with by way of summary disposal in the District Court. Ms Milaniakova was also charged with the theft of an engagement ring at the Mount Errigal Hotel in Letterkenny on December 29th, 2023. That charge is Contrary to Section 4 of the Criminal Justice (Theft and Fraud Offences) Act 2001 The case was adjourned to November 10th for hearing.
