RM16 million donation to UMNO not linked to breach of trust
UMNO's counsel, Mohamed Shahrul Fazli Kamarulzaman, stated the funds were accepted as donations and used for corporate social responsibility (CSR) initiatives.
'No evidence shows UMNO knew the RM16 million was disbursed due to any breach of duty by former directors in 2019. UMNO was a bona fide recipient, and the funds were spent on CSR activities,' he said during the hearing of a lawsuit filed by SRC International and its subsidiaries against UMNO and Selangor UMNO.
The counsel further argued there was no proof former Prime Minister Datuk Seri Najib Razak, then Advisor Emeritus of SRC, instructed the disbursement. 'The SRC Board held decision-making authority, and Najib's role was official, not as a shadow director,' he added.
SRC's lawyer, Razlan Hadri Zulkifli, countered that no documents justified the transfer. 'UMNO claims it was a political donation but never verified the funds. There's no record explaining why JPSB's cheques were in Najib's possession,' he said.
The plaintiffs seek RM16 million from UMNO and RM3.5 million from Selangor UMNO, alleging wrongful transfers. The hearing resumes Wednesday before Judge Datuk Raja Ahmad Mohzanuddin Shah. - Bernama

Elsewhere, Bersatu information chief Tun Faisal Ismail Aziz warned Malaysians against being overly elated with the RM1.99/litre price tag that was unveiled by PMX as part of his 'extraordinary tribute to Malaysians' package last week. 'Since when has the price of petrol come down? What was announced has not even been implemented yet,' he penned on his Facebook. This is a valid point given even if the RM1.99/litre price tag materialises, not all Malaysians might get to enjoy the six sen/litre discount on grounds that this is part of the fuel subsidy rationalisation exercise that ultimately entails a free float of RON95 (well-to-do motorists may end up having to pay RM2.50-RM2.60/litre). 'With the current fall in world crude oil prices, the fall in the value of the greenback and by using the Rafizi formula, Anwar should have been able to lower the price of RON95 petrol and diesel to RM1.70/litre now instead of end-September,' opined the former press secretary to then communications and multimedia minister Tan Sri Annuar Musa. 'It seems the Turun Anwar rally has had a huge impact on the brains and emotions of PMX, the Madanons, Walanons and most strangely, the UMDAP gang. ‘Umno took RM16mil donation without knowing SRC's affairs'
KUALA LUMPUR: Umno had received RM16mil as a donation and contribution from a subsidiary of SRC International Sdn Bhd 10 years ago without prior knowledge of what transpired in the company, the High Court heard. Lawyer Mohamed Shahrul Fazli Kamarulzaman, who appeared for the party, said in his submission that Umno did not have the requisite knowledge that the RM16mil, received from Jendela Pinggiran Sdn Bhd (JPSB), was a result of a breach of duty or trust by the company's former directors, especially SRC's former chief executive officer Nik Faisal Ariff Kamil. 'Umno was a bona fide recipient of the RM16mil, and the sum was spent and used by Umno for activities and programmes that were CSR (corporate social responsibility) in nature. 'It is unjust to allow for restitution against Umno and Umno will suffer injustice if it is called to repay the amount to the plaintiffs,' Mohamed Shahrul said. He also argued that the claim against Umno was time-barred by the statute of limitation provided under Section 6(1)(a) of the Limitation Act. He said Umno received the RM16mil in April 2015 and the plaintiffs contended that the purported wrongful disbursement of the sum was only discovered by the new management in 2019, but there was no evidence to substantiate the claim. Meanwhile, the plaintiffs' lawyer Razlan Hadri Zulkifli submitted that Umno had not proven its case that the money was used for political reasons as there was no evidence to support the claim. He said evidence before the court had shown that the source of the money was SRC, and that Umno was not entitled to it. In May 2021, SRC and its two subsidiaries – JPSB and Gandingan Mentari Sdn Bhd – filed two separate lawsuits against Umno and Selangor Umno. In the lawsuit against Umno, the plaintiffs are seeking RM16mil, which they claim was wrongfully transferred to the party, asserting that Umno had no basis to receive the funds. The second lawsuit involves a claim for RM3.5mil against Selangor Umno, which is also alleged to have received the funds improperly. The hearing continues before Justice Raja Ahmad Mohzanuddin Shah Raja Mohzan tomorrow.

No documents to justify SRC unit's RM19.5mil transfer to Umno, court told
SRC International's lawyer, Razlan Hadri Zulkifli, told the Kuala Lumpur High Court that Jendela Pinggiran Sdn Bhd's purpose was to 'purely collect money and transfer it out'. KUALA LUMPUR : The High Court heard today that SRC International Sdn Bhd's subsidiary, Jendela Pinggiran Sdn Bhd (JPSB), was a dormant company with only RM500 in its bank account before it received RM43.96 million from its parent company, with no documentation to justify the transfer. SRC International's lawyer, Razlan Hadri Zulkifli, told the court the former directors of JPSB had committed a breach of fiduciary duty following the lack of documents concerning the transfer. 'There were no resolutions, notes, internal memoranda, or even WhatsApp messages … nothing at all related to JPSB. 'JPSB had an opening balance of RM500 in April 2015. That remained the case until July 2015, when SRC International suddenly transferred RM43.96 million into JPSB's bank account. 'Not only were there no documents justifying the amount, obviously there were no documents justifying the RM19.5 million (transferred) to the defendants (Umno),' he said. Razlan was submitting in a suit filed by SRC International and its subsidiaries, JPSB and Gandingan Mentari Sdn Bhd, against the Umno headquarters and its Selangor chapter to recover RM19.5 million in funds, including RM3.5 million transferred to Selangor Umno. He said that after July 2015, JPSB returned to its 'natural state, very quiet, sitting there with a minimal sum of money in its bank account'. Razlan said there had been no documentation because JPSB's purpose was to 'purely collect money and transfer it out'. The plaintiffs claim that the defendants had dishonestly and knowingly received the funds from JPSB. Umno's lawyer, Shahrul Fazli Kamarulzaman, denied the claim, suggesting that JPSB was a special vehicle with a dedicated account to run corporate social responsibility activities, accept funds for CSR, and disburse them to third parties. He said the earlier examination of former JPSB director Suboh Yassin showed that there were documents available pertaining to the company's activities. 'PW-2 (Suboh Yassin) said there are other documents available outside the bundle, possibly with the authorities or in the plaintiff's office,' he said. The hearing before Justice Raja Ahmad Mohzanuddin Shah Raja Mohzan continues on July 30.
