Law firm Venable hit with $10 mln lawsuit by ex-client in FDA fight

For three years, law firm Venable represented a California clinic fighting claims by the U.S. Food and Drug Administration that it was selling unauthorized stem cell therapy treatments.
Now the clinic is suing Venable and one of its lawyers, opens new tab for more than $10 million, arguing that the law firm betrayed its trust and spread false claims about the clinic's medical practices in a different case.
The California Stem Cell Treatment Center asked a California state judge last week to order Venable to pay back all of the fees it has paid, plus another $10 million in compensatory damages.
The clinic said it already paid approximately $500,000 to Venable, and that the firm claims it still owes another $532,000 in unpaid bills.
A spokesperson for Venable and counsel Thomasina Poirot, who was named as a defendant, declined to comment.
A lawyer for the clinic did not immediately respond to a request for comment.
Venable led the clinic's defense team in the FDA case, opens new tab until one of its partners joined rival firm Jones Day in April 2021. Venable remained "intimately, actively involved in all aspects of the case through trial and beyond," the clinic said in its February 13 lawsuit.
U.S. District Judge Jesus Bernal in Riverside, California, held a bench trial in the FDA's case in 2021 and eventually sided with the California clinic, ruling in August 2022 that its stem cell treatments did not fall under the FDA's regulatory purview. By the time the ruling was issued, all of the remaining Venable lawyers representing the clinic had withdrawn from the case.
Meanwhile, the clinic and other defendants were sued for alleged medical malpractice in Washington state court in January 2022. The lawsuit claimed that a patient, Michael Trujillo, died from complications associated with the injection of stem cells into his spine.
Venable and Poirot began representing a defendant in the Trujillo case, a Seattle-based stem cell doctor, without the California clinic's consent and without notifying it first, according to the clinic's lawsuit against Venable.
In that role, Venable and Poirot falsely claimed that the California clinic's techniques contributed to Trujillo's death, damaging the reputations of the clinic and the doctors who run it, the lawsuit said.
The clinic said it received "summary adjudication" in the malpractice case because none of its affiliates actually treated Trujillo. But it said it had to pay $200,000 in legal fees relating to the case, and could spend more if there's an appeal.
The 9th U.S. Circuit Court of Appeals reversed Bernal's decision in the FDA case in September, finding that the clinic's treatment procedure is subject to FDA regulation. Celeste Brecht, a Jones Day partner who represented the clinic both at trial and on appeal, did not immediately respond to a request for comment.
-- In other news, U.S. plaintiffs' lawyers who negotiated a $275 million settlement with Swiss generic drugmaker Sandoz said they will ask a judge to award them up to $91.6 million in fees.
The settlement, filed in federal court in Pennsylvania this week, resolves consumer and other buyers' claims that Sandoz conspired with other pharmaceutical companies to inflate the prices of some drugs.
Sandoz denied any wrongdoing in agreeing to settle. The company said it will cooperate with the plaintiffs as they pursue claims against other drugmakers.

However, Mirror Football understands Trossard mutually agreed to part company with long-standing representative Comhair, who is battling health problems. ‌ The separation was totally amicable even though Comhair had been leading negotiations with Arsenal over a potential contract extension. ‌ Trossard's current deal in north London runs until the summer of 2026 but it's understood Arsenal hold a one-year extension option the club can formally trigger. The 30-year-old wants to stay at Arsenal but so far, talks over fresh terms have stalled and failed to reach a positive conclusion to date. Discussions have been centred around a pay-rise and were not certain to include an extension of the length of Trossard's contract but no agreement has been reached thus far. It's understood suitable offers for Trossard may yet be considered this summer, should they land on the table because there has been no breakthrough between the parties. Arsenal are firm admirers of Real Madrid's Rodrygo and are aware the Brazilian could yet be available this summer for the right price as he has struggled for minutes at the Club World Cup under Xabi Alonso. But in order to facilitate that deal - plus the potential capture of Crystal Palace's Eberechi Eze and a top-class centre-forward - there might yet need to be a notable sale come the end of the window. ‌ Financially, Arsenal remain in good stead and are not currently at risk of breaching PSR regulations but they will need to ratify some departures for the sake of their future financial records if they're to continue spending notable cash. Sources have indicated there is still active Saudi Pro League interest in Trossard, who was the subject of a rejected verbal offer from Al-Ittihad last summer, and there have also been tentative enquiries from Europe, namely Italy and Turkey, in recent weeks. ‌ But at this stage, Arsenal are yet to receive any concrete proposals for the player and he still remains part of Mikel Arteta's plans for the forthcoming campaign. Trossard struck 10 goals and 10 assists in 56 appearances in all competitions last season and his availability and versatility is regarded as a huge asset at the Emirates. Comhair had represented Trossard since he broke into the senior setup at Genk but relations between the pair remain full of respect, according to sources.

OHMS was launched three years ago as a partnership of two and since then has grown from being a subcontractor into a main contractor and a trusted partner with Octopus. 'After years of successful partnerships with utilities and subcontractors alike, we are now in a position where via our utility companies we have available that significant amount of money to invest in solar panel and heat pump products for people who qualify under the criteria for the scheme,' says Tennant. These include those entitled to Child Benefit, Income Support Income Based Jobseekers Allowance, Income Based Employment Support Allowance (ESA), Pension Credit Guarantee Credit and Pension Credit Savings Credit. The company manages domestic and commercial electrical projects, offers landlord certifications, conducts EICR (Electrical Installation Condition Report) assessments and holds MCS (Microgeneration Certification Scheme) certifications for Solar PV, battery storage, Air Source Heat Pump Installations and installs Electric Vehicle Charging Points. 'Basically, the whole aim of the scheme is that we take an existing building and retrospectively bring it up to today's standard and, while doing that, create a carbon saving,' says Tennant. 'The client sees the benefit from the free installation of heat pump and/or panels or high heat retentions through cavity wall installation – whatever it takes to bring the house up to today's standard.' OHMS has grown its team to around 60 people operating from 20 vans and one example of the ECO4 projects undertaken by the company was at Waterside Cottage in the Scottish Borders and consisted of three Energy Efficiency Measures (Solar PV, loft insulation and High Heat Retention Heaters) which enhanced the properties EPC Rating, the valuation of property for landlord and had wider environmental benefits. 'We were able to offer free renewable and fabric measures to ensure inclusiveness and best working practice while striving toward a fully-fledged Net Zero policy,' says Tennant. This is all part of a new narrative in approaching home energy, he adds. 'The UK is committed to reducing its carbon footprint and transitioning to clean energy sources. OHMS Renewables shares this vision and stands at the forefront of the solar energy revolution. 'Our mission is to make Solar PV and other means energy efficiency accessible to everyone, helping the nation move closer to a sustainable, eco-friendly future.' An additional benefit is that investing through ECO4 in solar panels and renewable heating could increase the value of a property and help sell it more quickly when someone decides to move. Lyons, 46, and Monaghan, 43, are being laid to rest by loved-ones in a joint ceremony just over one month after they were gunned down in a Spanish boozer. Hundreds of friends, family and underworld figures are gathering at a crematorium in north Glasgow to show respect to Monaghan and Lyons Jnr - son of Godfather Eddie, 67, and brother of Dubai-based mob boss Steven Lyons, 44. We told how Lyons and Monaghan met their end after watching the Champions League Final in Monaghans, Fuengirola, on Saturday,May 31. In the wake of the killings, associates of the Irish Kinahan cartel leaders gave their support to the families and promised them: "We'll get this sorted." Allies of fugitive kingpin Daniel Kinahan had also told grieving loved ones they intend to pay their respects at the funerals of the executed hoods. "The family have had a few phone calls from them to say, 'Sorry for your loss'.' We told how alleged hitman Michael Riley is to fight extradition. The 44-year-old, of Huyton, Liverpool, appeared last month at Westminster Magistrates Court as part of a bid to have him shipped to Spain. Riley's full extradition hearing will be in October and is expected to last all day. The Lyons gang kingpins were drinking in Monaghans bar when they were gunned down in front of staff and revellers. A hooded assassin was captured on CCTV storming the boozer and shooting both men dead in a targeted double hit. We told how cops in Spain and Scotland gave conflicting information over who is believed to have ordered the slayings. Police Scotland first insisted they had 'no intelligence' to suggest the murders were connected to an ongoing turf war here. However, their Spain counterparts later said the man they want extradited over the killings was 'an internal member of the rival Daniel gang'. That prompted the Scottish force to repeat their insistence there is no Daniel link to the slayings - a position also held by members of Monaghan's family. A relative of the murdered mob boss said last month: 'The one thing people need to know is the Daniels are not behind this.' We told how a captured mobile phone holds the key to proving the alleged assassination is linked to their Daniel gang rivals, sources claim. Cops are understood to have seized the mobile from the alleged hitman suspected of shooting dead the duo. Insiders say it contains data allegedly linking Riley to Daniel hoods who Spanish detectives reckon are behind the massacre. Career criminal Monaghan – who fled Scotland for Spain after a failed attempt on his life in 2017 – was tried but acquitted over the murder of notorious Glasgow hood Kevin 'Gerbil' Carroll at an Asda car park in 2010. In August 2017 he and Lyons Jr, both members of the Lyons Glasgow crime family, were cleared of being involved in a brutal street attack on three men outside the Campsie bar in Bishopbriggs, near Glasgow. The murders happened in the thick of a gang war in Scotland involving associates of caged kingpin Mark Richardson, 38, and his allies in the Daniel clan - the Lyons' arch enemies. Dubai-based hood Ross 'Miami' McGill and a group known as Tamo Junto have been targeting Richardson's associates and Daniel family members. Cops have arrested 50 people in Scotland under Operation Portaledge but McGill remains out of reach in the UAE. Scotland's top cop has warned hoods based abroad who are linked to the chaos 'We are coming for you'. Chief Constable Jo Farrell laid down the gauntlet to crime figures hiding in the glitzy desert bolthole. She said: "We're working closely with the Crown Office and the National Crime Agency (NCA) to see if we can get those people back from those countries.
