The Punjab and Haryana High Court on Monday dismissed an advocate's petition to shift three of her ongoing cases from a particular judge's court, citing 'jurisdictional limitations'. The petition stemmed from the judge's involvement with the Bar Council of Punjab and Haryana (BCPH) during a time when the advocate allegedly faced harassment from its members.
A division bench of Chief Justice Sheel Nagu and Justice Sanjiv Berry ruled that it does not have the power to transfer cases to another bench within the high court or to another high court, adding that the advocate was free to explore other legal options.
The petitioner, a 37-year-old advocate from a Scheduled Caste background, had also asked for an order preventing her future cases from being listed before the same judge.
In her petition, the advocate described being sexually harassed by a district attorney in Gurgaon in 2022. She also stated that BCPH members barred her entry, adding that she had been targeted with false complaints, including one that resulted in a legal notice later quashed by the court. She argued that the judge's earlier association with the BCPH created a conflict of interest and violated the principle that 'nobody can be a judge in their own cause'.
The advocate further stated that a contempt notice issued against her on July 22 was an attempt to pressure her into withdrawing allegations against a senior police officer.
On the question of transferring the cases to another court, Chief Justice Nagu said, 'So far as the prayer of transferring the aforesaid three cases to any other High Court is concerned, the same cannot be granted since this Court is not vested with any such power; the petitioner for this purpose is free to approach the appropriate Forum.'
The judges clarified that under Article 226 of the Constitution, the high court's role is limited to reviewing the actions of the state or its agencies. If the petitioner disagrees with decisions made by a single judge, the appropriate course is to appeal through a letter patent appeal (LPA) or approach the Supreme Court, they said.
The bench noted, 'Pertinently, the jurisdiction under Article 226 of the Constitution of India can be exercised to assess the legality and validity of orders passed by the State or an instrumentality of the State under Article 12 by seeking one of the writs or for performance of any public function. The remedy against an order passed by learned Single Judge in civil or criminal jurisdiction is either by filing an LPA by demonstrating that the Single Bench passed the order overstepping the jurisdictional purviews, or by approaching the Higher Court i.e. the Apex Court.'
'Accordingly, this Court declines interference and leaves it to the petitioner to avail appropriate remedy available under the law,' the bench concluded.

1 2 Chandigarh: The Punjab and Haryana high court on Tuesday asked the District and Sessions Judges across Punjab, Haryana, and the UT Chandigarh to furnish status updates on all pending criminal cases involving sitting and former MPs and MLAs. A division bench comprising Chief Justice Sheel Nagu and Justice Yashvir Singh Rathod passed these orders while hearing an ongoing petition related to the cases pending against sitting and former MPs/MLAs in Punjab, Haryana, and UT Chandigarh. The matter is pending before the high court in a suo motu petition. The high court had taken cognisance of the matter following the directions of the Supreme Court to speed up the trial of cases against such VIPs. When the matter came up for hearing on Tuesday, the high court was informed that a total of 13 cases were pending against MLAs/MPs in the state and the investigation was pending in 11 cases. With regard to the delay, the state counsel informed that there were cases involving a scam of Rs 5,000 crore.

SRINAGAR/JAMMU: The sixth anniversary of Article 370's abrogation drew contrasting responses Tuesday with J&K lieutenant-governor Manoj Sinha asserting the move heralded the 'birth of a new Jammu and Kashmir' and most parties, barring BJP, protesting the 'Black Day'. 'On Aug 5, 2019, dismantling of the terror ecosystem began. The new J&K is one where tears are not shed on deaths of terrorists but tears of common Kashmiris are wiped away,' Sinha said at Srinagar's Sheri Kashmir Convention Centre, handing over 158 job letters to kin of civilians killed by terrorists over the years. The Centre-appointed LG painted a picture of robust security and responsive administration after the abrogation of J&K's special status and statehood as well as the region's conversion into a Union Territory, saying the long wait for justice and healing was over for families of terror victims. 'They (job recipients) have come out to reveal the role of Pakistani terrorists and the terror ecosystem in J&K.' Barely 10km from the convention centre where Sinha spoke, the mood was not as bright as the governing National Conference (NC) and opposition Peoples Democratic Party (PDP) decried the abrogation. While the two parties were not permitted to hold public marches, both held protests in their offices. 'This day is a Black Day for us. There should be a restoration of statehood and democratic rights. Even BJP knows it was not a good decision and that's the reason they keep us locked up on this day,' senior NC functionary Salman Sagar said. PDP president and former CM Mehbooba Mufti, also barred from leading a march, echoed the 'Black Day' condemnation. 'J&K has been turned into a laboratory. They subverted the Constitution here and later started similar experiments in other states. You are now seeing the SIR (voter roll revision) exercise in Bihar. I want to tell the people of India their situation could become worse than ours. No one will come to their aid, just like no one is helping us,' Mehbooba said. Peoples Conference chief and MLA Sajad Gani Lone described 'Aug 5 as a brutal reminder of undermining of democracy, an ugly example of selective targeting'. In Jammu, NC, PDP and Congress workers hit the streets. Congress leaders garlanded a statue of the last J&K Dogra ruler Maharaja Hari Singh. Party workers sported black ribbons and raised slogans against the Centre and BJP for delay in restoration of statehood. 'Today's protest is part of our intensified campaign to seek restoration of pride and glory of this historic Dogra state, which was destroyed by BJP on Aug 5, 2019,' J&K Congress working president Raman Bhalla said. Chief party spokesperson Ravinder Sharma accused BJP of undermining the elected NC govt and running the administration through LG Sinha as 'remote control' . If the opposition staged demonstrations, BJP organised celebrations, hailing Aug 5 as a day of 'collective achievement'. J&K BJP chief Sat Sharma told a gathering in Jammu's Akhnoor the abrogation had brought constitutional unity and equal rights. 'This day led to the welfare of neglected and oppressed communities of J&K,' Sharma said.

Chhatrapati Sambhajinagar: Head constable Suresh Ingle has been dismissed from the police department after being caught for the second time during raids on gambling dens, authorities said. Ingle, who was last posted with the Chhatrapati Sambhajinagar city police headquarters, had three cases registered against him — one for cheating and two for gambling — over his nearly two-decade-long service. According to records, Ingle was first booked on April 14, 2008, for a cheating case at the MIDC Waluj police station. He was subsequently apprehended during a raid on a gambling den within the limits of the Begumpura police station on March 11, 2022. In the latest incident, on June 17, Ingle was caught during a police raid at a gambling den and was named in an FIR at the City Chowk police station under the relevant sections of the Maharashtra Prevention of Gambling Act. Police officers stated that following the earlier cases, Ingle faced departmental actions, including minor punishments and suspension of increments. "What justification can be accepted from a policeman who, not once, but twice, got arrested by police teams raiding gambling dens? It is beyond imagination that a serving policeman is visiting a gambling den to play cards," Pawar added. The commissioner said instructions have been given to prepare a list of police personnel facing criminal cases, their current status, and their postings to review each case based on gravity and merits before making appropriate decisions.
