Grand Western Lodge and Blayney Council's $60,000 footpath battle

The owner of a historic building and a New South Wales council are in a bitter dispute over a footpath, which has already cost ratepayers tens of thousands of dollars, and there is no end in sight.
Retired investment banker Ian Gillings has threatened legal action against Blayney Shire Council in the state's Central West over its plan to fix a dilapidated footpath outside his business in Millthorpe, near Orange.
Mr Gillings purchased the run-down 1901 Grand Western Lodge on Victoria Street at the beginning of the COVID-19 pandemic and spent more than two years renovating the federation-era property into accommodation for miners.
But he is not happy with the state of a bitumen pavement footpath that straddles the state heritage-listed building's wrap-around balcony.
Mr Gillings has likened the footpath to a poorly maintained country road, filled with potholes and water damage.
"The footpath is in dangerous and is in bad repair," he said.
As part of its broader Millthorpe Village Masterplan, the council plans to fix the footpath with asphalt, which Mr Gillings opposes.
He alleges the material would worsen water damage in the building, by allowing water to penetrate the cellar, and is not aesthetically appropriate for the heritage.
"I don't want my building to fall apart," he said.
Instead, he wants to replace it with bluestone, a more porous and durable product that matches the kerbs and guttering in the heritage conservation area.
Mr Gillings has even offered to foot the entire estimated $80,000 bill and sign a 99-year guarantee to cover maintenance and costs associated with it.
"It doesn't work like that from our risk perspective nor our insurance and liability," Blayney Shire Council's general manager Mark Dicker said.
"We need to have a fit-for-purpose product not a Rolls Royce product, particularly when heritage advice doesn't agree with it."
Council's heritage advisor and Heritage NSW have given the green light to its existing plans to replace the asphalt path with like-for-like, in line with rest of the village.
Its independent engineering advice found the proposed renewal works would not change the conditions that have resulted in rising damp in the lodge.
But a report by Calare Civil, hired by Mr Gillings, found the bluestone pavers would be the "best practice approach".
"The permeable pavers along with their dark colouring will promote escape of soil moisture through evaporation as opposed to directing water up the building walls," the report said.
When council said no to Mr Gillings's offer, he commenced legal proceedings in the NSW Land and Environment Court in April.
They have since been discontinued after the council agreed to temporarily pause the planned upgrade.
It means the footpath will remain in its poor state for now.
"It is the most incomprehensible thing ever," Mr Gillings said.
"I have no idea why they'd want to waste money in court rather than just say, 'Fine, we'll take your money.'"
The council estimated the legal proceedings could cost up to $150,000 and that money remains set aside if they recommence.
"Noone wins going to court; that's a last resort from us," Mr Dicker said.
"This has quite frankly wasted over $30,000 of money plus numerous hours of staff time."
Mr Gillings also said it had so far cost him $30,000 in legal fees.
Mr Gillings said the footpath stoush was the latest hurdle he had faced since purchasing the building, which had a tainted reputation.
The lodge gained the unfavourable title "house of horrors" after stories about its previous owner's treatment of discharged psychiatric patients who lived in the hotel-turned-private boarding house emerged in the early 2000s.
A class action resulted in a payout of more than $4 million to approximately 50 claimants.
In spite of its history, Mr Gillings saw a business opportunity in re-opening the lodge and has no plans of backing down in the stoush with the council.
"The moment they give me notice that they're doing it [fixing the path with asphalt] they'll be in the Land and Environment Court."

Nonna's Bakehouse has lost a $2.5-million lawsuit against its flour supplier after claiming the "inconsistent" product was ruining its bread. The dispute with Ben Furney Flour Mills reached the New South Wales Supreme Court last week after the Dubbo-based business launched legal action over more than $780,000 in invoices not paid since 2022. Nonna's Bakehouse hit back with a $2.5m countersuit alleging breach of contract and misleading conduct, claiming the mill "nosedived" the quality of its bread with "inconsistent flour". According to court documents, the bakehouse began experiencing problems in 2021 when its bread became "sticky" and absorbed less water, prompting one of its directors to urge the mill to "fix the issue". The mill investigated production data, ran test bakes, sent technical staff to the bakery and made adjustments with its milling processes, but could not identify any fault with the flour. In handing down her judgement, Justice Kelly Anne Rees found that while there may have been some variation in the flour due to seasonal factors and grain sourcing, the real shift occurred in late 2021 when Nonna's Bakehouse changed its head baker. During the proceedings the court heard Nonna's Bakehouse's technical support manager, Sergio Soria, resigned in October 2021 and that Jorge Gironda, who was not a baker by trade, took over the role. The court heard Mr Soria had explained to chief executive Sarah Furney that he did not "agree with the direction" the company wanted to head in. "This isn't Nonna's — this is not who we are or what we stand for," he said of a restructure at the company. Justice Rees found that after the change in leadership the company instructed Mr Gironda to revert to its "original recipe," which contributed significantly to the baking issues. "This departed from Mr Soria's process of adding gluten or malt if needed to achieve a consistent baking product," Justice Rees found. Court documents showed that following a change in bread quality Mr Gironda emailed the mill and insisted it was its job to supply "the right fuel to run the Ferrari". When the mill failed to identify any fault with the flour Mr Gironda requested tests on each bag of the product and not just the bulk tankers. Justice Rees found that despite being told the mill could not meet the bakery's specific needs, Nonna's Bakehouse continued to order flour and refused to adapt its process, which was not required under the contract. In May 2022 Nonna's Bakehouse stopped paying its invoices to the flour mill and, after ignoring offers to set up a payment plan, Furney's ceased supply by August. Justice Rees also ruled that the bakehouse's claims of financial hardship as a result of the mill and its "inconsistent flour" were unsubstantiated. "What is immediately striking from the historical financial performance of the baker, for the 2019 to 2023 financial years, is the significant increase in the baker's sales over those years, increasing by 45 per cent overall," she said. She ruled in favour of Ben Furney Flour Mills and ordered Nonna's to pay $783,178, plus interest and legal costs.

Houses with a price tag below $2 million could soon vanish from Sydney's inner suburbs, with less than 100 houses currently listed below this threshold within a 10km radius of the city. It's come as agents warn $3 million has already become the norm for most houses in areas within Sydney's inner ring, with prices above $1 million largely the norm for most inner apartments. Research from Ray White Economics showed the cheapest inner suburbs were currently a strip of suburbs under the flight path of Sydney Airport, including Tempe, Sydenham and St Peters. Houses in these suburbs had a median price of about $1.7 million but, being smaller areas, rarely had properties available for sale. And the prices are going up. The next cheapest suburb within 10km from the city by median house price was Mascot, where houses commanded prices of about $1.95 million. Thereafter, Marrickville had the next cheapest houses, with typical prices of about $2.1 million. Ray White Economics data analyst Atom Go Tian said expensive prices in inner suburbs were affecting the entire market as it meant even families on decent incomes were being pushed out. 'We're very close to, or may have already reached the point, where sub-$2 million houses disappear entirely from 'easy reach' of the CBD,' he said. 'As each distance band fills up with expensive housing, buyers are pushed further out, creating a ripple effect that inflates prices in previously affordable areas.' Even the cheapest detached housing in much of the area within 10km of the CBD was out of reach for families on fairly decent incomes, Mr Go Tian added. 'The implication is that even with dual professional incomes, many households are effectively locked out of inner Sydney,' he said. '(That's) unless they have substantial family wealth or equity from previous property ownership. 'This effectively creates a two-tier system where property ownership in inner Sydney becomes increasingly dependent on intergenerational wealth transfer rather than earned income alone.' With limited options to buy houses within a 10km radius of CBD, PropTrack data indicated buyer competition has been ramping up – especially since interest rates were cut earlier this year. PropTrack reported an average of over 100 'key' buyers per listing for houses in Rosebery, in the inner south, and in coastal suburbs Coogee, Clovelly and Rose Bay. Key buyers were those who had inquired about listings with agents by phone, text, email or submitted an online request for an inspection. Adrian Tsavalas, the director of inner west agency Adrian William, said there were simply not enough houses within inner suburbs for the numbers of buyers who wanted them. 'It's just pure supply and demand and that's why the prices keep going up,' he said. 'It won't be long until there are no longer any opportunities to buy under $3 million close to the (CBD). We've already seen that happen with $1 million and then $1.5 million. It's inevitable.' Data showed prices in Sydney's middle ring suburbs – between 10km and 20km of the CBD – were generally cheaper than those closer to the CBD but remained a big ask for house buyers on regular incomes. House prices across most of this region were also above $2 million, with a cluster of suburbs that roughly followed the Bankstown train line in the southwest offering the most affordable options. This grouping included neighbouring suburbs Wiley Park and Lakemba (the only two middle-ring suburbs with a median house price below $1.4 million) and Greenacre, with a median of $1.45 million. Once house seekers went between 20km and 35km outside of the CBD, some of the cheapest options included southwest suburb Fairfield (median $1.12 million) and nearby Canley Vale ($1.22 million). 'Areas like Fairfield East, Granville-Clyde, and Auburn have industrial heritage that has historically kept residential prices lower,' Mr Go Tian said. 'The data shows cheaper areas are typically those with longer commute times or poorer transport connections, suggesting infrastructure hasn't kept pace with housing demand.' Marrickville resident Monica Wulff said she wasn't surprised to learn her area offered home buyers some of the best bang for their buck closer to the city. 'The houses are a lot bigger than in the surrounding areas and you get this access to culture while still being convenient and quiet enough to raise children,' she said. 'Our house has a big garage, new kitchen, space to breathe and a bit of a backyard and we didn't find you could get that kind of value even in places a little further out like Leichhardt.' The couple are now selling their Philpott St house at auction August 2 to be closer to family. Ms Wulff said cheaper prices in outer suburbs were not really an option for them. 'We need to be close to the city. It needs to be accessible. We got that in Marrickville but it's not easy to find that (in Sydney).'

Sydney's CBD is soaring to new heights with plans for two new skyscrapers that will eclipse the city's tallest buildings and dramatically transform the skyline. The City of Sydney council has endorsed proposed changes to planning rules which will increase the maximum height and floor space of new buildings. Lord Mayor Clover Moore said the proposal is in line with the Central Sydney planning strategy, a blueprint for height and floor space growth – the most significant review of planning in the city centre in over 45 years. The changes will increase the maximum permitted building height on in a precinct on Pitt St to 310m. This would be marginally higher than Sydney Tower – currently the tallest structure in the city. MORE: Sydney tenant slugged with $520k bill The proposal would be for a 70-storey commercial building at 56-60 Pitt St. Included in the proposal would be plans for public spaces and a pedestrian through-site link connecting Pitt St to Spring and Gresham streets. Another proposal to enable a second 300m-plus tower is also being finalised before public consultation. This second tower would be nearby at 1-25 O'Connell St and would be 319m. The 71-storey skyscraper and adjoining development will provide 150,000 square metres of commercial floor space. The space would include a public through-site link and precincts logistics hub, a shared loading dock for businesses in the precinct and adaptive reuse of heritage buildings. Both sites are located in the northern tower precinct of Central Sydney favoured by financial, legal, property and technology sectors, according to the City of Sydney. The strategy works to allow the skyline to rise at the same time as ensuring sunlight continues to reach popular public spaces such as Hyde Park and the Royal Botanic Garden. According to Ray White Head of Research Vanessa Rader, building skyward is strategic and practical to grow in the city centre. 'Sydney historically has had lower height restrictions in order to keep Sydney Tower as the highest landmark,' she said. 'You look at other cities like Melbourne – they have much higher buildings. 'Sydney Tower is a bit of an ageing building now when you look at the new buildings that are coming up. Just look at Barangaroo and Crown – its great to see that we are competing with the rest of the world in terms of having these landmark structures.' Ms Rader said the development around the CBD and existing public transport also creates hubs which take a leaf out of international cities transport orientated, high density developments. 'We are probably going to go through a period of seeing consolidation of sites – like the one on Pitt Street,' she said. 'A lot of kind of smaller, older style buildings or secondary buildings consolidated into these larger sites in order to cater to these new, beautiful and premium buildings.'
