
Karnataka High Court finds no fault in government's policy of not providing roster-based reservation for honorary posts of anganwadi workers
'...the post of the anganwadi worker is honorary and persons selected to these posts will be paid a honorarium and they are not entitled to a salary... hence it is not required for the State government to follow the reservation roster,' the court observed.
Justice M.I. Arun passed the order while dismissing a petition filed by 28-year-old Vijayalakshmi of Vijayapura district. The petitioner, who belongs to the Scheduled Tribe community and an aspirant to the post of anganwadi worker, had questioned the government's action of not providing caste-based reservation while appointing persons as anganwadi workers.
However, the government said that it is appointing persons from Scheduled Castes and Scheduled Tribes as anganwadi workers if the population of these communities in the area of the anganwadi centre is more than 40%.
The population of the ST community in the area of the centre to which the petitioner is seeking appointment is very low, and hence the government has not provided posts for persons from this community, the court said, while pointing out that the petitioner, who may not be meritorious to secure honorary posts, had raised the issue of reservation.
The government also pointed out to the court that anganwadi workers are required to inspire confidence of all the villagers and care for all the children irrespective of the community, and a person is chosen to these posts taking all these factors into consideration.
'Courts should be reluctant to interfere with the legislation or policy on reservation of the State unless it is shown that they are ultra vires the provision of the Constitution,' the court said, while pointing out that the government's policy on not providing roster-based reservation for the post of anganwadi workers is not contrary to the Constitution.

Revanth Reddy contested BJP MP Nishikant Dubey's statement 'without Modi, BJP will not get even 150 seats'. Under the leadership of Rahul Gandhi, the Congress will register a resounding victory in the next general election and 'BJP's tally in the Lok Sabha will not cross 150', Revanth observed. Soon after coming to power, the 'People's government' in Telangana conducted the caste census to provide 42 per cent BC quota in education, employment and political opportunities in local bodies. Caste Census meant rendering social justice to the backward communities, the Chief Minister underlined. The Chief Minister took potshots at BJP leaders for repeatedly questioning the contribution of the Congress to the country.

Election system 'already dead' in country: Rahul
New Delhi: Congress leader Rahul Gandhi on Saturday said he will soon release an "atom bomb" of data that will send shockwaves through the election system, alleging that it is "already dead" and the 2024 Lok Sabha elections were "rigged". Addressing the inaugural function of the day-long legal conclave on the theme 'Constitutional Challenges: Perspectives and Pathways', he also claimed that the prime minister is sitting on his chair with a "thin majority" and had there been a difference of a few seats, he would have not been there. Gandhi cited data collected by the Congress from an assembly constituency in Karnataka, where the party checked the photographs and names of electors physically and reportedly found out that 1.5 lakh votes were "fake" out of a total of 6.5 lakh voters. "You will see the shockwave that is going to go through the electoral system when we release this data. It is literally like an atom bomb," the Congress leader claimed. "The truth is that the election system in India is already dead. Please remember one thing that the prime minister of India enjoys a very slim majority. If 10-15 seats were rigged, and we suspect the actual figures to be closer to 70-80 to 100, he would not have been the prime minister of the country," the Leader of Opposition in Lok Sabha claimed. "In the coming few days, we are going to prove to you without any doubt how a Lok Sabha election can be rigged, and it was rigged," he alleged. Gandhi will make public details of the "anomalies" in voter list in the constituency in Karnataka on August 5 at Bengaluru's Freedom park. Sharpening his attack on the Election Commission, the former Congress chief said, "It's very clear that the institution that protects this (Constitution), and defends it has been obliterated and taken over." Gandhi also said that he did not have the proof earlier and that is why he could not make such statements before. "But, I am making this statement confidently now because I have 100 per cent proof. And, whoever I have shown it to has fallen off the chair. They literally said how it is possible. But it is possible, it's happening, literally," he claimed. Gandhi said he has been speaking about the election system as he always had a suspicion that there was something wrong. "Right from 2014, I had a suspicion that there is something wrong, something is not adding up. I had suspicions about the Gujarat Assembly elections... About this ability to score sweeping victories. Congress doesn't get a single seat in Rajasthan, doesn't get a single seat in Madhya Pradesh, doesn't get a single seat in Gujarat... This was surprising to me," he said. Gandhi said in Maharashtra three formidable parties "suddenly evaporated" in assembly elections after winning clearly in the Lok Sabha elections a few months ago. Noting that it was in Maharashtra that started to look seriously into electoral malpractice, he said, "We found it clearly that one crore new voters showed up between Lok Sabha and Vidhan Sabha and bulk of those votes go to the BJP. Still, we didn't have clear proof. When I mentioned to my allies that a clear cheating had happened.

HC dismisses bail plea of main accused in removing national flag from a Gurugram mosque
The Punjab and Haryana high court has denied anticipatory bail to a Gurugram man who allegedly replaced the national flag atop a mosque with saffron flag observing that conduct of the petitioner had 'serious communal and constitutional implications'. He had argued that was falsely implicated in this case and had no role to play in the entire incident. (Getty Images/iStockphoto) 'The allegations against the petitioner are not vague or general in nature but are specific and substantiated by initial investigation, including purported conversations between the petitioner and the co-accused during the commission of the alleged act. The gravity of the offence and its potential impact on public order and communal peace cannot be overlooked at this stage,' the bench of justice Manisha Batra observed while dismissing the plea from one Vikas Tomar from Gurugram. He had approached high court seeking pre-arrest bail in an FIR registered on July 7 this year under Sections 299,3(5),61(2)AND 2 of Prevention of Insult to National Honours Act, 1971 and causing disappearance of evidence at Bilaspur police station in Gurugram. He had argued that was falsely implicated in this case and had no role to play in the entire incident. Allegations were that on July 7 police received information that the national flag being hoisted on a mosque was replaced with another flag in a Bilaspur locality by unsocial elements. The complainant gave three names to the police and also provided an audio and video recording. During the probe petitioner's role had surfaced, the police had told the court. State's counsel had told the court that there are serious and specific allegations against the petitioner who with an intent to create communal tension in the vicinity, had got the national flag hoisted in the mosque of village Uton removed and instead unfurled a saffron flag in place of the same with an intent to cause hurt to religious feelings of the members of Muslim community. For conducting a deeper probe, custodial interrogation of the petitioner is must. Hence, pre-arrest bail be not allowed, the state's counsel had told the court. The court observed that no extraordinary or exceptional circumstance has been brought on record by the petitioner that would warrant court's interference in his favour. '…in light of the serious communal and constitutional implications of the alleged conduct. …custodial interrogation of a suspected person is qualitatively more elicitation oriented than questioning a suspect …(on anticipatory bail). Many useful information can be disinterred during custodial interrogation,' the bench said dismissing the plea and adding that a deeper and proper probe is required and the custodial interrogation of the petitioner is 'must'.
