
Overly bureaucratic policies to encourage entrepreneurship need to be reviewed
It's a truism at this stage, but uncertainty has become the new normal.
Understandably, there is concern among Irish policymakers, and indeed the general public, as to what the new economic dispensation will mean for Ireland's FDI-led economic model.
FDI companies operating in Ireland deeply value their presence here and the contribution this has made to their business.
Many companies have invested heavily in Ireland and dismantling investment of this nature and locating it somewhere else is not easily done, even if firms were minded to do so.
And though we don't detect any appetite of this nature in the market there is an issue, however, in relation to further growth of Ireland's stock of FDI in future.
The continuing uncertainty is having an impact on firms' investment decisions as they look to incorporate a 'wait-and-see' approach.
In this context, it is important to look at Ireland's capability to continue to deliver economic and employment growth in a (still hypothetical) world where the level of FDI is lower than it has been.
The health and prosperity of our homegrown businesses will be vitally important in this scenario.
Ireland has a track record of generating world-beating businesses, but the reality is the current policy environment is not calibrated to achieve our full potential in this area.
Successive governments have sought to introduce various policies to foster more entrepreneurship.
Adjustments are made year-to-year across budgets, but the day-to-day reality has been that the design of some of these schemes is not suitable to achieve the desired ends.
Tax practitioners like myself and my colleagues are seeing this on a regular basis as we seek to help clients utilise these schemes.
KEEP scheme
Take the KEEP scheme for example. This is designed to enable companies to grant share options to employees on a tax-efficient basis, essentially so the share is taxed within the capital gains bracket rather than the income tax bracket.
Granting share options to employees is a good way of supplementing their remuneration in an environment where large firms with deep pockets are competing for the same talent.
The issue with KEEP, unfortunately, is it is not working in practice; take-up is extremely low.
What we see in our practice is that firms will tend to opt for so-called 'unapproved' share schemes rather than KEEP, even though the unapproved schemes are taxed more heavily from the perspective of the employee.
Why are they doing this? The biggest reason we can see is the limit that attaches to the total value of share options that can be issued to an individual employee (€300,000).
There is also a limit of €6m on the total amount of share options that can be issued (across all employees) and unexercised at any point in time.
These limits restrict firms' ability to offer really competitive packages across their companies.
Instead, they are opting for unapproved schemes that mean employees can be offered a higher value of share options, albeit in a less tax-efficient manner.
The UK equivalent of KEEP, which has much less red tape attached, works much better, and the Government should look to draw lessons from it.
Angel investor scheme
On March 1, the Government commenced the new angel investor relief scheme which aims to incentivise investment in startups by reducing capital gains tax to 16%-18% on the sale by angel investors of these investments.
It is early days, but we are not optimistic for take-up.
Again, there is a lot of administration work involved for the small firms that are the targeted beneficiaries.
They need to hold two certificates, showing they are an innovative company that is a going concern, and obtaining these involves an application process which many companies would need to undertake.
In addition, investment by family members, a common source of funding for early-stage companies, has restrictions attached.
Taken together, we believe these will serve as a significant brake on uptake of this scheme.
A relaxation of the restrictions on family members and a self-declaration process allowing firms to obtain the qualifying certificates would be preferable.
Another way to increase take-up would be to allow the relief to apply where investment is directed towards follow-on or expansion funding, rather than simply angel investment.
The above are two examples of how Ireland's policy regime could be enhanced to encourage more entrepreneurship.
There are others, including changes to the oft-criticised entrepreneur's relief scheme.
We know we have a fantastic, knowledgeable, skilled and talented workforce. We are lucky to have it.
But at a time like now, when the outlook for growth in FDI is hazy, it's important that we consider how to drive homegrown businesses forward.
In this regard, a wholesale government review of policies towards entrepreneurship is warranted.

Broad public support for a mandatory pension scheme
The new auto-enrolment pension, called My Future Fund, is due to begin from January after more than two decades of promises to launch such a scheme. Now a survey has found that more than eight in 10 Irish adults believe it is fair to automatically sign workers up for the new pension scheme. The findings came in a survey of 1,000 adults nationwide by Ask Acorn, a nationwide network of financial intermediaries. Under auto-enrolment, workers aged between 23 and 60 who earn more than €20,000 and are not already in an occupational pension scheme would automatically be enrolled in the new pension plan. These workers will have the option to opt out after six months. However, the research suggests they are unlikely to do so. Almost nine in 10 of those eligible for auto-enrolment say they are likely to remain in the pension scheme once enrolled. Financial experts said the findings showed a strong appetite for the scheme and signalled a positive shift toward broader pension coverage But Ask Acorn experts warned that this could lead some workers to a false sense of financial security. Chief executive of Ask Acorn Keith Butler said: 'People who may have previously been putting off pension planning could see their auto-enrolment as a 'job done' moment, when in fact the scheme might not be the most suitable or sufficient option for their individual retirement needs.'

Irish exporters likely to face baseline US tariffs higher than 10pc, says Barclays
Mr Trump has threatened a 30pc rate on imports from the EU from August 1, but negotiations will continue in the meantime and it is expected that a headline agreement will be in place by the new deadline. Given that Mr Trump appears to have rejected the current draft US-EU deal, which would have kept the tariff rate at the current 10pc and exempted some goods such as aircraft, European businesses need to brace themselves for a higher rate, Barclays has warned. 'While we do not foreclose the possibility that the US and EU can still reach a provisional agreement by August 1 that maintains the average tariff on most EU goods at 10pc, we think it may be more likely than not that the tariff on the EU increases from 10pc, but short of 30pc,' it says. 'We also expect more sectoral tariffs to be announced, which could cover a largefraction of EU exports to the US.' As Mr Trump has been preparing tariffs of 15pc to 20pc on other countries, Barclays says this 'suggests to us that it may be more likely' he will fix on a number in this range for the EU as well. Many Irish businesses are already 'materially hurting' from the current regime of 10pc, according to Ibec. Fergal O'Brien, a director at the lobby group, said low-margin businesses were particularly affected, and also hit by the weakness of the dollar. 'The 10pc tariffs is layered on top of the existing tariffs, and particularly in the case of the food and dairy industry, those are quite chunky,' he said. 'The most tangible impact has been in the drinks sector. 'We still have close to 90pc of distillery capacity mothballed at the moment.' Mr O'Brien said that following the announcement of a 20pc 'reciprocal' tariff by Mr Trump on April 2, the so-called Liberation Day, some firms in the life-sciences sector considered putting staff on immediate short-term work after having contracts in the US cancelled. 'If you go to 30pc, that would raise a lot more issues in terms of the ongoing viability of supply from Ireland, or Irish companies continuing to sell into the US. We think 30pc, if that did transpire, which we don't think it will, would be extremely damaging.' Markets largely shrugged yesterday in response to Mr Trump's threat on Saturday, when he also threatened Mexico with a 30pc tariff from August 1. The Iseq in Dublin finished down almost 1pc on the day, with the stocks usually most reactive to tariff announcements disproportionately affected. Ryanair was down 1.6pc, similar to AIB, while Bank of Ireland was down 1.36pc. Also down was the Kingspan group, whose share price fell by 1.46pc. The biggest fall was experienced by Uniphar, down 1.7pc. Other European stocks also slipped in early trading, but recovered most of their losses by the end of the day. The Cac in France fell by just 0.2pc overall, while the Dax in Germany closed only 0.4pc lower, having been 1.2pc down earlier. The overall Stoxx Europe 600 index, which includes some non-EU markets, was only 0.1pc down on the day. By contrast, the FTSE index gained 0.6pc. The UK has an outline trade deal in place with the US, with a baseline 10pc tariff, leaving it largely immune from fluctuations in Mr Trump's trade policy. US stock indexes had even risen slightly by lunchtime, reflecting the fact many investors think Mr Trump won't ultimately follow through on his threats. The euro also remained unchanged against the dollar.

Last week, Social Protection Minister Dara Calleary launched a national awareness campaign for My Future Fund. Mr Butler said the Government should be encouraged by the feedback from the research. ADVERTISEMENT 'Even more important than the fact that so many support the fairness of the auto-enrolment itself is the fact that so many of those eligible plan to remain in the scheme,' he said. 'If nothing else, these results should be viewed by those with responsibility for the rollout as a compelling reason to ensure there are no further delays.' The rollout of the scheme has been subjected to repeated delays over the last two decades. Mr Butler said My Future Fund would be a good fit for many, especially those who have not yet thought seriously about pensions. 'But for others, particularly those with different income levels, career paths or retirement goals, auto-enrolment could fall short of delivering the retirement they're expecting. 'Workers should absolutely be proactive in taking some advice to determine whether auto-enrolment is truly the right vehicle for their needs, or whether the rollout is just the prompt they need to take action around their financial plans for the future.' The survey, conducted by iReach, found that four in 10 Irish adults believe it is 'very fair' that workers would be automatically enrolled to the pension scheme. A further four in 10 described it as 'somewhat fair'. One in six feel the compulsory enrolment of workers to the scheme is either 'somewhat' or 'very' unfair. The youngest age cohort surveyed are the most likely to feel it is 'very unfair' to automatically sign workers up to the scheme. Mr Butler said the findings indicated there was an obvious demand and need for the scheme. One-third of Irish workers have no pension coverage outside the state pension.
