Prosecution: Peter Anthony's review application premature as court sets next hearing over falsified UMS contract conviction
Deputy Public Prosecutor Datuk Wan Shaharuddin Wan Ladin informed a three-member Court of Appeal panel chaired by Justice Datuk Che Mohd Ruzima Ghazali that the prosecution had filed the preliminary objection on April 25, on the grounds that the applicant's (Peter's) application was premature.
'The parties have also been informed that the grounds of judgment are currently being prepared, and the prosecution is not preventing the applicant from filing the review,' said Wan Shaharuddin.
Also presiding over Tuesday's proceedings were Justices Datuk Azman Abdullah and Datuk Azhahari Kamal Ramli.
Earlier, Peter's lawyer Datuk Rosal Azimin Ahmad said they had applied for the full written grounds of judgment, which had yet to be completed.
'Our side (the applicant) had requested the court recording transcription (CRT), but we did not receive it and only have the notes of proceedings,' he said, adding that they were requesting the review to proceed based on the brief grounds of judgment given by the Court of Appeal previously.
The counsel also said they had filed a certificate of urgency as the case involved public interest, with Peter's status in the Sabah State Legislative Assembly still unresolved.
The court then fixed May 16 for an e-Review mention (via Zoom) to set the hearing date for Peter's review application and the prosecution's preliminary objection.
On March 14, Peter filed a notice of motion seeking the Court of Appeal to review and set aside the conviction and sentence it imposed on March 4 under Section 468 of the Penal Code.
Peter is also seeking the cancellation of the prison warrant dated March 4 issued to Kajang Prison, as well as any consequential orders necessary to ensure justice is served.
On March 4, the Court of Appeal ordered Peter to serve a three-year jail sentence after dismissing his final appeal against the conviction and sentence handed down by the Kuala Lumpur Sessions Court in May 2022.
Peter had earlier filed an appeal on April 19, 2023, to overturn the conviction and sentence, but this was rejected by the Kuala Lumpur High Court on April 18, 2023, which upheld the Sessions Court's decision.
He has already paid the RM50,000 fine imposed.
According to the charge, Peter, as managing director of Asli Jati Sdn Bhd, was accused of falsifying a letter from the Office of the Deputy Vice-Chancellor of UMS dated June 9, 2014, by inserting false statements with the intent to deceive.
The offence was allegedly committed at the Office of the Principal Private Secretary to the Prime Minister, Perdana Putra Building, Putrajaya, between June 13 and Aug 21, 2014, which carries a maximum jail term of seven years and a fine upon conviction under Section 468 of the Penal Code. — Bernama

Govt open to improving MyKad application process, says minister
Home minister Saifuddin Nasution Ismail said JPN already has a service charter aimed at ensuring applications are processed in a timely manner. (Bernama pic) PETALING JAYA : The home ministry is open to improving the national registration department's (JPN) MyKad application process after the Enforcement Agency Integrity Commission (EAIC) highlighted delays in processing applications. Home minister Saifuddin Nasution Ismail said today he respected the EAIC's findings, and that JPN already has a service charter aimed at ensuring applications are processed in a timely manner. 'When the public who need (JPN's) services are affected by delays, it becomes the ministry's responsibility to make improvements,' Bernama quoted him as saying. He made it clear, however, that due diligence cannot be compromised, pointing to examples where forged paperwork was used in MyKad applications. On Wednesday, the EAIC recommended disciplinary action against several JPN officers in Sabah over a delay in processing a MyKad application, stating that their sluggish response reflected a failure to carry out their duties and poor case management. The commission also recommended that JPN update its procedures to include clear timeframes for conducting investigations and improve its SOPs to ensure that officers are given sufficient time to effectively carry out their duties. Set up in 2011, the EAIC is a federal statutory body tasked with investigating and conducting hearings into complaints against some 20 enforcement agencies.

STAR not planning to quit GRS, says Kitingan
Jeffrey Kitingan reaffirmed STAR's commitment to GRS, of which it is a founding member. (Bernama pic) PETALING JAYA : Parti Solidariti Tanah Airku (STAR) is not planning to leave the Gabungan Rakyat Sabah coalition, says its president, Jeffrey Kitingan. Kitingan said the viral TikTok video clip of him suggesting otherwise had been misinterpreted and taken out of context, The Daily Express reported. 'The clip was part of a conversation during our party's anniversary event, where I was asked what STAR would do if GRS were forced to work with Barisan Nasional and Pakatan Harapan. 'In that context, I said, 'Yes, we will leave GRS, but remain in government'. But the video only captured that line without the background,' he said. Kitingan, who is also a Sabah deputy chief minister, reaffirmed STAR's commitment to GRS, of which it is a founding member. Yesterday, GRS information chief Joniston Bangkuai also rubbished rumours that STAR is planning to quit the ruling state coalition. He said the leaders of all eight GRS components, including Kitingan, had met coalition chairman Hajiji Noor on Monday, where they affirmed their commitment to GRS. 'They were unanimous in that they must not only remain together but further strengthen GRS,' he said. GRS's eight component parties include Hajiji's Parti Gagasan Rakyat Sabah, Parti Bersatu Sabah (PBS) and STAR. Gagasan Rakyat has 26 seats in the Sabah legislative assembly, while PBS and STAR have seven and six seats, respectively. Separately, STAR communications director Jalumin Bayogoh said the party is lodging a police report over a news portal's article allegedly linking the party to the Sabah mineral licence case involving businessman Albert Tei. 'That report is false and defamatory. We will not tolerate such slander,' he said.

Sabah sports minister Ellron Angin denies role in mining graft scandal
Sabah youth and sports minister Ellron Alfred Angin has denied receiving a RM530,000 bribe in the alleged mining scandal in the state. (Facebook pic) PETALING JAYA : Sabah youth and sports minister Ellron Alfred Angin has denied a news report alleging that he accepted a bribe of RM530,000 in connection with the alleged mining scandal in Sabah. Ellron said the accusations in the report by Malaysiakini are 'baseless slander driven by immature political motives to tarnish my reputation and integrity as an elected representative'. 'I have always upheld the principles of integrity, accountability and clean governance in line with the Sabah state government's commitment to combat corruption,' he said in a Facebook post. 'I have instructed my legal team to take firm action against any party spreading these false allegations.' The Parti Solidariti Tanah Airku (STAR) deputy president's denial follows a rebuttal from party president Jeffrey Kitingan, who was also implicated in the Malaysiakini report, along with four other Gabungan Rakyat Sabah (GRS) leaders. On Monday, Sabah assistant industrial development and entrepreneurship minister Andi Suryady Bandy, and Sindumin assemblyman Dr Yusof Yacob were charged with receiving bribes related to mineral prospecting licence applications in the state. Yusof is also the chairman of Qhazanah Sabah Bhd, the state government's investment arm. Businessman Albert Wei was charged with bribing them. The alleged scandal was reported last year after a series of videos linking several Sabah assemblymen to it were leaked. The videos allegedly depicted discussions involving bribery and misconduct related to mineral exploration projects in the state. In February, MACC chief commissioner Azam Baki said the initial batch of videos lacked credibility as they had been heavily edited.
