A California mother has been charged with involuntary manslaughter after allegedly leaving her baby boy to die in a scorching hot car while she got a cosmetic lip filler procedure.
Maya Hernandez, 20, is accused of leaving her two young sons – 1-year-old Amillio Gutierrez and his 2-year-old brother – strapped into their car seats outside the Always Beautiful Med Spa in Bakersfield on June 29.
By the time she returned to her 2022 Toyota Corolla hybrid around 4:30pm, little Amillio was foaming at the mouth, convulsing, and unresponsive.
His body temperature had soared to a deadly 107F.
He was rushed to the hospital but died shortly before 6pm.
The toddler's older brother miraculously survived and has since been taken into protective custody.
Police say Hernandez initially claimed she left the car running with the air conditioning on – but when officers arrived, the vehicle was stifling hot.
Investigators later discovered the car had an automatic shut-off feature that kills the engine after one hour.
Experts say the internal temperature could have reached a blistering 143F.
The car was parked facing west, directly in the path of the setting sun, during one of the hottest times of the day – with outside temperatures peaking at 101F.
Surveillance footage reportedly shows frantic spa workers and bystanders dousing the children with water in a desperate attempt to save them.
One customer grabbed the drenched 2-year-old and took him into the restroom to cool him down.
A nurse told police Hernandez had inquired ahead of time about bringing her kids to the appointment, but made no mention of actually having them with her when she arrived.
Staff even offered to let the boys stay inside in the air conditioning - but Hernandez allegedly left them outside instead.
Cops say she didn't check on them for more than two hours.
'They were strapped in their car seats. They couldn't even get up to save themselves,' said the boys' heartbroken grandmother, Katie Martinez, told ABC 7. 'She literally locked them in and shut the doors.'
Martinez said she's been sitting in her own car with the windows up just to try to understand what her grandsons went through.
'If you just take 20 minutes out of your day and sit in your car, I think that's the only way to know how a kid feels,' she added.
Despite the horror, Martinez insists her daughter-in-law wasn't a bad mother.
'She wasn't like that. She was a really loving mom,' she said. 'Those boys loved her. They really loved her and they relied on her.'
Hernandez has pleaded not guilty to involuntary manslaughter and child cruelty.
She's being held on more than $1 million bail and is scheduled to return to court Friday for a pre-preliminary hearing.
The boys' father – Martinez's son – is currently behind bars on unrelated charges and learned of his son's death through a jail chaplain.
A vigil for Amillio was held Saturday at a local park, where stunned members of the community gathered to mourn the young boy's tragic death.
'My message to her is to accept responsibility,' Gricelda Anaya, who works next door to the spa and witnessed the chaos that unfolded, told local news outlet WKRN. 'It was something very sad that never had to happen.'
Court records reveal Hernandez previously had a run-in with Child Protective Services in March 2023 over alleged emotional abuse - but the complaint was deemed unfounded.
GoFundMe page launched by the family says they are 'broken' by the loss and struggling to cope in the wake of Amillio's death.

US FTC demands better policing of 'Made in USA' online sales claims

July 8 (Reuters) - The U.S. Federal Trade Commission on Tuesday called on (AMZN.O), opens new tab and Walmart (WMT.N), opens new tab to crack down on third-party sellers that make deceptive "Made in USA" claims on the retailing giants' online marketplaces. In letters to Amazon and Walmart, the FTC said it learned of several instances where third-party sellers falsely claimed their products were made in the United States. The FTC urged both companies to take "corrective action" against sellers whose "Made in USA" claims violate federal law and Amazon's and Walmart's codes of conduct. Four smaller retailers also received FTC warning letters demanding they cease "Made in USA" claims unless they prove "all or virtually all" of the products in question are made domestically. The four retailers are Oak Street Bootmakers in Chicago; Stand Flag Poles in Fort Lauderdale, Florida; football equipment maker Pro Sports Pads in Jacksonville, Florida, and medical products maker USA Big Mountain Paper, also in Jacksonville. Walmart had no immediate comment. The other five companies did not immediately respond to requests for comment. "Consumers want to have confidence that when they buy something labeled 'Made in the USA' they are actually supporting American workers and the American economy," FTC Chairman Andrew Ferguson said in a statement. Many companies have been accused by regulators or in private lawsuits of using imprecise labeling to induce shoppers to pay more, including through appeals to their patriotism. In 2021, the FTC adopted a "Made in USA Labeling Rule" to protect businesses and consumers. The agency later brought cases against kitchenware and home furnishings retailer Williams-Sonoma and Pyrex kitchenware maker Instant Brands, and said it obtained $15.8 million of judgments, opens new tab in 11 "Made in USA" enforcement actions between 2021 and 2024.

MTV star Whitney Purvis, who appeared on the reality show 16 And Pregnant, is on suicide watch as she is in prison over a fatal February 17 drug overdose she was formally charged with on Monday. The 33-year-old reality star is being monitored in the Georgia jail where she is being held for involuntary manslaughter according to TMZ on Tuesday. Law enforcement sources for the publication claim that Purvis was medically designated and committed within the jail system after making suicidal comments. 'John mark, I hate that I found out what happened today and missed your funeral,' Purvis wrote on the Henderson & Sons Funeral Home site. 'I wish I could've found out sooner and attended your celebration of life.' The MTV star posted the message more than three months before she was arrested Monday in Floyd County, Georgia in connection with with involuntary manslaughter and distribution of a controlled substance, among other felony counts, TMZ reported Monday. Purvis 'distributed a substance presented as "Tranq," commonly known as Xylazine and Fentanyl, to the victim, which directly contributed in the victim's death due to a toxic overdose,' law enforcement officials said in an arrest affidavit reviewed by People. It's been an awful year for Purvis, who would later pen an emotional memorial for her son Weston following his death at the age of 16 on June 2; Daily Mail has reached out to Purvis via Instagram for further comment on this story. Purvis thanked her late confidante 'for being such a great friend to me and always making me feel beautiful and cared for.' Purvis said that her late friend had been a dear one, as they grew close over their passion for cooking: 'We bonded over being chefs, our love of cooking and our struggle.' Harris had been employed as a chef at Barnsley Gardens, a popular North Georgia resort. She praised Harris for his candor and intelligence in their interactions over the years. Purvis penned an emotional statement in memory of her late friend - whose death she was subsequently charged in 'I could tell you anything and you always knew what to say or give me your honest opinion and advice,' Purvis said. The MTV alum added 'You've came to my rescue on many occasions and saved me over the years. 'I am so very thankful for the times we had together.' Purvis - who's also charged with use of a communication device to commit a felony involving controlled substances - said that she was dealing with serious emotional trauma over the loss of her friend. 'My brain just can't process this happened,' she said. 'I don't want it to be true.' Purvis listed off a number of things she associated with Harris that she would miss in the wake of his passing. 'I'll miss waking up to your silly messages and pictures you'd send me,' she said. 'I'll miss marshal and lunchbox. I'll miss your amazing cooking. 'I'll miss snuggling on the couch watching tv with you. I'll miss sitting outside, smoking camel crush cigs w/ you how we talked about talked about life, gossiping and you telling me what movies/shows I need to watch next.' Purvis characterized her late friend as 'a truly good hearted, one of a kind man' who she would 'never forget.' Purvis, who has more than 17,500 followers on Instagram, wrapped up in saying: 'Rest in peace and my condolences to your family and friends. 'I pray they are able to find some kind of comfort during this tragic time. I love you forever, John Mark. Love, Whitney.' Whitney has been arrested a number of times before. In 2015 she landed in jail after allegedly attacking ex-boyfriend, and father of her two sons, Weston Gosa, with a broom handle Following the death of her son last month, Purvis spoke on social media about how she was understandably struggling in the wake of her child's unexpected passing. 'This is so hard to write,' Purvis said. 'My beautiful son, Weston has passed away. He was only 16 years old. Life is so cruel and unfair. I just dont understand. 'Oh my baby is gone and I don't know what to do with myself. He was so perfect. This is really my worst nightmare come true. 'How do you go on in life after losing a child?' Purvis said she was 'in disbelief,' thinking that 'this cannot be happening' and that she didn't 'want it to be real.' She added of her late son: 'I love you so much, Weston Owen Gosa. I would do anything just to hold him. Words just can't describe the pain I am feeling. 'God, I love you so much. You are my heart. I was so proud of the young man you were becoming. I just can't go on without you.
